( MAY - 21997 _hI TO: Mike Robertson - -- FROM: Cary Teague /Scott Richards DATE: 1 May 1997 RE: Oak Park Heights - Ventura Homes Inc. - Minor Subdivision FILE NO: 798.02 - 97.04 BACKGROUND Ventura Homes Inc. is requesting a Minor Subdivision of Lots 11 and 12, Block 1 of the East Oaks Planned Unit Development (PUD). The subject property is located south of 60th Street and east of Osgood Avenue. The subject property has been zoned PUD as part of the East Oaks development. This Spring, construction began on a twin home over these two lots, however, the wall separating the two units was not built on the side property line, rather, it was constructed between 2.51 and 3.94 feet onto Lot 11. Therefore, the applicant is requesting a Minor Subdivision to re -align the lot line to be located over the wall which separates the two units. Attached for reference: Exhibit A - Site Location Exhibit B - East Oaks Subdivision Exhibit C - Proposed Minor Subdivision ISSUES & ANALYSIS Lot Area. Per Section 401.15.C.3 of the Zoning Ordinance, a minimum lot area of 6,000 square feet per unit must be provided for two family dwellings. As demonstrated on Exhibit B, the subject Tots are two of the larger lots within East Oaks. As such, with the re- location of the lot line between Lots 11 and 12, both of these lots exceed 8,000 square feet in size, therefore, meet the City's minimum requirement. 5775 WAYZATA BOULEVARD, SUITE 555 ST. LOUIS PARK, MINNESOTA 55416 PHONE 612-595-9636 FAX 612-595-9837 Lot Width. The Zoning Ordinance does not specifically address the minimum lot widths for this type of development. Lot widths for twin homes are determined by the lot size, setback requirements and the proposed building style. As a result of the proposed reconfiguration of the lot line, the width of Lot 11 is 39 feet and width of Lot 12 is 44 feet (measured at the required front setback line). As demonstrated on Exhibit B, these are two of the widest Tots within the East Oaks development. Setbacks. The PUD Ordinance states that all perimeter setback requirements of the underlying zoning district must be upheld. The underlying zoning district in this instance is R -B, Residential Business which requires a perimeter setback of 30 feet. The proposed subdivision will not have any effect on any required setback. Registered Survey. The applicant has not yet submitted a survey that shows the specific location of the proposed lot line, therefore, as a condition of approval a registered survey showing the new location of the lot line must be submitted.
