Dear Mr. Nolde:
The Cit of Oak Park Hei is in receipt of y our application submitted on Februar 8,
2006 seekin consideration b the Cit for the concept and g eneral plan of
development, subdivision and site plan review for the Oak Villa project. With
this letter, we are notif y ou that y our application will be deemed complete with the
receipt of the followin information b Februar 22, 2006:
1. A separate conditional use permit application and fees for the fill from the Lowe's
site that will be brou onto the subject propert The application should provide
a plan with the proposed location of the fill, number of cubic y ards, and erosion
control plans.
2. The plans should be clarified to reflect the areas to be considered as part of
Phase 1. It appears as thou the temporar cul-de-sacs would be on propert
not under control of the applicant.
3. VSSA will need to be a si on the application or a letter of consent from
their representatives is re to allow review of the pro that is partiall on
their propert
4. Please contact Julie Hultman at Cit Hall (651.439.4439) so that she can provide
a number of additional booklets needed for distribution to the Plannin
Commission and Cit Council.
5. A tabulated list shall be provided of what trees will be preserved and what will be
removed as part of the pro A calculation of tree replacement should also be
provided.

City staff has determined this project will be reviewed as separate concept and general
plan applications. Although similar plans have been reviewed and approved on a
concept level for this project previously, there are a number of issues that should be
addressed on a separate concept plan level. Some of the preliminary issues that staff
have identified include:
The right -of -way for Novak Avenue has been reduced to 80 feet but there is not
adequate separation or landscaping to provide a transition between the
commercial and reS.'Jidenticad uses.
Z. The north project entrance should align with the adjacent Loge's driveway.
3. The two driveways on long, relatively narrow roadways with cul-de-sacs, may be
an issue until the second phase is constructed.
As part of the review process for this application, a plan review will be conducted on
Wednesday, February 22, 2005 at 11:15 AM at city Hall. We encourage you and your
representatives to attend this meeting. If all of the information is submitted as required
by the specified date, the application for concept plan review only will be placed on the
March 9, 2005 Planning Commission meeting scheduled for 7:00 PM at City Hall.
Pursuant to Minnesota Statutes 15.99, Subd. 3(f), the city of oak Park Heights is
herewith extending the period of time for agency /city review of the application for an
additional 50 day period (for a total of 120 days from the date of application) inasmuch
as the City has determined- that additional research and study by the City staff relative to
the complexity of the project as proposed will be required. Please contact me with any
