SPECIAL CONDITIONS
•
1. This permit allows for the composting of leaves, grass and brush and the processing of tree waste.
No tree waste greater than 12 inches and no stumps are to be brought on -site.
2. Improvements and activities must take place in the area shown on the site plan dated September 26,
1995. All access to the site must be from Memorial Drive. No driveway of any type is to be
constructed onto Highway 36.
3. Grading/drainage improvements must take place in accordance with the approved grading/drainage
plan dated September 26, 1995, and revised October 19, 1995. Silt fencing shall be erected prior to
grading, and the east property line must be staked prior to grading.
4. Screening must take place in accordance with the approved landscaping/screening plan dated
September 26,1 995. The berm and tree planting must be in place before any waste is brought to the
site. Any trees not surviving must be replaced immediately. If the screening is deemed inadequate,
the County can request additional screening.
5. Equipment must be operated in a manner so as to comply with noise standards of Washington County.
6. The owner /operator may process only tree waste, yard waste and untreated wood.
7. Once the operation begins, additional conditions may be added to this permit to assure the use is not
detrimental to the area and the site is adequately screened.
8. Open burning is prohibited.
9. Burial of waste is prohibited.
10. No tree waste shall be delivered before 7:00 a.m. or after 7:00 p.m. and no equipment shall be
operated before 8:00 a.m. or after 4:30 p.m. on weekdays and 9:00 a.m. to 4:30 p.m. on Saturdays.
There shall be no operation on Sundays.
11. The owner /operator shall maintain the site so that it is free of litter and other nuisances.

12. Odors emitted from the facility must not exceed the limits specified in MN Rules parts 7005.0900 to
7005.1400.
13. Composted yard waste offered for use must be produced by a process that encompasses turning of the
yard waste on a periodic basis to aerate the yard waste, maintain temperatures, and reduce pathogens.
The composted yard waste must contain no sharp objects greater than one inch in diameter.
14. By- products, including residuals and recyclables, must be stored in a manner that prevents vector
problems and aesthetic degradation. Materials that are not composted must be stored and removed
at least weekly.
15. All waste or other unauthorized materials must be removed from the site prior to closure. Closure
shall be approved in writing by the Department.
16. A $10,000.00 financial guarantee must be posted with Washington County upon expiration of the
$2,500.00 financial guarantee to assure proper closure of the site. A $10,000.00 financial guarantee
must be posted to assure landscaping and other site improvements are completed in accordance with
this permit.
17. Violation of any conditons of this permit or any other provision of the Washington County Zoning
Ordinance may result in revocation of this permit.
