Dear Ms. Alt:
I am writing relative the above - referenced, which was closed for business by Denny Hecker
Automotive Group, last winter.
When a business in Oak Park Heights permanently closes or leaves a tenant space, signs are
to be removed within 30 days from the close of the business, per the criteria established
within City Ordinance 401.15.G.15.c "Out of Business Signs." I have enclosed a copy of this
ordinance language for your convenience.
With this letter, you are requested to:
1. Have all wall signage removed from the building exterior and any damage resulting
from the same corrected. In lieu of complete removal, wall cabinet signs may be
changed out with a dark blank face insert;
2. Have all signage located upon the garage doors, exterior doors, windows removed and
repair any damage to the exterior surface as a result their removal; and
3. Have the two freestanding signs completely removed or have their sign panels
replaced with dark blank replacement panels.
For your convenience, I have enclosed photos showing the signage referenced above. In no
case shall there be illumination if any signage at the site and any internal security lighting
shall be kept to a minimum.
Sign Removal and correction shall be completed no later than the end of the day Sunday,
September 20, 2009.

In addition to the sign removals, all exterior debris and items upon the property are to be
cleaned up and removed, including the vehicle display ramps, tires and other items in and
around the trash enclosure.

At such time a new tenant or owner takes occupancy of the building, they shall be required to
contact the City of Oak Park Heights for an evaluation of signage allowance at the site and
obtain approvals as necessary for their business operation.
I appreciate your prompt attention to this request and ask that you contact me immediately
with any questions you may have. A compliance check will be made Monday, September 21,

consistent with the present appearance of the area, building wall, or surface.
b) Temporary Illegal Signs. The City may impound signs which have been
illegally installed upon public property or within public right -of -way or
easement. The sign owner may retrieve the signs according to the following:
1) Fee Payment. For impounded signs, there shall be an impoundment
and storage fee, as may be approved from time to time by Council
resolution.
2) Retrieval of Sign. The sign shall be retrieved from a designated
impound area during routine business hours and within fifteen (15)
days from the date of impounding. After fifteen (15) days, the City will
dispose of the sign.
3) Liability. The City shall not be held liable for any damage to
impounded signs.
c) Out of Business Signs. Signs not used for signing when a business
permanently closes or leaves the tenant space shall be removed or altered
/ within thirty (30) days from the close of business. Wall or freestanding signs
and sign structures that are in compliance with the provisions of this
—1(7.16. o1,15' Ordinance but are not in use shall be addressed in the following manner:
1) Wall signs. The sign shall be removed.
2) Wall signs (cabinet). A blank face shall be inserted in the cabinet.
3) Freestanding Signs. The sign area shall be totally: covered.
4) Non- Conforming Signs /Sign Structures. All non - conforming signs and
sign structures shall be removed in compliance with Section
401.15.G.11 of this Ordinance.
d) Administrative Enforcement. Enforcement procedures for violations of this
Chapter shall be conducted as outlined in Section 101.05 of the City Code.
401.15.G.16. VARIANCES. In order to provide additional flexibility in the enforcement of
this Ordinance and to alleviate hardship and injustice, the City Council may, upon
application, grant a variation from the terms of this Ordinance. Upon application,
therefore, from the person seeking a permit for the erection or installation of a sign,
the request for variance shall be processed in accordance with Section 401.04 of
this Ordinance, as may be amended.
