411 CITY OF OAK PARK HEIGHTS MINUTES OF MEETING HELD MONDAY, DECEMBER 28, 1987 Call to order at 7:00 by Mayor Sommerfeldt. Present: Torgerson, Seggelke, Doerr, Moberg and Wilson. Absent: O'Neal Steve Chaves to acquire stockpile permit which is valid for one year. Grinding to take place during winter months and removal to be completed by July 1, 1988. Seggelke, seconded by Torgerson, moved to approve request for turning of Stone Lake Restaurant sign 180 degrees. 4 aye votes. Carried. Torgerson, seconded by Doerr, moved to approve Mayor and Clerk to sign the 1987 -1989 Police Union Contract. 4 aye votes. Carried. Torgerson, seconded by Doerr, moved to accept quote from Schwantes, Inc. in the amount of $3498.00 from Contingency Fund for the installation of a hot water boiler at City Hall. 4 aye votes. Carried. Seggelke, seconded by Torgerson, moved to accept quote from • Odland Construction in the amount of $5100.00 for fencing at Cover Park, contingent on the receipt and signage of the change order from City Engineers. 4 aye votes. Carried. Torgerson, seconded by Doerr, as representatives of the constituency of Oak Park Heights, moved to adopt Resolution #87- 12-54 objecting to the County Commissioners substantial salary increase. Roll call vote taken with 4 aye votes cast. Resolution adopted. Park Commission will meet Wednesday, January 20, 1988 at 6:30 P.M. at City Hall. Doerr, seconded by Torgerson, moved to approve Stillwater Gazette as official newspaper for 1988. 4 aye votes. Carried. Doerr, seconded by Seggelke, moved to approve release of check to Abrahamson Nurseries in the amount of $3441.00 for tree trimming project. 4 aye votes. Carried. Present: O'Neal, Torgerson, Seggelke, Doerr, Eckberg, Leier and Wilson. Lengthy discussion on the Sunnyside Project ensued. Steve Chaves reported on stockpile of blacktopping material on his property. He Will return December 28th with further information to the Council. Seggelke, seconded by Doerr, moved to approve proposed signs (2- 2'x8' wall signs East & North walls) at St. Croix Car Wash /Union 76 and remove 3 roof signs. Also, disconnect rotating '76 ball sign. 5 aye votes. Carried. Doerr, seconded by O'Neal, moved to approve 1988 kennel license to Robert and Phyllis Dahl for three dogs with no breeding or commercial sales. 5 aye votes. Carried. Seggelke, seconded by O'Neal, moved to hire the following rink attendants at $3.50 /hr: John Bonse, Jon Doerr, Bill Duffy, Doug • Luchsinger, Mark Pearson and Tim Witzel. Clerk read public hearing notice, presented affidavit of publication and mailing list on request for a conditional use permit submitted by Holiday Stationstores, Inc. Mayor called for comments and discussion ensued. Torgerson, seconded by Seggelke, moved to close hearing. 5 aye votes. Hearing closed. Seggelke, seconded by Torgerson, moved to approve the above request and site plan subject to conditions noted in City Planner's letter of November 20, 1987: 1. All parking lot setbacks are achieved and a temporary asphalt curb is provided along the southern and eastern edge of the parking lot to extend to the tip of the triangular access easement. 2. The eastern most parking stall is eliminated and replaced with appropriate screening and landscaping as provided along the northern edge of the parking stalls. • 3. The trash enclosure is set back off of the parking lot and appropriate "No Parking" signage is provided. 4. A grading and drainage plan and a utility plan is submitted and approved by the City Engineer. 5. A certified survey is submitted for the subject property. It should be noted that if any discrepancies exist between the survey and the site plan, a revised site plan must be submitted for review. 6. A signage plan is submitted which conforms to the ordinance requirements. 7. Subject to comments from other City Staff. Roll call vote taken with 5 aye votes cast. CUP approved. Doerr, seconded by O'Neal, moved to adopt Resolution #87 -11 -52 accepting the petition for annexation from Alvin J. Krueger and Elaine K. Krueger and authorize City Attorney to file with Municipal Board. Roll call vote taken with 5 aye votes cast. Resolution approved. O'Neal, seconded by Torgerson, moved to allocate $5,000.00 contribution to the St. Croix Valley Teen Center from the contingency fund. Present: O'Neal, Torgerson, Seggelke, Doerr, Eckberg and Wilson. Clerk read public hearing notice and presented affidavit of publication on amendment to Ordinance #1101. Mayor called for comments. O'Neal, seconded by Seggelke, moved to close hearing. 5 aye votes. Hearing closed. O'Neal, seconded by Doerr, moved to adopt Resolution #87 -7 -22 approving amendment relating to regulation of motor vehicles so do as to regulate and control the parking of motor vehicles upon lots occupied by residential dwellings. Roll call vote taken with 5 aye votes cast. Resolution adopted. Hearing on possible reopening of Oren Avenue was opened with many residents in attendance. Mayor called for comments and discussion ensued. O'Neal moved to close hearing requesting a show of hands for or against closing above street. Approximately six were for the closing and about twenty for keeping it open. Seconded by Torgerson. 5 aye votes. Hearing closed. • O'Neal, seconded by Seggelke, moved to amend Resolution #87 -6 -18 to reopen Oren Avenue July 14, 1987 and remain open until construction necessitates temporary closing. City will proceed with a professional traffic study of Oren Avenue and entrance /exit at Osgood Avenue when project is completed at the Mall and, upon completion of study, conduct another public informational meeting. Oren Avenue to be posted at five (5) ton limit with through traffic not to exceed ten (10) miles per hour and be strictly enforced. Torgerson, seconded by Seggelke, moved to adopt Resolution #87 -7- 23 authorizing Juran & Moody to purchase $995,000.00 General Obligation Improvement Bonds of 1987. Seggelke, seconded by Doerr, moved to direct Clerk to contact City Engineer requesting review of documents presented by the City of Stillwater and Short, Elliott and Hendrickson regarding the East Industrial Park Drainage Report. Present: Torgerson, Seggelke, Doerr, O'Neal, Eckberg and Wilson. Clerk administered Oath of Office to Mayor Sommerfeldt, Councilman Doerr and Councilman Seggelke. O'Neal, seconded by Torgerson, moved to direct Clerk to submit letter to Lakeview Memorial Hospital showing the City's support and recommending approval of Advance Life Support (ALS). 5 aye votes. Carried. O'Neal, seconded by Doerr, moved to grant NSP approval to incinerate soil, contingent on a letter to the City with specific starting and completion dates and route schedules. With Mayor's approval, NSP may then proceed with the project. Aye votes cast by Sommerfeldt and O'Neal. Nay votes cast by Torgerson and Doerr. Abstain by Seggelke. Motion defeated. O'Neal, seconded by Doerr, moved to request an $8,000.00 performance bond from Espree Corporation to complete painting at Oak Ridge Place. Completion date is set for July 1, 1987. 5 aye • votes.
