PLANNING COMMISSION MEETING MINUTES

Thursday, June 14, 2012 — Oak Park Heights City Hall
I. Call to Order: Chair Bye called the meeting to order at 7:00 p.m. Present: Commissioners
Dougherty and Squyres; City Administrator Johnson, City Planner Richards and
Commission Liaison Abrahamson. Absent: Commissioner LeRoux.
II. Approval of Agenda: Commissioner Dougherty, seconded by Commissioner Squyres,
moved to approve the Agenda as presented. Carried 3 - 0.
III. Adjourn to Worksession — Planning Commission Vacancy Interviews: Commissioner
Squyres, seconded by Commissioner Dougherty, moved to adjourn to the worksession for
the purpose of Planning Commission interviews. Carried 3 - 0.
IV. Reconvene Regular Meeting: Chair Bye reconvened the regular meeting.
A. Commission Appointment Recommendation: Discuss and make recommendation for
appointment to the Planning Commission vacancy for a 3 -year term commencing
July 1, 2012 and culminating on May 31, 2015.
Commissioner Squyres, seconded by Commissioner Dougherty, moved to continue
appointment to the Planning Commission to the July meeting to allow an opportunity to
interview all the candidates who applied for the position. Carried 3 — 0.
V. Approval of April 12, 2012 Meeting Minutes: Commissioner Dougherty, seconded by
Commissioner Squyres, moved to approve the minutes as presented. Carried 3 - 0.
VI. Department /Commission Liaison / Other Reports: None.
VII. Visitors /Public Comment: None.
VIII. Public Hearings:
A. Port of Sunnyside Club, Inc. (Sunnyside Marina): Consider a request for Setback
Variance and Conditional Use Permit to allow construction of eight shade structures
over existing patio areas at Sunnyside Marina, located at 6413 St. Croix Trail, N.
City Planner Richards reviewed the June 6, 2012 planning report, noting that the variance
was required for the proposed setbacks of the shade structures from the St. Croix River and
the Conditional Use Permit was required for a building permit within the River Impact
District. Richards concluded his report with a proposed recommendation, subject to
conditions for the Commission's consideration.

Chair Bye opened the public hearing for comment and invited the applicant to speak.
Rich Chapman, General Manager of Sunnyside Marina introduced himself and addressed the
question of what color selection is preferred for the proposed structures, noting that the
Committee has selected Adobe as their preference.
Mr. Chapman described the existing layout and overall color scheme of the marina and that
the request for the shade structures stems from desire to create shade for existing picnic
areas. He noted that those picnic areas not shaded are not used, whereas the three other areas
that are either covered or naturally shaded are.
Brief discussion of the structure construction requiring footings for the posts to be bolted to
them and the conditions of the planning report ensued. Mr. Chapman indicated that he had
no concerns with the conditions noted in the report.
There being no further public comment, Chair Bye closed the public hearing.
Commissioner Dougherty, seconded by Commissioner Squyres, moved to recommend the
City Council approve the request for setback variance and conditional use permit, subject to
the following conditions as proposed within the June 6, 2012 Planning Report:
1. There should be no permanent or temporary lighting installed on the shade structures.
2. No signage shall be installed on the shade structures.
3. Footings and installation of the shade structures shall require a building permit
subject to review and approval of the Building Official.
4. The color of the structures shall be of earth or summer vegetation tones.
5. The City Administrator may order the structures to be removed if it is thought that
they may obstruct the flow of flood waters or become lose ad be caught up in the
current.
6. The plans are subject to review and approval of the Department of Natural Resources
and any other state or federal regulating agency, if applicable.

A. Greg Mischo: Consider a request for a Conditional Use Permit to allow the
manufacture and assembly of metal fabrication equipment in the B -3, Highway &
Business Warehouse District at 12430 55 St. N., #107.
City Planner Richards reviewed the June 6, 2012 planning report, providing an issue analysis
and a proposed recommendation, subject to conditions for the Commission's consideration.
Chair Bye opened the public hearing for comment and invited the applicant to speak.
Greg Mischo introduced himself and his wife, Lynne as partners to the business and
discussed the business operation being proposed for the site. It was noted that the business
was being purchased from another Minnesota location and was being relocated to the
proposed site. The Mischo's responded to questions from the Commission regarding the
proposal and the planning report conditions.
There being no further public comment, Chair Bye closed the public hearing.
Commissioner Squyres, seconded by Commissioner Dougherty, moved to recommend the
City Council approve the conditional use permit request, as described within the June 6,
2012 Planning Report, subject to the following conditions as proposed within the same:
1. All manufacturing activities shall be limited to within the principal structure and the
service and delivery doors shall be kept closed except when vehicles are being
moved in and out of the building.
2. There shall be no exterior storage of materials or finished product on the site. All
storage shall be internal to the building.
3. Welding and painting activities shall be outsourced to vendors. If welding or
painting activities are to be done on site or if the business expands beyond the
assembly and manufacturing processes originally approved, the applicant shall make
a request in writing to the City Administrator with documentation. The City
Administrator shall determine if the expansion of activity shall require an amended
CUP.
4. All noise created from operations on the site shall be in conformance with Section
401.15.B.11 of the Zoning Ordinance.
5. All mechanical equipment installed outside of the building shall be screened in
accordance with Section 401.15.E.10.e of the Zoning Ordinance.
6. All proposed signage shall be in compliance with Section 401.15.G. of the Zoning
Ordinance.

7. The applicant shall receive and retain, if required, a Hazardous Generators Licenses
from Washington County.
