EXTRACT OF MINUTES OF MEETING OF THE
CITY COUNCIL OF THE CITY OF OAK PARK
HEIGHTS, WASHINGTON COUNTY, MINNESOTA
HELD: August 12, 1997
Pursuant to due call and notice thereof, a regular meeting of
the City Council for the City of Oak Park Heights, Washington
County, Minnesota was duly held at the City within said City on the
12th day of August, 1997, at 7:00 o'clock p.m.
The following members were present:
Mayor: David D. Schaaf
Councilperson: Janet Robert
Councilperson: Jerry Turnquist
Councilperson: Mark Swenson
Councilperson: David Beaudet
The following members were absent:
None

RESOLUTION NO. 97- CJFf .30
CITY OF OAK PARK HEIGHTS
RESOLUTION RECEIVING PRELIMINARY REPORT AND
CALLING FOR PUBLIC HEARING ON BRACKEY WEST/
STILLWATER FORD UTILITY IMPROVEMENTS OF 1997
WHEREAS, the City Council deems it necessary and expedient
that the City of Oak Park Heights construct certain improvements
to -wit: municipal water, sanitary sewer and street improvements, in
the City of Oak Park Heights as described and in accordance with
the preliminary plans and report prepared by Bonestroo, Rosene,
Anderlik and Associates dated May 30, 1997 and amended on June 11,
1997, the City's consulting engineers; and,
WHEREAS, the City Council has been advised by the consulting
engineers that said Brackey West /Stillwater Ford improvements of
1997 are feasible and should best be made as proposed, and that the
consulting engineer's report to this affect as heretofore been
received by the City Council and filed with the City Clerk; and,
WHEREAS, the statute provides that no such improvement shall
be made until the Council shall have held a public hearing on such
improvements following mailed notice and two publications thereof
in the official newspaper stating the time and place of the
hearing, the general nature of the improvement, the estimated cost
thereof, and the area proposed to be assessed, in accordance with
law.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Oak Park Heights, Washington County, Minnesota as follows:
1. A public hearing will be held at the time and place set
forth in the Notice of Hearing attached hereto as Exhibit A to
consider the proposed improvements.
2. The nature of the improvements, the estimated cost of
each major portion thereof, and the areas proposed to be assessed
therefore are described in the form of Notice of Hearing hereto
attached.
3. The Notice of said public hearing shall be in
substantially the form contained in the notice hereto attached.
4. The City Administrator is hereby authorized and directed
to cause notice of said hearing to be given two publications in the
official newspaper. Said publications shall one week apart, and at
least three days shall elapse between the last publication and the
hearing. Not less than 10 days before the hearing, the clerk shall
mail notice of the hearing to the owner of each parcel of land
within the area proposed to be assessed as described in the Notice.
For the purpose of giving such mailed notice, owners shall be shown
to be such on the records of the County Auditor or, if the tax
statements in the County are mailed by the County Treasurer, on the
records of the County Treasurer. As to properties not listed on
the records of the County Auditor or County Treasurer, the Clerk
shall ascertain such ownership by any practicable means and give
mailed notice to such owners.
The Motion for the adoption of the foregoing Resolution was
duly seconded by member 5U'e ' and upon a vote being taken
thereon, the following voted in favor thereof:

Councilperson: Mark Swenson
Councilperson: David Beaudet
And the following voted against same:
None
Whereupon said Resolution was declared duly passed and
adopted.

Administrator of the City of Oak Park Heights, Minnesota, DO HEREBY
CERTIFY that I have compared the attached and foregoing extract of
minutes with the original thereof on file in my office, and that
the same is a full, true and complete transcript of the minutes of
a meeting of the City Council of said City, duly called and held on
the date therein indicated insofar as such minutes of a meeting of

of the City of Oak Park Heights authorizing the Brackey West/
Stillwater Ford improvements of 1997.

NOTICE OF PUBLIC HEARING
ON IMPROVEMENTS
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
TO WHOM IT MAY CONCERN:
TIME AND PLACE: Notice is hereby given that
the City Council of the City
of Oak Park Heights, Minnesota
will meet at the City Hall
building of the City of Oak
Park Heights, as located
within said City at 7:00
o'clock p.m., on the 9th day
of September, 1997, to
consider the construction of
the following improvements,
to -wit: Municipal Water and
sanitary sewer improvements,
serving the plat of Brackey
West and Stillwater Ford
properties.
NATURE OF IMPROVEMENT: The construction of municipal
water and sanitary sewer
improvements serving the
platted area of Brackey West
and the Stillwater Ford
properties.
ESTIMATED COST: The total estimated cost of
said improvements is
$365,200.00.
AREA PROPOSED TO BE ASSESSED: The area proposed to be
assessed for such improvements
is as follows: All lots,
parcels or pieces of land
benefited by said improvements
including but not limited to
Brackey West Plat and the
Stillwater Ford Dealership
property.
AUTHORITY: The Council proposes to
proceed under authority
granted by Chapter 429 M.S.A.
Such persons who desire to be
heard with referenced to the
proposed improvements will be
heard at this meeting.
Written or oral objections
shall be considered.
