A MINNESOTA STAR CITY • February 3, 1993 St. Croix Bowl 5862 Omaha Avenue North Oak Park Heights, MN 55082 Re: Accumulation of Ice Gentlemen: Public utility crews for the City of Oak Park Heights have noticed that there is a significant accumulation of ice in the private drive on the east side of your property. As you may be aware, the city street (Omaha Avenue) ends at the entrance of the K -Mart parking lot and the projection of the travelled portion of the street area extending along the east side of your property is common area within the St. Croix Mall PUD. As common area, it is not the responsibility of the City of Oak Park Heights to maintain that area, although the City plows have on occasion passed through the area and attempted to clear some of the ice and debris as they did so. However, the City is not authorized to be in the common area as it affects removal of ice and snow and the current accumulations of ice along that private drive appear to make passage for pedestrians and vehicular traffic unsafe. We are taking this opportunity to advise you that the City does perceive a public safety risk in the area adjacent to your property on that private drive or common area and is requesting that you and other affected parties within the St. Croix Mall PUD take appropriate action to clear the area of accumulations of ice and snow. It would appear also that much of the problem as it affects . the accumulation of ice is directly related to a drainage issue as it affects the St. Croix Bowl property. Because the area is not a public street the City of Oak Park Heights will not be able to provide any assistance as it affects removal of snow and ice in the area.
