Gentlemen: The above -named organization was granted a Class B license sometime in August of 1989. The applicants appeared before the City Council of the City of Oak Park Heights at its July 24, 1989 meeting, and indicated they would be sending the City monthly financial statements. The City has written to this organization on several occasions requesting a list of donations that have been made from the charitable gambling at the St. Croix Bowl, but no reply has been received. We wish to advise you that the City is not receiving the cooperation represented by the applicants to the City Council at the aforementioned meeting. It would be appreciated greatly if the Charitable Gambling Control Board could advise this organization that the City expects to be furnished with the information requested. Any amendments to this lease must be furnished to the Charitable Gambling Control Board at least 10 days prior to the effective date of the change. If said amendment would cause loss of license, it shall be negated. • 3. Both parti„ will comply with all Federal, State, and Local Laws pertaining to the conduct of games of chance. ` 4. First Party agrees that only one eligible organization at a time may operate on the above stated premises and that this premises shall be subject to rules adopted by the Charitable Gambling Control Board of Minnesota. 5. This agreement may be terminated upon the giving of thirty (30) days notice by either party, said notice to be in writing. 6. Brief description of the general area leased by the Second Party: 7. The signing of this agreement signifies nullification of any previous agreements made by and between First and Second Party or by and between First Party and any other eligible organization for the purposes of con- ducting games of chance. Over the past five years Celebrity Bowl Charities has funneled approximately quarter of a million dollars into Camp Confidence, Shriners Heart Hospital, Ronald McDonald House and other charities. The source of funds thus far has been a variety of activities such as Bowling tournaments throughtout the state. Now the Board of Celebrity Bowl Charities is applying the resources of the organization, and its already rigorous accounting and reporting system, to systematically sponcering pull tab operations in any community where a bowling proprietor member of Celebrity Bowl Charities operates a business. In the Bowl is one of these businesses. The guiding principle for managing the pull tab profits is to support local charitable and non - profit organizations providing universal benefit to the community. Youth programs, programs for Seniors, or ones for disadvantaged people of all ages are examples of acceptable programs deserving support. We urge you to support Celebrity Bowl Charities as we move forward in making the community of an even better place to live, through systematic and aggressive support of local charitable and non - profit organizations. Present: O'Neal, Seggelke, Doerr, Kern, Eckberg and Wilson. O'Neal, seconded by Kern, moved to adopt Resolution #89 -7 -39 adopting the Oak Park Heights Housing and Redevelopment Authority Bylaws as amended. Roll call vote taken with 5 aye votes cast. Resolution adopted. Doerr, seconded by Seggelke, moved to close HRA meeting. 5 aye I / `votes. Carried. Stan Palmer and David Savoie requested a gambling license for the St. Croix Bowl. Discussion ensued. Seggelke, seconded by Doerr, moved to direct Clerk to sign waiver to allow pulltabs for Celebrity Bowl Charities to start as soon as approved by the State Board. Monthly financial report to be sent to the City. 5 aye votes. Seggelke, seconded by O'Neal, moved to adopt Resolution #89 -7 -40 authorizing Mayor and Clerk to sign Breckenridge Development Developer's Agreement contingent on funds required being received by the City. O'Neal, seconded by Kern, moved to approve Change Order #2 on Hall Addition and Remodeling project in the amount of $692.00. 5 aye votes. Carried. Rules, Chapter 786 Subp. 2 and 3, provide that your organization still has the obligation to report expenditures, to have the expenditures authorized by your organization, and to expend funds only for lawful purposes. Until the profit carry —over is lawfully expended, your organization still retains the obligations listed above. Minnesota Statute, Section 349.162, Subd. 4 states, "No person other than a licensed organization or a licensed distributor may possess registration stamps issued by the board." Because your organization is no longer licensed at this premises, any registration stamps on unused gambling equipment must be returned to your distributor or arrangements must be made with the Board for the recovery of the stamps. If your organization has other licensed premises, this would not apply. Because the license has expired, you may no longer conduct lawful gambling at this premises.
