PO BOX 337 Stillwater, MN 55082 RE: Proposed Modifications to Stillwater Motors Dear Mr. Raduenz: Thank you for taking the time to meet with me again about possible improvements to your building. 1 regret to inform you that under no circumstances will the City issue any pre- emptory opinions about what a variance application (or any application for that matter) may result in. That is to say, unless and until a full application is submitted to the City Council for review under MN Stat. 15.99 and related law, the City will not be in a position to offer any binding opinions. 1n fact, as city council deliberations are quasi-judicial in nature, any pre - issued statement concept violates many due process and equal protection laws outlined within the State and /or Federal Constitution. You do have my letter dated Dec 16 2011, (attached again hereto) that outlines a staff perspective of the proposal and what the possibility of success might be should a full application be submitted. As we have discussed, the City's timeline for any development applications traditionally begins with some informal pre - development application discussions, followed by a formal submission and concludes with a Planning Commission and City Council action. Under this scenario, your formal application would need to be submitted by Feb 15 2012 in order to be considered by the City P,�ig Commission and City Council in March 2012. / Iyase.let me kn �a' if you have any questions.
