97 -03 PROPOSED ST. CROIX RIVER BRIDGE CROSSING AT OAK PARK HEIGHTS
In a 1992 resolution, the Minnesota Division of the Izaak Walton League of America opposed a
new crossing of the St. Croix River either north or south of the existing Stillwater bridge. The
IWLA resolution stated that proper environmental and transportation studies had not been done
and that other options for dealing with the traffic problems were inadequately addressed.
Since then the Minnesota Department of Transportation his formalized plans to build a very'high
and costly bridge through the city of Oak Park Heights a mile south of the existing bridge.
However in 1996 the National Park Service acting under requirements of the St. Croix National
Wild and Scenic River designation, refused to grant construction permits, stating that the scenic
value of the river would be irreversibly diminished by the structure.
In addition to the above objections, there is great concernthat this massive new bridge would
greatly accelerate urban sprawl that would permanently destroy farmlands, fragment wildlife
habitat, increase air, noise and light pollution and forever change the character of the river
valley.
THEREFORE BE IT RESOLVED: that the Minnesota Division of the Izaak Walton League of
America In convention April 27, 1997 in Two Harbors, Minnesota reaffirms its opposition to the
construction of a new St. Croix River bridge crossing as now proposed, We commend Sec
Babbitt for his decision to halt the permit process and urge our congressional delegation to abide
by that decision.

A RESOLUTION BY THE CITY COUNCIL FOR THE CITY OF OAK
PARK HEIGHTS FINDING THAT THE SUBMITTED PLANS FOR THE
ST CROIX RIVER CROSSING AND ITS APPROACHES ARE NOT
CONSISTENT TO THOSE AS FOUND IN THE PLANS AS GRANTED

Whereas in 1995 the City Council for the City of Oak Park Heights (hereafter
referred to as the "City ") approved a particular layout for the construction of the
various roadway and layout approaches for the St. Croix River Crossing Project,
and;
Whereas, in 1995 the City and the Minnesota Department of Transportation signed
a Memorandum of Understanding that would bind both parties to specific actions
related to a specific layout, the execution of the project, including costs, timelines
and statutory provisions, and;
Whereas, during the interim years, the project was stopped twice due to a lawsuit
initiated by the Sierra Club; and was re- reviewed by environmental studies,
resubmitted to the Cites' of Bayport and Stillwater for a 2005 Layout approval
under a 2001 amended layout approval statute and;
Whereas the Department has continually worked towards the resurrection of the
Project ultimately leading to a July 2nd, 2012 submission to the City for approval
of construction plans as outlined un MN Statute 161.177 (1995).; and;
Whereas the City has met with MNDOT on numerous occasions to identify
community impacts saving im acts and cost savin measures with the Department and despite
requests from the City for a written document there has not yet been a formal
agreement executed to enumerate such commitments, and;
Whereas, the District Court of the Tenth Judicial District, Washington County
Minnesota Case No. 82 -CO -06- 006815 has determined that the law existing prior
to 2001 legislative amendments applies to the Municipal Consent process, which
decision was not appealed from and is the law of the case in this proceeding; and
Whereas the City has reviewed the submitted plans from July 2 2012 relative to
the 1995 layout Profile #2 approved by the City August 14 1995 and makes the
following findings of fact:
1. Pursuant to Statute the City of Oak Park Heights has compared the current
construction plans with the 1995 layout approval and fmds the following
changes, deviations and differences:

2. The City attorney has notified the Department of Transportation by
correspondence dated July 11, 2012 that the current submission of
construction plans is non - compliant with the requirements of law in that the
plans as submitted are based upon the 2005 layout submission which has
never been submitted to nor approved by the City of Oak Park Heights and
that there has been no submission of construction plans as required by
statute based upon the 1995 Layout Profile #2 as approved by the City of
Oak Park Heights.
3. The Department has not provided a final Cooperative Construction
Agreement that would outline all anticipated financial and maintenance
commitments associated with this Project; a revised layout and design for
the Oakgreen Ave / South Frontage Roadway and final commitments for the
maintaining of the Omaha Ave. access to the South Frontage Roadway, as
well as other roadway mitigations and amendments.
Now Therefore be it Resolved by the City of Oak Park Heights as follows:
1. The City Council determines that the submission of July 2 2012 has the
following deviations from the 1995 Layout as approved by the City:

2. the City Council for the City of Oak Park Heights does hereby fmd that
there are numerous material deviations existing within the July 2, 2012
construction plans as distinguished from 1995 Profile #2 that received municipal
approval in 1995 from the City and that the City Council does hereby reject the
July 2, 2012 construction plans as non - compliant with statute and inconsistent
with the 1995 approved layout and further determines:
a. That the statutory non - compliance by MNDOT affecting the construction
plan submission, basing same upon the 2005 Layouts never submitted to
or approved by the City of Oak Park Heights is statutorily non - compliant
and that as a result no further proceedings may occur in this matter until
and unless the Department of Transportation resubmits construction plans
according to the statutory mandates and compliant with the 1995 Layout
Profile # 2 approved by the City of Oak Park Heights.
b. That following construction plan re- submission compliant with the 1995
Layout Profile #2 as approved by the City of Oak Park Heights the City
will re- examine the plans pursuant to Minn. Stat 161.177 for compliance.
c. That should a Court of competent jurisdiction determine that the non-
compliance in the MNDOT submission is not jurisdictional the City does
elect to proceed in to the Appeals Process as outlined in MN Statute
161.75.

being the following:
a. Final design for Lookout Trail at TH 95 to provide for a right in- right out
configuration with the trail depicted along the south border thereof from TH 95
to the turnaround area being removed
b. Trail location along Lookout Trial will either extend all the way from TH 95
to the Scenic Lookout and Beach Road or not be put in at all.
c. Omaha Ave left in final design and construction as a right in right out, at
grade, access
d. North and South Frontage Roads within the City's jurisdiction remain under
MNDOT ownership, and control subject to existing agreements in place with
the City over maintenance.
e. All Xcel power lines within the TH 36 Corridor be undergrounded compliant
with City ordinance
f. Oakgreen Avenue shall be continued to an urban standard to the intersection
point southwardly to 58 street and construct a right turn lane to 58 Street and
all stormwater therefrom such extension shall be contained into the MNDOT
systems at no cost to the City. Project limits will be established to 58 St.
g. All existing stormwaters now entering the TH 36 corridor from the City of
Oak Park Heights shall be captured and treated within MNDOT systems for
volume and rate control and the City shall have no ongoing maintenance or
reconstruction responsibilities therefore.
h. All MNDOT trails within the TH 36 corridor shall be owned and controlled
by MNDOT with the City having minor maintenance thereon. Any trail
reconstruction shall remain a MNDOT responsibility.
i. All signalizations within the TH 36 and TH 95 corridors to which MNDOT
policy would otherwise call for a municipal contribution shall be funded by
MNDOT using MNDOT funding sources, not reducing other allocations to the
City or in a manner resulting in no out of pocket contribution from the City.
The City will participate in future minor maintenance consistent with re-
lamping and painting and power supply.
j. The layout for Oakgreen Avenue will be adjusted to provide a pull back of
the Frontage Road from the Pine Grove Gardens development of approximately
50 feet as opposed to the proposed 25 feet.
k. Oakgreen Avenue be reconstructed as part of the project to urban standards
with Curb and gutter replacements along both sides to 58 Street. From TH 36
1. That MNDOT implement and complete reasonable maintenance to the
Scenic Overlook as committed to under the mitigation commitments.
m. That MNDOT install appropriate and distinct pedestrian crossing elements at
Osgood Ave and at Oakgreen/Greely so that surface markings are constructed
of materials that are distinct from typical road section, such as pavers, concrete
or other durable materials.
n. Project limits for the TH 36 and bridge project will be established on the
west end at TH 36/Norell- Washington.
o. All new streets or street/drive extensions created by the project will be
established as private drives unless the City of Oak Park Heights agrees to
accept them as public streets. New Street extentions within the City of
Stillwater are not affected by this condition.
p. The Holiday Gas Station shall retain its access points on Osgood Avenue.
q. Trails constructed under this project within the City shall be regulated in use
under the City's park ordinance and may be seasonally closed as directed by the
City council.
r. A reasonable access for the Home for Me Townhomes (Oakgreen and South
Frontage Road) shall be maintained
3. Whereas, MNDOT has agreed to prepare and execute a Cooperative
Construction Agreement and Utility Agreement assuring the City that the
City expenses projected into this project shall be kept to a maximum
contribution projected at the level of $ representing the
city's remaining costs in relocating municipal utilities impacted by this
project between Oakgreen and Osgood Avenues along TH 36 following
application of State of Minnesota funding, HPP funding, Federal Funding
and Legislative funding secured by Representative Kathy Lohmer.

between Oakgreen and Osgood Avenues along TH 36, being all municipal
utilities affected by this project following application of State of Minnesota

3. The City of Oak Park Heights does conditionally approve the July 2, 2012
Construction Plans as submitted provided that items
immediately above are reduced to agreement and implemented between the
City and MNDOT.
4. The City also does hereby conditionally waive and release any statutory non-
compliances by MNDOT with the submission of these construction plans
again conditioned upon compliance with the provisions above.
BE IT FURTHER RESOLVED, that should the provisions of items 1 -4
above are not able to be reduced to a binding agreement between the City and
MNDOT then and in that event:
The City Council for the City of Oak Park Heights does hereby fmd that

signed by the Commissioner of Transportation Thomas Sorel dated August 23, 2012,
and this City approves of same, and;
WHEREAS, the City of Oak Park Heights and the Minnesota Department of
Transportation have benefitted from the input and participation and the resolution of
various issues by the intervention of the Honorable Mark Dayton, Governor of the
State of Minnesota, and acknowledges and is grateful for his input and commitments
as outlined in his correspondence to the City dated August 23, 2012, and the City
approves of same, and;
WHEREAS, the City of Oak Park Heights has previously been benefitted by
the assistance of the Honorable Kathy Lohmer, member of the House of
Representatives of the State of Minnesota in securing additional funds for the City in
this project to address financial needs as presented, and is grateful for her input; and,
WHEREAS, the City has been benefitted also on the federal level by the
participation of the Honorable Michele Bachmann member of the United State
Congress and her staff in addressing Federal funding issues relative to this project,
and is grateful for her input and continuing assistance;
WHEREAS, the City has been benefitted also on the federal level by the
participation of the Honorable Amy Klobuchar member of the United States Senate
and her staff in addressing Federal funding issues relative to this project, and is
grateful for her input and continuing assistance;
WHEREAS, the City has been benefitted by the diligent work of its City staff,
together with MNDOT staff, and Project Director Jon Chiglo in working to find
solutions to the various issues that have been presented relative to this project and the
various renditions and changes that have occurred.
NOW, THEREFORE, BE IT RESOLVED, by the City
Council for the City of Oak Park Heights as follows:
1. That the City Council approves the construction plans submitted
by the Minnesota Department of Transportation to the City on July 2, 2012 as being
in accordance with the 1995 Layout Plans as approved by the City on August 14,

1995 in Resolution 95- 08 -39.
2. The City of Oak Park Heights approves of all work associated
with the St. Croix Crossing Project as the City finds the plans as submitted benefit
and are in the best interest of the citizens and residents of the City of Oak Park
Heights.
3. That the City of Oak Park Heights waves or releases any claim of
statutory non - compliance by the Minnesota Department of Transportation with the
submission of the construction plans on July 2, 2012.
4. That the City Council authorizes its staff to begin work with the
staff of the Minnesota Department of Transportation to negotiate and formalize
Cooperative Construction and Utility Agreements consistent with the commitments
and financial projections agreed to between State and City staff.
5. The City of Oak Park Heights is committed to working with
MnDOT as an active partner through the development and implementation of the St.
Croix Crossing Project.

Dear Mayor Beaudet and City Councilmembers:
Over the last six months, my Administration has worked closely with the City of Oak

Park Heights to advance the critically important and time - sensitive construction of the St. Croix
River Crossing between Wisconsin and Minnesota.
A crucial next step in this process is the passage by the City on August 23, 2012, of a
resolution expressing unconditional municipal consent to, and approval of, all work associated
with the St. Croix River Crossing project.
Working together, the City of Oak Park Heights and the Minnesota Department of
Transportation have successfully resolved many issues associated with this project. These
agreements are outlined by MnDOT Commissioner Tom Sorel in the attached letter.
In addition, the City has asked for help covering the cost of utility betterments associated
with the project amounting to $2,871,997.90. In the 2012 session, the Legislature appropriated
$1 million in state General Obligation bonds from resources provided in the Local Road
Improvement Fund (Minnesota Laws 2012, chapter 293, section 16, subdivision 3). The City of
Oak Park Heights has agreed to take responsibility for $351,828 of these costs, leaving a gap of
$1,520,170.
With this letter, I personally pledge to requesting approval from U.S. Department of
Transportation Secretary LaHood for the federal government to commit $1,520,170 for these
project costs. If Secretary LaHood informs me that the U.S. Department of Transportation is
unable to provide these funds, I will request and do my utmost to secure an additional State
General Obligation bond appropriation equal to $1,520,170 during the 2013 legislative session.
The Minnesota Department of Transportation will work with the City to ensure that cash flow and
local payment timing provides sufficient time for the 2013 Legislature to take action, if necessary.
I understand that, with these commitments, no issues remain that would prohibit the City
of Oak Park Heights from passing, on August 23, 2012, a resolution expressing its unconditional
municipal consent to, and approval of, all work associated with the St. Croix Crossing Project. In
addition, the resolution will state that the city fmds the construction plans provided to it by the
Department of Transportation on July 2, 2012, to be fully in accordance with the layout plan it
approved in City of Oak Park Heights Resolution No. 95 -08 -39 on August 14, 1995.

Dear Mayor Beaudet and City Councilmembers:
This letter reflects and further documents the agreements reached between the City of Oak Park
Heights and the Minnesota Department of Transportation related to the St. Croix Crossing
Project between Wisconsin and Minnesota.
1. Final design for Lookout Trail at TH 95 will provide for a right - in/right -out
configuration.
2. Lookout Trail: The pedestrian and bike accommodations will run up Lookout Trail and
be continuous between Beech Road and TH 95. This work will be incorporated into a
turn-back proposal by MnDOT to the city of Oak Park Heights. The turn back agreement
will include funding for the city to design and reconstruct Lookout Trail. The turn-
around in the current plan will be eliminated from the St. Croix Crossing project. If a turn
back agreement cannot be reached this work will not be done.
3. The Omaha Avenue right- in/right -out at grade intersection with eastbound TH 36 shall be
reconstructed as part of the St. Croix Crossing Design -Build project.
4. North and south frontage roads within the city of Oak Park Heights jurisdiction remain
under MnDOT ownership.
5. As provided in Minnesota Statutes Section 161.45 the relocation of construction impacted
utilities will need to comply with any applicable city ordinance, unless waived by the
city. MnDOT is committed to working with the City to relocate utilities to a point as
close to the right of way line as possible to minimize potential impact to these facilities in
the future.
6. Work on Oakgreen Avenue shall be extended to the south from the proposed southern
termini of work depicted on the construction plans to approximately the northern termini
of Oakgreen Avenue at 58 Street. A southbound right -turn lane will be constructed at
Oakgreen Avenue and 58 Street to facilitate right turns from Oakgreen Avenue onto 58
Street. All work upon Oakgreen Avenue will consist of an urban roadway section, with
concrete curb and gutter and construction stay within the existing right of way.
7. All MnDOT trails constructed as a part of the St. Croix Crossing project and within the
City of Oak Park Heights shall be owned by MnDOT, with the city having minor
maintenance responsibilities thereon. Any trail reconstruction shall remain a MnDOT
responsibility. Closure of the trails by the City of Oak Park Heights will be in
accordance with the Americans with Disabilities Act and City Ordinances and Park
policies.
8. The layout for Oakgreen Avenue will be adjusted to provide a pull back of the frontage
road from the Pine Grove Gardens development. MnDOT will increase the distance
between the townhomes and the south frontage road by approximately 30 feet. This
provides a total distance between the townhomes and frontage road of approximately 50
feet.
9. MnDOT will implement and complete reasonable maintenance to the Scenic Overlook as
committed to under the Section 106 mitigation requirements.
10. MnDOT will install appropriate TH 36 at grade pedestrian crossing elements at Osgood
Avenue and Oakgreen Avenue /Greeley per MnDOT standards.
11. Western project limits for the St. Croix Crossing project will be established to ensure
reconstruction of TH 36 mainline not constructed since the 1990s and ensure the project
begins where the previous phase of construction ended.
12. The Holiday gas station shall retain its access point on Osgood Avenue.
13. A reasonable access for the Home for Me Townhomes (Oakgreen and South Frontage
Road) shall be maintained.
14. The storm water design will meet the volume, rate and water quality requirements for the
project. MnDOT will coordinate the St. Croix Crossing storm water design with the
Browns Creek Watershed District and the Middle St. Croix Water Management
Organization. MnDOT will be responsible for pond maintenance and any future
reconstruction.
15, The total cost to the city of Oak Park Heights is $2,$71,997,00: This is computed by
adding city defined betterments, city share of construction impacted utilities, Grey Area
utilities and city responsibility of traffic signal costs. After applying the $1,000,000 from
the Local Road Improvement Fund and the City responsibility for Utility Betterments
MnDOT commits that the total City of Oak Park Heights financial obligation as a result
of the St. Croix Crossing Project will not exceed $1,520,169.00. This total obligation
does not include the cost of the "Moelter Site" utility relocation which if elected by the
City will increase the total obligation to the City. This figure does assume the relocation
of City utilities between Oakgreen_ and Osgood as part of the project
16. MnDOT and the City will review a list of new driveways or streets and determine which
will be classified as a public facility or private facility.
As you are aware, in March of 2012 I appointed Jon Chiglo as the St. Croix Crossing Project
Director. With this appointment, Mr. Chiglo has full authority to negotiate on behalf of the
Minnesota Department of Transportation regarding all elements of this project. The Minnesota
Department of Transportation looks forward to enhancing our partnership with Oak Park Heights
by working together to successfully complete and open the new St. Croix Bridge.

Enclosed is the bid tabulation from the recent Olene Ave Storm Water Improvements Bid
Solicitation. Council will recall that this work is scheduled to deal with a failed private storm
sewer line causing downstream sinkholes on private property. The City Engineer has reviewed
the bids and recommends Hydrocon as the prevailing low bidder to perform this work.
On a related note the City Attorney's office has processed the required nuisance abatement
notice to each property owner as the private property group did not address the nuisance. The
City will proceed with the work, tabulate the anticipated final expenses, subtract any amount it
may desire to subsidize and will assess the final portions to the properties benefitted by the
project.
Work is scheduled to commence upon the completion of a twenty -day waiting from the
summons received by the property owners on Aug. 20 and a final court order which will allow
the City to perform the repairs. (Assuming there are no objecting property owners or lien
holders). The City has also sent easements documents to the impacted property owners so that a
City pipe can be installed that will ultimately service the area.
Requested Action: Award the Bid to Hydrocon Inc. subject to the final go ahead
clearance from the City Attorney's office that all court permissions have been secured.

HAZARDOUS PROPERTY LOCATED AT 5802, 5804, 5806, 5808, 5810, 5812, 5814 AND
5816 OLENE AVENUE, OAK PARK HEIGHTS, MINNESOTA 55125
WHEREAS, this Order is made relative to the property located at: 5802, 5804, 5806,
5808, 5810, 5812, 5814 and 5816 Olene Avenue, Oak Park Heights, Minnesota, being legally
described as identified on Exhibit A annexed hereto, and hereinafter referred to as "the
Property"; and,
WHEREAS, the private storm water catch basin and outflow piping serving the
townhomes of the Property has failed, as shown and described on the City Engineer's
Memorandum dated November 23, 2009 and incorporated on Exhibit B attached hereto; and
WHEREAS, the City Council of the City of Oak Park Heights adopted Resolution No.
12 -02 -13 on February 28, 2012, making findings as to hazardous conditions existing on the
Property and nuisances creating sinkholes and other drainage problems upon adjacent
downstream properties lying to the north, causing property damage and safety concerns, a
certified copy of such Resolution being incorporated on Exhibit C attached hereto (the
"Resolution "); and
WHEREAS, the City of Oak Park Heights considers the aforesaid hazardous conditions
and public nuisances a hazard to public safety or health, due to potential physical damage,
unsanitary conditions, and safety hazards for surrounding property; and
WHEREAS, the immediate course of action, as recommended by the City Engineer, is to
abate the public nuisance by replacement of the storm water drainage system now located upon
or that serves the Property with a new system that will adequately manage all site generated
storm water flow; and

WHEREAS, all costs of this endeavor may be charged against the Property and collected
in the same manner as other taxes, all pursuant to Minnesota Statutes, Sections 463.15 through
463.26, as amended (the "Act "); and
WHEREAS, the Property owners have been repeatedly requested by the City of Oak Park
Heights to make improvements to the storm water drainage system serving the Property so as to
remove the hazardous conditions and nuisances, including the provision of a 90 -day period from
the effective date of the Resolution, and the Property owners have been unable or failed to do so.
NOW, THEREFORE BE IT RESOLVED by the City Council for the City of Oak Park
Heights, Minnesota that the City finds the Property is in a hazardous and physically damaged
state, providing a risk of a hazard to the public safety and health to the neighborhood in which it
is located, and orders, pursuant to and without limitation of the Act and Minnesota Statutes,
Section 412.221, the following:
1. The City of Oak Park Heights shall repair or cause to be repaired the storm water
catch basin, outflow piping, and related appurtenances of the storm water system serving the
Property
2. In the reasonable judgment of the City of Oak Park Heights, the Property shall be
further graded and adjusted to provide drainage so it does not create or continue to create a
nuisance for the adjacent neighborhood;
3. A copy of this Order shall be personally served upon the Property owners and
existing lien holders of the Property;
4. A copy of this Order shall be appended to a Lis Pendens and recorded against the
record titles of the Property; and
5. A Motion for Summary Enforcement of this Order will be made to the District
Court of Washington County, Minnesota, unless corrective action is taken or an Answer is filed
as required by law, but such action shall not preclude the institution of enforcement actions for
the performance of this Order and the removal of the hazardous, unsanitary and unsafe
conditions thereof by the City of Oak Park Heights before that time, and all such enforcement
actions are hereby authorized by directive of the City Council.

Background:
The private backyard drainage system between Olene Avenue North and Olinda
Avenue North has failed. The existing 8" clrainage pipe was determined to be plugged
just north of the existing catch basin, which is located in the northwest corner of the
existing parking lot at 5816 Olene Avenue North. r;
The existing catch basin collects all of the drainage from the parking lot, which entails
the runoff from the garage of 14386 58t Street North, and the building units of 5802
and 5816 Olinda Avenue North. The remaining backyards drain to the north above
ground and not into the existing drainage system.
City staff flushed water into the system which exposed the location of the plugged
pipe. Water exited to the surface at two locations on the 5834 Olene Avenue North
property, and drained above ground to the north. The only water observed exiting the
system was on this property.
This report presents two options for resolving the pluggecl drainage system; a
temporary solution, and a permanent solution. The information presented here is the
result of initial survey data, observations and meetings with City staff, and review of
utility record information.
Storm Sewer Drainage Resolutions:
Option 1— Excavate and Repair Existing Drainage System
This option provides a temporary solution to repair the existing drainage pipe.
This work entails exploring and excavating the existing pipe at the plugged
locations. The pipe will be removed and replaced at the plugged locations
until the drainage system is functional. Restoration and seeding of the
disturbed area will be required.
The pipe is located on private property with no City drainage and utility
easements.
The amount of the work required will vary depending on the extent of the
plugged pipe.
Option 2— Install Storm Sewer on Olene Avenue North (see Figure 1):
This option provides a permanent solution including installing storm sewer
pipe and catch basins to collect drainage from the existing parking lot and
Olene Avenue North. The existing drain system will be left in place with no
connection to the new storm sewer system.
Connection to the existing catch basin manhole (EX. CBMH) will be required at
the southeast corner of Olene Avenue North and 59 Street North. The
existing catch basin (EX. CB) located in the existing parking lot will be
removed and replaced. Removal and replacement of the street aggregate
base section and bituminous will be required for the installation of storm
sewer.
Landscaping fences, a light pole, and a sign will require removal between
5834 Olene Avenue North and 5816 Olene Avenue North. Restoration and
seeding of the disturbed area will be required.
The storm sewer pipe connecting the catch basin in the parking lot will require
a 20' drainage and utility easement for maintenance purposes.

For Option Land the purposes of this report, it was estimated that one -third of the O °-TY
• total existing pipe will require replacement. It was assumed that no engineering would
be needed as the replacement of the drainage pipe is private work. ( e.00
The costs for Option 2 included engineering fees and contingencies. Since the
construction work is located within the City's right of way and proposed drainage and
utility easement, engineering design and inspection of the construction will be
required.
The costs do not include the acquisition of easements.

Drainage Area Allocation:
The area for the drainage to the existing catch basin in the northwest corner of the
parking lot is shown on the attached Figure 1. During a rain event, runoff from this
drainage area is collected at the existing catch basin. The drainage area includes area
from three properties: half of the garage rooftop from 14386 58 Street North, the
parking lot and rooftop from the townhomes at 5802 -5816 Olene Avenue North, and
the parking lot driveway area within the city right of way.
If the costs for the drainage resolution are to be allocated based on area, the
following table shows the distribution of these costs:

Summary and Recommendations:
The estimated cost for Option 1 is significantly lower than Option 2. This reflects the
difference in a temporary solution vs. permanent solution. The existing] drainage pipe
can be repaired, but is more susceptible to fail and plug again.
It is recommended to install the new storm sewer in Option 2 as a permanent
solution. Including this work in future street reconstruction projects would be
beneficial and reduce costs.
If a resolution is required soon and prior to street reconstruction, Option 1 provides
the best temporary solution.

A RESOLUTION DEL NIATING A PUBLIC NUISANCE AND ORDERING ABATEMENT -
PRIVATE STORM WATERLINE FAILURE
Whereas the private storm water catch basin and outflow: piping serving the townhome properties of 5802,
5804;5806, 5808,5810, 5812,5814 and 5816 Olene Ave as well as portions of 14386 Olinda Ave, as
shown on the City Engineer's Memorandum dated November 23' 2009, has failed, and;
Whereas the estimated age of the storm water system is in exceedence of 25 . years old and for which no
known maintenance can be verified, and;
Whereas as a result of these failures,: public nuisances have arisen including various sinkholes and other
drainage problems upon adjacent down- stream properties lying to the north, causing property damage and
safety concerns, and;
Whereas the City has sent two notices, dated Feb 17` 2011 and June 10 2011 to the above property
owners requesting that the abatement be completed in a timely matter but no action was undertaken, and;
Whereas that these nuisances do depreciate the value of real property in the City both on and adjacent to
the site and cause property owners to be insecure in the use of their property as defined in City Ordinance
1109.01. D & E, as well as 1109.04.G & Y.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK
HEIGHTS THAT: -
1, The City council does hereby declare a public nuisance exists regarding the private storm water
catch basin and outflow piping serving the townhome properties of 5802, 5804,5806, 5808,5810,
5812,5814 and 5816 Olene Ave as well as portions of 14386 Olinda Ave. in its current condition.
2. the owners of said properties are to immediately abate this public nuisance and prevent its
reoccurrence via the replacement of the storm water drainage systems now located upon or that
serve the properties with a new system that will adequately manage all site generated storm water
flow.
3. The owners are provided 90 days to remediate the nuisance condition by the replacement of
storm water drainage systems
BE IT FURTHER RESOLVED THAT, should these nuisances not be abated wholly consistent with this
resolution, that the City shall implement necessary actions under Section 1109.07 of the code of
ordinances to enforce the nuisance ordinance and perform the abatement as prescribed by the City
Engiineerand will either assess the land affected or bill each contributing party for the cos of all such
abatement activities including all legal, engineering and administrative fees to complete the project.
