SCHEDULE B SECTION 1
REQUIREMENTS
The following are the requirements to be complied with and the instruments in insurable form
which must be executed, delivered and duly filed for record:
1. Empire Title Services, Inc. was not provided with the Abstract of Title for this property
and will not be responsible for locating it or for the cost of replacing it.
2. Mortgage from Ventura Homes, Inc. to Central Bank securing the property to be insured
herein in the sum of $125,000.00.
3. Warranty Deed from Thomas E. Wortman and spouse if any to Ventura Homes, Inc.
conveying in fee simple the property to be insured herein.
4. Records indicate a Judgment against Ventura Homes, Inc. in favor of Asphalt Specialties
Co. dated March 27, 1995, docketed October 26, 1995 as Case No. 82C595005159, in
the amount of $2,051.00. If this involves the Borrower /Purchaser we require a
Satisfaction or Release of Land from Judgment Lien. If not, we require an Affidavit of
Non- identity in recordable form.
5. Obtain and record a partial release or satisfaction of Mortgage dated August 25, 1994,
filed October 7, 1994 as Document No. 818654, by East Oaks, LLC to Central Bank to
secure $276,000.00.(Note: Above Mortgage amended by Document No.'s 826277 and
840977)
(also covers other land).
6. Obtain and record a partial release or satisfaction of Mortgage dated June 25, 1993, filed
July 6, 1993 as Document No. 748685, by Norris M. Swager and Gloria M. Swager,
husband and wife and Norvin L. Swager and Delores M. Swager, husband and wife to
Central Bank to secure $50,000.00.
(also covers other land).
7. Pay the full consideration to, or for the account of, the grantors or mortgagors.
8. Pay all taxes, charges, assessments, levied and assessed against the subject premises,
which are due and payable.
9. Satisfactory evidence should be had that improvements and /or repairs or alterations
thereto are completed; that contractor, subcontractors, labor and materialmen are all
paid; and have released of record all liens or notice of intent to perfect a lien for labor
or material.

10. Pay all outstanding utility, water /sewer and diseased tree removal bills prior to or at
closing. This commitment does not cover utility, water /sewer or diseased tree removal
bills against the premises not shown on tax or assessment records.
NOTE: The following exception will appear in any subsequent Owner's Policy issued
on the property described herein: Assessments and charges, if any, for utility,
water /sewer or diseased tree removal tendered by the local municipality.
11. Affidavits, on a form acceptable to the Company, indicating no judgments, liens,
bankruptcies, etc. from all parties signing deeds or mortgages in this transaction.
12. If wells are located on the property, proper and completed well certificates pursuant to
Minnesota Statue Sec. 103I.235 must be submitted at closing.
The following statement should appear on all deeds transferring title where no well
certificate is needed: "The Seller certifies that the Seller does not know of any wells on
the described real property ".
13. Picture identification will be required from all parties required to sign documents at
closing (i.e. a current drivers license).
14. Arrangements to reserve a closing date must be made through the Real Estate Closer or
Lender. These arrangements must allow for adequate time between the written Loan
Commitment and the date of closing. Failure to allow for adequate time may result in
the requested closing date not being available.
15. Pursuant to the provisions of the Tax Reform Act of 1986, all real estate transactions,
except for refinances, must be reported to the Internal Revenue Service.

Schedule B of the policy or policies to be issued will contain exceptions to the following matters
unless the same are disposed of to the satisfaction of the company:
1. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first
appearing in the public records or attaching subsequent to the effective date hereof but
prior to the date the proposed Insured acquires for value of record the estate or interest
or mortgage thereon covered by this Commitment.
2. Rights or claims of parties other than the record owner in actual possession of any or all
of the property.
3. Unrecorded easements, discrepancies or conflicts in boundary lines, shortage in area,
encroachments or other matters which an accurate and complete survey and inspection
of the premises would disclose.
4. Any lien, or right to a lien, for services, labor or material heretofore or hereafter
furnished, imposed by law and not shown by the public records.
5. Real estate taxes payable in the year 1996 and thereafter.
NOTE: Real estate taxes payable in the year 1995 and all prior years are paid in full.
