I was also stopped on my way in to work this AM from a different resident complaining about the noise last night. The contractor Miller Trucking told the officer that responded last night that they were told by the facility they could start at 0400. Citations will be issued for any further violations to the snow removal operators and the facility CEO. This has been a repeated disregard of the complaints and violations from the facility with warning after warning, year after year. Brian DeRosier Chief of Police / Emerg. (nothing new…..happens every year) Every year the City receives noise complaints from residents that abut the southern fence line of the property. The City does communicate with residents that Andersen does have a situation in which they must get the lot cleared so that staff can come in, in the am, just like any other business so on occasion plowing happens at night. These are necessary actions to get the lot opened up. 1 What seems to happen is that the contractor comes in to do follow-up clean-up work at hours that are not compatible with City Ordinance or would not be following this emergency or necessity protocol, sometimes days after a snowfall. I know the Chief of Police has spoken with Mr. Alex Rockwell (the contractor? - see email below) to make him aware of this issue, yet he apparently did not understand? The City is put into a difficult situation once a noise complaint is called in at night, which at that point the officer on duty must follow the City Ordinance, which can be hard on the Contractor. All this being said, we usually work it out and it isn’t a big deal, but a reminder to your contractor from your end could be helpful to reduce complaints. If I can answer any questions let me know. (who knows maybe it wont snow again?) Thanks Eric From: Brian DeRosier Sent: Tuesday, December 11, 2012 10:49 AM To: Rockwell, Alex Cc: Eric Johnson Subject: Re: Noise Compliant Mr. Rockwell; We received a complaint this morning from a resident complaining of the snow removal equipment operating this AM 12-11-12 at 0500 hrs. The equipment was operating in the rear lot of the Omaha Av location. The complaint was of loud back up beepers, engine noise with banging /scraping. This is 2 days after the last plow able snow fall and would not be considered necessary to the removal at that time of the morning. In example it could have been completed after business during the early evening prior if there was further “clean up” that needed to be done after the main snow removal the previous day. The necessity is not determined by the times the contractor or business would like to complete the operations. As we discussed when we met and has been previously addressed numerous times in past years the city ordinances prohibit noise disturbing to residential neighborhoods that is not necessary. No noise is allowed on Sundays at all. Noise complaints are enforced between the hours of 2200 hrs. and 0700 hrs. This has been an ongoing issue with the facility with snow removal and other maintenance operations over the years. Please be considerate of the neighborhood 50 feet or less from the South of the facility lot. Please inform your plow contractor of the operational allowed hours and using equipment without backup beepers may be a significant help in reducing further complaints. Further complaints may be addressed with criminal citation to the plow operator and or the facility manager.
