RE: Proposed Homeowner's Association Changes
Dear Mark:
After conferring with my Attorney and in response to discussions held with the four current homeowners on Nutmeg Ave.,
we decided to implement the following.
The Homeowner's Association documents would be amended to reflect a total number of four units in the association. The
association would enter into an agreement with the other two owners' of the development (Oakgreen Commons, LLC and
Oakgreen Villa, LLC and/or its assigns) whereby they would agree to pay their pro-rata share of the upkeep and repairs on
the streets and utilities benefiting their properties.
Any other repairs and maintenance on the exterior of the four unit building would be handled internally by the Association.
Lawn care and snowplowing will be provided by one entity at one time for the entire development. The costs would be
shared on a pro -rata basis.
This seems to be the fairest way to treat the existing homeowner's. Otherwise, they would not have a majority voice in an
over -all association, and could be subjected to onerous assessments and dues increases. Regarding the $50,000 initial fund;
that was initially intended for 67 units. We proposed to the homeowners' that 4/67ths of that amount $3,000.00 would be
funded into their reserves, when control of the association is turned over.
