Page 21 of 28 City of Oak Park Heights 14168 Oak Park Blvd. N • Box 2007 • Oak Park Heights, MN 55082 • Phone (651) 439 -4439 • Fax (651) 439 -0574 October 5 2012 MEMO TO: City Council Members • FROM: Eric Johnson, City AdminiitratDr / RE: Phil Tara's Parking Lot Mauer i On Wednesday, October 3 2012, Mark Vierling and I had organized a meeting with the following individuals to discuss the parking lot matter as the City Council anticipates taking this item up for further discussion on October 9` Phil & Nick Barbatsis, Phil Tara's Hideaway Eric Thole, Attorney for Phil Tara's Randy Capra, Xcel Energy James Zyduck, Xcel Energy Jon Chiglo, MNDOT Adam Josephson, MNDOT Overall the meeting was positive and went very well. The NEW turn of events that came from the meeting was that Xcel Energy is willing to transfer the real property interest directly to Phil Tara's without the need for the City becoming an intermediary. This is the optimal solution as upon further review the City would likely have had a difficulty owning a parking lot for a private entity to lease as the City's insurance policies and statutory immunities for park /governmental purposes would be compromised. This would be in addition to a need to seek major amendments to the Park Licensure Agreement between the City and Xcel Energy. As it relates to the City's twenty parking spaces, sharing a parking lot with Phil Tara's is practiceable so long as the City's twenty spaces are clearly delineated. Phil Tara's will exclusively have their own maintenance and operational policies for their areas of the lot as the City will on its parking spaces. A map is expected to be received by the City from MNDOT (not yet received as of 2:45pm on 10/5/12) that will best depict this much agreed upon course of action. These items will take some additional discussion and possibly a need for a four -party agreement that would allow this process to proceed as well as an administrative MINOR SUBDIVISION of property, splitting of a parcel from the fly -ash property to be attached to Phil Tara's property with cross — easements to the City for access. When I have the map from MNDOT it will express the concepts better than this narrative. I will email out to you when I have it and hopefully well in advance of the City Council meeting Possible Action /Discussion: Authorize Staff to continue to work with the involved parties to come to an formal agreement meeting the concepts discussed above and that should such Agreement be satisfactory to the City Council, the further need for a Conditional Use Permit by Xcel Energy be waived by the City Council.
