HomeMy WebLinkAbout11-09-25 RESOLUTION NO. 1 1- 0 9 - 2 5 • CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION TO THE CITY COUNCIL THAT THE REQUEST BY JAY AND DEBORAH ANDREWS FOR TWO CONDITIONAL USE PERMITS, SITE PLAN, AND DESIGN GUIDELINES REVIEW FOR A TIRE PROZ STORE AT 14447 60 STREET NORTH BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from Jay and Deborah Andrews for two Conditional Use Permits, Site Plan, and Design Guidelines review for a Tire Proz store at 14447 60 Street North; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights recommended that the request be approved with conditions. The City Council of the City of Oak Park Heights makes the following findings of fact and resolution: • 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and 3. The property is zoned B -2, General Business District. The subject property requires a conditional use permit to allow a tire and service store in the B -2 General Business District, a conditional use p ermit for the outdoor storage of tires, site plan and Design Guidelines review; and 4. City staff prepared a planning report dated September 8, 2011 and memo dated September 20, 2011 reviewing the request; and 5. Said report recommended approval of the two Conditional Use Permits, Site Plan, and Design Guidelines review subject to the fulfillment of conditions; and • • 6. The Planning Commission held a public hearing at their September 15, 2011 meeting, took comments from the applicants and public, closed the public hearing, and recommended that he request be approved with conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted by Jay and Deborah Andrews for two Conditional Use Permits, Site Plan, and Design Guidelines review for a Tire Proz store at 14447 60 Street North and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby approved by the City Council of the City of Oak Park Heights with the following conditions: 1. The applicant shall provide an executed copy of the boundary development agreement prior to issuance of the building permit. 2. Ten (10) foot utility and drainage easements along all lot lines shall be • provided to the City. The easement shall be recorded on the property subject to review and approval of the City Attorney and City Engineer. 3. The access points are subject to review and approval of the City Engineer and permitting by the Minnesota Department of Transportation if required. 4. The grading, drainage and utility plans shall be subject to the review and approval of the City Engineer. The drainage plans shall be subject to the review of the Middle St. Croix Watershed District. 5. All lighting fixtures shall be full cut off and installed in compliance with the lighting standards of the Zoning Ordinance. All lighting fixtures on the building shall be installed in the locations shown on approved plans. Any changes shall be subject to review and approval of City Staff. 6. The outdoor lighting shall be turned off one hour after closing, except for approved security lighting. 7. The applicants provide elevation drawings and/or photographs to show how the back of the building (west facing) and site will appear from Olene Avenue and from 60 Street when traveling eastbound. • 2 8. The landscape plan is revised to incorporate some large evergreen • plantings on site to provide visible vegetation during winter months, to address the view of the back of the building from Olene Avenue and the view from 60 Street when traveling eastbound. The landscape plan must also incorporate a three (3) foot high planter around the base of the freestanding sign. The landscape and tree removal/replacement plans are subject to review and approval of the City Arborist. 9. The freestanding sign adjacent to 60 Street does not exceed 20 feet in height or 24 square feet per face as shown on approved plans. Only the sign letters may be illuminated, not the background portion of the sign faces. All signage shall be subject to final review and approval of City Staff for conformance with Zoning Ordinance standards. 10. As indicated by the applicants, no mechanical equipment is to be located on the exterior or roof of the building. If, in the future, exterior mechanical equipment becomes necessary, it shall be screened from street level view and from neighboring properties with materials that blend harmoniously with the building facade materials. 11. The applicants give consideration to adding architectural trim details to the building, particularly at the roof line. • 12. All auto repair activities shall be conducted indoors and the overhead doors to service bays shall be kept closed at all times except when moving vehicles in and out. 13. The City Council intends to construct an eight foot bituminous trail on the south side of 60 Street North adjacent to Tire Proz. Tire Proz agrees to a special assessment for this improvement and does hereby waive all rights they have by Minnesota State Statutes 429.081 or otherwise challenge the amount or validity of the assessments or procedures used by the City in levying the assessments. 14. The applicant shall provide a plan with a location of the trail and a trail easement, with a connection from the trail to the front entrance of the building, subject to review and approval of the City Engineer and City Attorney. 15. A bike rack shall be provided near the front entrance of the building. 16. The used tires will be required to be completely stored within the designated outdoor storage area. No tires shall be allowed outside of the storage area or placed above the height of the storage enclosure. The base of the storage area shall be paved or provided a gravel surface. • 3 17. Any new tire displays or racks located outside shall be kept near the III building and moved inside when the store is closed. 18. The applicant shall accept oil for recycling and receive and retain, if required, a Hazardous Waste Generators License for batteries, oil and tires from Washington County. City Council 4/5 Conditional Use Permit - Lapse of Approval: Unless the City Council specifically approves a different time when action is officially taken on the request, the conditional use permit shall become null and void twelve (12) months after the date of approval, unless the property owner or applicant has substantially started the construction of any building, structure, addition or alteration, or use requested as part of the conditional use. An application to extend the approval of a conditional use permit shall be submitted to the Zoning Administrator not less than thirty (30) days before the expiration of said approval.
