Oak Park Heights, MN 55082 Oak Park Heights, MN 55082 Re: Home Occupation 401.15.M Ordinance, Conditional Use Permit 401.03 Ordinance, Public Morals and Welfare Ordinance 1105, and Nuisance Ordinance 1109 Dear Ms. Anthony: Dear Mr. and Mrs. Sheridan: The purpose of this letter is to offer a communication to both of your residences so that there is no misunderstanding in what the City's policies and /or goals in fact are. Above all the City strongly desires that neighbors work out their disputes independently and in a professional cordial way. The City prefers not to be a mediator; however, the City occasionally will take the opportunity when the time is appropriate, which may be the case here. Accordingly, in response to a situation that occurred last week, I am writing to inform you of the above - referenced ordinances. As it relates to Home Based Businesses: Home based businesses are regulated by City Ordinances 401.15. M and 401.03 in order to maintain the character and integrity of residential areas. A Home occupation permit is required for businesses that operate out of a single family detached dwelling and apply to home based offices for a business as well as any business actually conducted within a single family detached dwelling. Enclosed you will find a copy of the related ordinances; however_in no case shall a home occupation serve to be incompatible with or as a disturbance to surrounding residential uses, nor shall any home occupation be conducted between the hours of 10:00 p.m. and 7:00 a.m. unless said occupation is contained entirely within the principal building, excluding attached garage space, and will not require any on- street parking facilities. As it relates to Noise in Residential Areas: City Ordinance 1105.06 - Noise In Residential Areas: "No person shall, between the hours of 10:00 p.m. and 7:00 a.m. congregate because of or participate in any party or gathering of people, or any place of business located near any residential area, from which noise emanates of a sufficient volume as to disturb the peace, quiet, or repose of persons residing in any residential area." • As it relates to other nuisances, such as barking dogs and other noises or conflicts, City Ordinance 1109 (ENCLOSED) is also applicable to a myriad of other items that can cause disturbances between neighbors.
