SUBJECT: Variance Request by Mr. Lester Ploen, 14436 - 57th Street
North, for the height of a fence gate in a sideyard from 32'
to 6'.
Mr. Ploen has requested a height variance from Section 4.22 (B) which requires that
a fence (gate) be no higher than 31 feet except that fences (gates) 6' high may be
permitted between the rear corner of a house and the rear corner of the lot. Mr.
Ploen would wish to place his gate (fence portion being formed by existing shrubs -
see diagram) 4 feet within the side yard, thus requiring a 31' set limit.
The purpose of the fence is to help disuade pedestrian traffic between 57th Street and
the Light Business District commencing at the rear property line of Mr. Ploen's lot.
There are five considerations with regard to this variance, and the intent of the ordi-
nance which is to provide free movement of light and air between buildings and pro-
perties, which movement can be hindered by high fences.
First, the fence gate will be perpendicular to the adjacent property rather than paral-
lel to it, which will decrease the visual effect as well as any effects on the movement
of air, etc.
Secondly, the gate will be approximately 8 feet from the lot line or nearly within the
building area of the site which would permit a height of 45'.
Third, the fence (shrubs) are existing and the gate would make the enclosure more
significant.
Fourth, the two houses, Mr. Ploen's and the neighbors to the west appears to be some 35
to 40 feet apart, a distance which would negate any interference of light and air by a
6' fence or gate.
Fifth, the westerly property is 2++ feet higher than Mr. Ploen's which offsets the 21 foot
increase in height of the fence (gate).

Because of the above existing relationship between the property under consideration
and the property to the west and the zoning to the north, it would appear that a 6'
high gate would have no detrimental affect to the intent of the ordinance, but would
enhance the appearance of the site, help to relieve the problem of pedestrian traffic
across the site and relieve a hardship which would be created by housing to move the
fence (gate) 4' to the rear and losing the value of the shrub fence.
