IRREVOCABLE LETTER OF CREDIT NO. 144

Gentlemen:
We hereby establish our Irrevocable Letter of Credit in
your favor at the request of and for the account of Robert
Buberl (hereinafter called: "Principal "), in the aggregate
amount of Ten Thousand and No /100 U.S. Dollars ($10,000.00)
available upon surrender of this Letter of Credit to us
accompanied by your sight draft(s) drawn on us and the
following documents:
(1) A certificate signed by an authorized officer of
the Town of Baytown stating that there has been a
default in the construction of a Morton building,
being constructed on Lot Five (5), Block One (1),
KERN CENTER; the Certificate shall also state:
a) the nature of the default;
b) that the builder has received Notice of
Default, but has not cured the default;
c) the amount to be paid to the city; and,
d) the amount to be retained as security under
the Letter of Credit.
All drafts so drawn must be marked "Drawn Under
Irrevocable Letter of Credit No. 144 ".
We engage with you that all drafts drawn under and in
compliance with the terms of this Irrevocable Letter of
Credit will be duly honored if presented during regular
business hours at our main office located at 11465 39th
Street North, Lake Elmo, Minnesota 55042, before 3:00 P.M.
on or before August 1, 1993.
Communications relative to this Irrevocable Letter of
Credit should be addressed to the address specified above to
the attention of "Cashier ", mentioning specifically our
Irrevocable Letter of Credit No. 144.

This Letter of Credit shall be governed by and construed
in accordance with the laws of the State of Minnesota,
including the Uniform Commercial Code in effect in said
state.
Except as otherwise stated herein, this Irrevocable
Letter of Credit is subject to the Uniform Customs and
Practice for Documentary Credits (1983 revision),
International Chamber of Commerce Publication No. 400.

SPECIAL CONDITIONS
•
1. All applicable provisions of the Washington County Zoning
Ordinance as well as any more restrictive provisions of
Baytown Township concerning commercial development shall be
complied with.
2. A septic system must be installed in accordance•with a permit
issued by Washington County. A separate holding tank
connected to the floor drain in the building must also be
installed.
3. On -site drainage shall comply with the grading and parking lot
grade - elevations plan as indicated on the submitted
grading /drainage plan. The grading /drainage plan must be
approved by the Washington County Soil & Water Conservation
District. All recommendations of the Soil & Water
Conservation District must be followed.
4. Design and location of access drives shall be located as
indicated on the approved site plan. Parking and internal
circulation shall comply with the final plan as submitted.
5. All drives and parking areas shall be paved with bitumen
before the establishment opens for business. A minimum 4 inch
white strip shall delineate each parking space. Handicap
•
parking must be provided in accordance with State and Federal
Laws.
6. All turfed areas on the parcel that have been disturbed or
• destroyed during the construction phase of this project shall
be graded with topsoil and sodded.

7. Erosion control barriers must be installed in accordance with
the Soil & Water Conservation District recommendations.
8. All plant materials listed on the landscape plan shall be
planted and maintained. The survival' rate of all plant
materials shall be one hundred percent (100%). Dead plant
materials shall be replaced as necessary during the
appropriate planting season. A berm with evergreens must be
installed on the north property line. Evergreens shall also
be planted on the south property line, except for a 24 foot
opening. If the owner does purchase the lot to the south
by August 1, 1993, this 24 foot wide opening shall be
landscaped.
9. All waste materials and refuse shall be in an area enclosed
and /or screened from all public streets and adjacent
properties.
10. The conditions of this permit shall apply to the land
described and shall not in any way. except as herein noted be
• affected by any subsequent sale, lease or other change from
the current ownership.
11. Any proposed alterations to the subject plans shall be
reviewed and approved by Baytown Township and Washington
County and shall require an application for an amended
• Conditional Use Permit and Certificate of Compliance.
12. Design. locations and specifications of signs shall conform
with the Washington County Zoning Ordinance. All signs shall
require a sign permit to be issued by the Washington County
Zoning Administrator.
13. This permit shall not be considered a building or sign permit. •
14. Noncompliance with the conditions and attachments of this
permit shall be considered a violation of said permit and may
result in revocation of said permit.

15. Construction shall begin within one (1) year after issuance of
this Certificate of Compliance or this permit shall be void.
16. A $10.000.00 irrevocable letter of credit or other acceptable
financial guarantee shall be submitted to Baytown Township to
insure compliance with the Conditional Use Permit. This
Certificate of Compliance shal 1 not valid unti 1 said letter
of credit has been submitted.
17. This permit shall be reviewed within one year.
18. The property must be maintained in a neat and orderly manner.
