S and 24 2012. Your dogs described as 2 boxer breed dogs have been running at large not under your control, approaching, circling, barking and attempting to bite other persons and animals in the area of the Stillwater Area High School You were warned about this conduct on Aug. 8 2012. On Aug. 10 2012 the same conduct was reported to our department and a phone message was left for you to contact our department in response to the complaint. To date you have not returned that phone call. On Aug. 24 2012 you and your dogs were again in the area of the school The dogs were off leash and were reported to have run across a four lane roadway to an adjacent pond. The dogs were reported to have attacked a wild duck near the pond. When officers arrived on scene the dogs were witnessed chasing after two persons jogging down a city trail. The dogs began barking and aggressively attempting to bite at the lower legs of the joggers. The joggers prevented this by kicking at your dogs. You made no attempt to control the dogs. The officer had to run toward the dogs to attempt to stop them and prevent injury to the joggers. The dogs then began to chase the officer, circling and biting at him. You again made no attempt to control the dogs. The officer had scare the dogs with a Taser, which only worked for a short time before they continued attempting to bite the officer causing him to run into a nearby business to avoid being bitten. You were cited for this offense, and told the officer you have been cited before and will not pay the citation. Review of police reports from the City of Oakdale also show these dogs running at large and out of your control. You were cited for this offense by them 06 -04 -2012. Your disregard for others safety and given the aggressive manner of your dogs barking, circling, attempting to bite, your lack of any reasonable attempt to control the dogs or retrieve them when they were acting in this manner, along with the past violations you have been warned about as witnessed by our officers on 08 -08 -2012 & 08 -10 -2012 & 08 -24 -2012 I am making a determination under City Ordinance 601 that your dogs are classified as Potentially Dangerous Dogs. This determination specifically prohibits any person to own, keep, possess, or harbor any dog within the City of Oak Park Heights that is a dangerous or potentially dangerous dog. With this classification under city ordinance 601.14 you are prohibited from bringing the 2 dogs " described as boxers in these incidents into the city on public or private property. Any future violations of attempting to bite or biting persons and your dogs may be classified as Dangerous Dogs and destruction of the dogs may be ordered consistent with state statute and city ordinance. Minnesota state statute also regulates dangerous and potentially dangerous dogs specifically under MSS Chapter 347. These regulations can include registration or up to destruction of the dogs. Any future violations by you will result in further citations and possible arrest, along with impoundment of the animals. A copy of this determination letter has been forwarded to the City of Oakdale and may result in further requirements or restrictions with your city of residence, the City of Oakdale. To reiterate you are prohibited from bringing these animals into the City of Oak Park Heights on private or public property in conformance with ordinance 601.14.
