The notice specified actions needed to gain compliance and requested that those actions be taken by October 10, 2002. An October 11, 2002 inspection found that in response to item 3, riprap had been placed in the ditch and the entranceway pipe was free of sediment. No action otherwise had been taken with respect to any of the five items. Accordingly, on Thursday, October 24, 2002, at the offices of the Washington Soil and Water Conservation District, 1825 Curve Crest Boulevard, Stillwater, Minnesota, at 4:30 P.M. or as soon thereafter as your matter may be reached, the Board of Managers of the Brown's Creek Watershed District (BCWD) will hold a hearing to consider the compliance status of the site. At that time you may address the Board of Managers, be represented by an attorney and present evidence or witnesses in your behalf. After hearing, the Board may issue an Administrative Order directing that you act to remedy outstanding violations found by the Board of Managers, or may initiate civil or criminal proceedings by authority of Minnesota Statutes § 103D.545. The listing of violations in the September 26, 2002 notice does not prevent the Board of Managers from finding additional or other violations on the basis of the evidence presented. To render the hearing unnecessary, you may bring the site into compliance by 4:30 P.M. on Tuesday, October 22, 2002. The timeliness and completeness of your compliance may be considered by the Board of Managers in deciding on further appropriate action. Pursuant to BCWD Rule 8.0, you are liable for all costs incurred by the BCWD in inspecting your project and obtaining your compliance with the terms of Permit No. 01 -12, including consultants' and attorneys' fees. If you do not complete the actions ordered by the Board of Managers by the deadlines specified in the Order, the BCWD itself may act to remedy the noncompliance and recover the costs of its action, including attorneys' fees, from you or your surety.
