Oak Park Heights, MN 55082 Re: Special Event Signage, Outdoor Garden Center Lighting & Drive Access /Maintenance Dear Mr. Friday: This letter serves as follow of my March 19, 2012 letter to you and our subsequent telephone conversation. From our conversation, it is my understanding that the drive access at 60th Street has a work order currently pending with Wal- Mart's facility team and is scheduled to have the asphalt replaced. You indicated that you anticipated this work to be completed prior to the compliance deadline of June 30, 2012. You did address the special event signage matter, which was inspected for compliance shortly after our conversation and found satisfactory. Please note that since that time, signage has been placed at the auto area entry. Please have it removed immediately. You were provided the information for obtaining special event permits for this type of signage. Please apply for the permit as required prior to placement of any additional signs to the store exterior. There is no charge for special event permits. Continued non - compliance to this City Ordinance requirement is a misdemeanor violation to which you will be subject to citation. Lastly, with respect to the full -cut off requirement for exterior lighting at the outdoor garden center; I did pull up the development approvals for the store to determine what, if any, requirements were established for the outdoor area and to locate a drawing such as you indicated that showed the outdoor garden sales area with a covering that shielded the lighting. As communicated back to you, I was unable to locate any such drawing. The drawings to this area show the area as it is presently - an open air outdoor area. City of Oak Park Heights Scott Friday April 9, 2012 Wal -Mart Supercenter #1861 Page 2 The Conditional Use Permit granted to WaI -Mart in 2005 and to the outdoor sales and storage for the Garden Center state that the lighting shall comply with the requirements of the Zoning Ordinance. That being said, compliance to the City Zoning Ordinance 401.15.B. as it relates to Outdoor lighting and as discussed in my March 19, 2012 letter to you must be met prior to June 30, 2012 as earlier requested. Please review the material I provided to you as a guide to effectively shield the light fixtures at the outdoor garden area, including those over the sales tables, so that they are provided with a 90- degree cutoff angle to accomplish a full or total cut off as required by City Ordinance. Among other possibilities, full or total cutoff may be obtained by replacing the shields to the fixtures or modifying them to meet the cutoff requirement. I would be happy to review your corrective plan, prior to your making compliance corrections to the fixtures. If I can provide you with any additional information, please do not hesitate to contact me. Thank you for your attention to addressing the matters herein.
