AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed
according to: (1) the conditions of this permit; (2) the
approval plans and specifications; (3) the applicable city
approvals, Ordinances, and Codes; and, (4) the State Building
Code. This permit is for only the work described, and does
not grant permission for additional or related work which
requires separate permits. This permit will expire and become
null and void if work is not started within 180 days, or if work
is suspended or abandoned for a period of 180 days any time
after work has commenced. The applicant is responsible for
assuring all required inspections are requested in conformance
with the Minnesota State Building Code.

'leant:
1. This permit has been issued for the land clearance, site/contour
grading, and erosion control The Applicant (Frattalone Companies)
shall verify ownership of all lands prior to commencing any work.
This permit dogs not authorize any work related to the installation of
utilities proposed to serve the Project (Oakgreen Village /Villas); this
work must be permitted separately and prior to any work being
commenced.
2. This permit authorizes that the Applicant for the Project, which
includes the properties as owned by Anchobaypro, Inc. shall comply
in total with the grading plans as submitted by the Developer
(Anchobaypro, Inc. / Mr. 'Tim Nolde) and as approved by the City
engineer. These plans are attached hereto an 11" X 17" format. The
Applicant shall secure fu1Isize plans Todd Erickson of Folz,
Freeman, Erickson that match, in total the attached and approved
plans. There shall be no deviations from th s1ans a roved b
the Ci En!ineer without the irior vvritken conse of the City
Eggigeer.
3. No grading shall be undertaken until such time as and all structures,
buildings, footings, septic tanks, weds, etc have been properly

4. Tree removal and tree protection shall be complaint with the approved
plan. Any persons engaged in tree clearanGe shall have an on -site
copy of their City license for tree removal. Failure to have such
license on site may result in the issuance of a "stop work" order.
5. This permit requires that all wells (if any) are located and closed
utilizing the most complete and safe process to protect groundwater
resources and per proper Minnesota Dept of Health and/or MPCA
procedures Only a Minnesota licensed firm specializing in well
closure may perform and oversee such work.
6. In areas of any suspected land contamination, such as all existing
buildings to be demolished and adjacent site areas, the Applicant shall
secure an appropriate Minnesota licensed sails- scientist or
environmental engineer to monitor and manage all excavations and/or
demolitions. Should any unsafe or improper conditions be found, all
work shall cease, the City, the Washington County Health Dept. and
the MPCA shad be immediately notified in writing and thin proper
remediation activities shall be undertaken by the Applicant to correct
and remediate any pollution sources. The City shall be notified by the
Applicant, in writing, of all remediation or correction activities.
7. Any and all excavation debris, materials and equipment being
removed from the pity and/or that will be accessing public roadways
shall be done in a method that is fully compliant with Minnesota state
law, which includes the covering of loads, proper manifesting and
final disposal.
8. No material may be removed from Project's property f development
area and replaced and/or relocated within the jurisdictional limits of
the pity of Oak Park Heights without the City's prior and
specific written consent for such placement. The Applicant
shall first verify with the City should any material be leaving the site
to a Iocation within the City. Otherwise all material shall remain either
on site and compliant with the approved plans or removed from the
City.
9, Dust control techniques such as appropriate site watering and soil
stabilizations shall be implemented and maintained at all times.
10. Operating of equipment shall not commence on at the site prior to 7
am and shall cease not later than 9 pm.
11. The Applicant shall coordinate with the owner(s) to ensure continued
compliance with all applicable terms and conditions of the
Development Agreement for the Project.
12. Site access shall be from Nova Scotia Ave., but subject to City
closure and needed City operations without notice. City streets shall
be jiept free of debris, dust and dirt at all times by street sweeping
equipment that applies water, performs an agitation and then collets
such material. Failure to comply with maintaining pity streets in
proper order shall result in the issuance of a "Stop-Work" order until
such time as the City street(s) is brought into compliance.
13. Any damages to City infrastructure by the Applicant or their
subcontractors will result in the City nit- issuing further building
permits until such time as the City is compensated for such damages
and/or damages are repaired to pity standards.
14. "As- built" drawings shall be provided to the City indicating that the
grading performed has conformed in total to the approved plans. Such
"as- built" drawings shall be provided by the applicant required to be
provided to the pity prior to the issuance of any building permit.

Village development as submitted by Folz, Freeman, Erickson, Inc on August 9, 2006 The
revised plans have addressed all previous comments,.
A copy of the Approval letter from the Middle St. Croix. Water Management Organization shall
be submitted to the City prior to issuing a grading permit.

normal font, response in italics):

4. The drainage calculations for this project use a post - development curve number of 58 (meadow) for
lawn areas. A curve number of 61 should be used for lawns with good grass cover on B soils (USDA
TR-55, Urban Hydrology for Small Watersheds).
Drainage calculations reflected appropriate curve numbers.
5. A. professional wetland delineation and report, including information on any required wetland setbacks,
must be submitted.
