Dear Mr. Nolde, As we have discussed in the past, the City is generally prepared to install the aprons, sidewalks and utility stubs as would be necessary and related to your Phase I approval for Oakgreen Village. These items could be installed under the City's contract with Burschville on the Nova Scotia Project thus potentially saving time and money. Currently, we do not have a completed Development Agreement which would ensure reimbursement of the City to install these items. While we are moving forward on that document I am unsure of the tinning and filing of all the other related documents. Accordingly we could treat these as separate items for construction sake. In order for the City to install these private improvements with the City's contractor the City would need some form of security from you, cash or letter of credit and in an amount of 125 percent of the anticipated costs. 1 do not know what these costs are at this point and is something that perhaps you could discuss with Todd Erickson. Perhaps in the $100,000 range? Additionally, at this time I am in need of a letter from you committing to paying these fees upon receipt of a bill from the City for the above work. Lastly, I would recommend that you prepare to issue a security to the City when better estimates are available so as to not cause any design or installation delays. However again please note that I am only guessing on the above amount. Please let me know if you have any questions. / , Regards, Eric Johnson City Administrator PS. —I have also enclosed a memo from Scott Richards outlining the anticipated Park Dedication Fees, It is my understanding that these would be for all properties own by you for Phase I and the other areas that conceivably could come in under your Phase II design. Those other few properties you are working on purchasing would be part of new plat I land assembly and such dedications would be picked up at that time.
