PLANNING REPORT TO: Oak Park Heights Mayor and City Council FROM: Curt Gutoske /Martha Greenwald DATE: 18 August 1987 RE: Oak Park Heights - Lindquist Rezoning FILE NO: 798.02 - 87.07 BACKGROUND A request was received from David Lindquist to rezone three contiguous parcels fronting on Highway 36. The parcels were annexed to the City and assigned an "0 ", Open Space Conservation District, pending redesignation. The street address for the parcels is 13951 North 60th Street; legal descriptions and a survey map are attached. The location of the parcels is also shown on Exhibit A, attached. The applicant has requested that the parcels be rezoned "B -2 ". The parcels have been occupied for some years by a professional building, by Rivertown Pizza, and by a restaurant sales company. The rezoning is needed to obtain the necessary permits to remodel the existing buildings. ISSUES AND ANALYSIS 1. Relationship to Comprehensive Plan. The subject parcel was not within the City limits when the Comprehensive Plan was completed. Therefore, desired land uses were not specified. However, the following policies from the Comprehensive Plan do provide guidance for this request: • Continue existing land use and development patterns into newly annexed land, except where physical barriers and /or conflicting land uses are present. • Relate peripheral commercial areas to the primary transportation mode. • Encourage clustering of peripheral commercial uses in concentrated locations to avoid sprawl. • Accomplish transitions between distinctly differing types of land uses in an orderly fashion which does not create a negative (economic, social or physical) impact on adjoining developments. 4601 excelsior blvd., ste. 410, minneapolis, mn 55416 (612) 925 -9420 • . Oak Park Heights Mayor a( A ty Council �' 18 August 1987 Page Two The request is generally consistent with the policies cited above and therefore, does not create indifferences with the Comprehensive Plan. 2. Character of Surrounding Area. The parcel is abutted on the north by Highway 36, on the south and west by the City limits, and on the west by the medium density Pondview Condominiums, zoned R -3. To the east of Pondview lies a much larger parcel with B -2 zoning. The existing use is generally compatible with mid or high density housing and the land uses found along Highway 36. With the exception of the restaurant, existing uses operate during day -time hours, and would not disturb adjacent residential development at night. The restaurant is separated from the resi- dential uses by the professional building. 3. Consistency with Zoning District. All the existing uses are permitted uses in a B -2, General Business District. Parcel B has a lot area of 10,000 square feet, below the minimum 15,000 square foot lot area. Since the property is being annexed, it could be considered as legally nonconforming, however, no expansion or remodelling of legally nonconforming uses is allowed under City ordinances. In order to allow for the expansion /remodeling, a variance would have to be granted allowing for this to occur to a legally nonconforming use. RECOMMENDATION It is recommended that the rezoning request from an "0 ", Open Space Conservation District to a "B -2 ", General Business District be approved with Parcel B being recognized as a legally nonconforming land use.
