The applicants wanted additional time to review alternative building designs with Chevrolet. The application includes requests for a Conditional Use Permit amendment and Design Guidelines review. The Conditional Use Permit amendment is requested to allow for an extension of the timeline for required improvements to the dealership. The Design Guidelines review is required to allow retrofit of the building to be consistent with the current banded image of Chevrolet. At that meeting the City Council continued the consideration of the application until such time as an alternative design had been provided by Chevrolet. Please find attached the new option from Chevrolet and the applicant labeled Option C and dated June 13, 2012. The Planning Commission, April 12, 2012 meeting voted to recommend Option 2 dated April 12, 2012. The Planning Commission has not reviewed the new Option C. ANALYSIS OF NEW OPTION The new option provided by Chevrolet and the applicant is not significantly different than Option 2 recommended by the Planning Commission. The front entrance is to be widened and the window frames in the entrance as well as the two adjacent sections of the building will be changed to a clear anodized framing. The glass in these areas of the Page 48 of 138 building will be changed to a "clear" glazing. The block base would be eliminated from the front entrance. Ward Sessing, the project architect has indicated that Option C has been endorsed by Chevrolet and represents a significant departure from the original proposal. He has indicated that there is no latitude for any departure from this concept. "A brief summary of items that must be included in this approval include: 1. The incorporation of the standard Chevrolet entry element, with no base, 2. Changing the color of the ACM metal panels in the sections of the building immediately flanking the new entry element to standard Chevrolet colors, 3. Incorporation of the new signage indicated, 4. Changing the aluminum window systems in the portion of the building, immediately adjacent to the entry element, to clear anodized framing, and 5. Changing all existing exterior glazing to "clear" at the entire showroom." EXHIBITS The review is based upon the following submittals: Exhibit 1: Option 2 — April 12, 2012 Exhibit 2: Option C — June 13, 2012 CONCLUSION / RECOMMENDATION Please find attached the recommending resolution of the Planning Commission and a draft approval resolution for the City Council. The City Council resolution endorses Option C — June 13, 2012 and approval of the extension of the timeline. The City Council could act on the resolution for approval of Option C and the extension of the timeline as attached, or send the most recent option back to the Planning Commission for further consideration. Option C, while it departs slightly from the Planning Commission recommendation, would still be consistent with the Design Standards. Page 49 of 138 • • A RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY RADUENZ DEALERSHIP PROPERTIES FOR A CONDITIONAL USE PERMIT AMENDMENT FOR AN EXTENTION OF THE TIMELINE FOR REQUIRED IMPROVEMENTS TO THE STILLWATER MOTORS DEALERSHIP AT 5900 STILLWATER BOULEVARD BE APPROVED WITH CONDITIONS, AND THE REQUEST FOR DESIGN GUIDELINES REVIEW FOR :BUILDING IMPROVEMENTS TO THE DEALERSHIP SHOULD BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from; and after having conducted a public hearing relative thereto for Raducnz Dealership Properties for a Conditional Use Permit amendment for an extension of the timeline for required improvements to the Stillwater Motors dealership, and Design Guidelines review for building improvements to the dealership at 5900 Stillwater Boulevard North, the Planning Commission of Oak Park Heights makes the following findings of fact: The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT 13 and 3. The property is zoned 13 -3 highway Business and Warehouse District in which automobile dealerships are a listed conditional use permit; and 4. The applicants have requested an amendment to the Conditional Use Permit, approved by the City Council on July 22, 2008, to allow an extension of the Page 50 of 138 deferment of required improvements related to parking setbacks, lighting, curbs and stormwater drainage systems in the northeast and southeast corners of the site. They have requested the deferment of improvements to August 31, 2018; and 5. The applicants have requested Design Guidelines review to allow a retrofit of the building to be more consistent with the branded image of Chevrolet; and 6. City staff prepared planning reports dated March 8, 2012 and April 5, 2012 reviewing the request; and 7. Said reports recommended denial of the original proposed exterior remodel in that it is not consistent with the Design Guidelines and approval of a revised design with conditions. The reports also recommended approval of the Conditional Use Permit amendment subject to the fulfillment of conditions; and 8. The Planning Commission held a public hearing at their March 15, 2012 meeting, took comments from the applicants and public, and continued the public hearing to their April 12, 2012 meeting where they made the following recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted by Raduenz Dealership 'Properties for a Conditional Use Permit amendment for an extension of'the timeline for required improvements to the Stillwater Motors dealership and Design Guidelines review for building improvements to the dealership at 5900 Stillwater Boulevard North labeled as Option 2 and dated April 12, 2012 should be approved and affecting the real property as follows: SEE ATTACHMENT A - The Planning Commission recommends to the City Council of the City of Oak Park Heights approval of the proposed exterior remodel labeled as Option 2 and dated April 12, 2012, subject to the following conditions: 1. The Planning Commission recommends Option 2 dated April 12, 2012. The dimensions of the front entrance are to remain as currently constructed and all window muntins and windows shall not be changed. 2. All signage shall comply with the approvals granted on July 26, 2005 with a total of 10 wall signs and no more than 655 square feet of signage. Further, the Planning Commission recommends to the City Council of the City of Oak Park I- teights approval of the request for the Conditional Use Permit for the extension of the timeline for required improvements to the dealership subject to the following Conditions: Page 51 of 138 1 . All parking setbacks, curbs and stormwater drainage systems, in the northeast and southeast corners of the site, shall be constructed and brought into compliance with the Zoning Regulations no later than August 31, 2018. 2. All other conditions approved on July 22, 2008 by the City Council in Resolution 08-07-31 and recorded with the Conditional Use Permit and Variance for Raduenz Dealership Properties LLC, shall remain in effect. The Option C is similar to Option 2 in building materials and color but includes a widened front entrance. NOW, THEREFORE, BE IT RESOLVED BY TIIE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted by Raduenz Dealership Properties for a Conditional Use Permit amendment for an extension of the timeline for required improvements to the Stillwater Motors dealership should be approved, and Design Guidelines review for building improvements to the dealership at 5900 Stillwater Boulevard North labeled as Option C and dated June 13, 2012 should be approved and affecting the real property as follows: SEE ATTACHMENT A City Council of the City of Oak Park ]-eights approves the proposed exterior remodel labeled as Option C and dated June 13, 2012, subject to the I conditions: Page 54 of 138 1. The City Council approves Option C dated June 13, 2012. 2.
