MEMORANDUM TO: Oak Park Heights Mayor & City Council FROM: Curtis Gutoskea DATE: 25 January 1988 RE: Hoffman Sign Variance FILE NO: 798.02 - 88.01 This memorandum is to accompany and provide further explanation to the Hoffman Sign Variance Planning Report. Item #2 at the bottom of the first page is a provision found in the City's Sign Ordinance which is intended to confront existing non - conforming signs. This provision is intended to be a measure the City can use to bring existing non - conforming signs into compliance with the ordinance over time. As properties and businesses change use, legally non - conforming signs which exist on these properties are to be required to com- ply with the ordinance. In this way, businesses which have legally non-con- forming signs are not forced to change their signs until a change in use occurs on the property. This allows the changing of the signs to occur naturally with the changing of the business. In the Hoffman case, these same set of circumstances occur. The subject sign was previously allowed as an existing legal non - conforming sign. However, as the use of the property changes, so must the conformity of the sign. This constitutes the major reason for the recommendation of denial in addition to the lack of hardship existing on the property. PLANNING REPORT TO: LaVonne Wilson FROM: Curtis Gutoske DATE: 21 January 1988 RE: Hoffman Refrigeration - Sign Variance FILE NO: 758.02 - 88.01 BACKGROUND 4' - .a er •• has requested for a variance from the City's .Sign Ordinance wi h respect to the property's allowable sign area. The subject property is the old Rivertown Pizza building which now houses Hoffman Refrigeration, Heating and Air Conditioning. The property is located along the south side of Highway 36 just west of Oakgreen Avenue North and is currently zoned B -2, General Business. Exhibit A illustrates the subject property's location. CASE ANALYSIS The applicant is proposing to repaint the existing " Rivertown Rizza" free- standing sign which is a legally non - conforming sign due to its excessive area. The maximum area allowed for a freestanding sign in a B -2 District is 15% of the building's front facade or 150 square feet, whichever is less. The front facade of the building, as indicated on the signage plan is 240 square feet. This results in a maximum sign area of 36 square feet (240 sq. ft. X 15 %). The proposed sign is measured at 8 feet by 16 feet or 128 square feet. This exceeds the allowable area by 92 square feet. Section 401.03 I.3.b. of the City's Sign Ordinance states that: (1) A non - conforming sign may not be: (a.) Changed to another non - conforming sign. (2) If any property use or business changes ownership, all signs on that property including any sign identifying a busi- ness no longer in existence, shall be brought into conformance within thirty (30) days. 4601 excelsior blvd., ste. 410, minneapolis, mn 55416 (612) 925 -9420 LaVonne Wilson / n alluary.21, 1988 -Page Two The proposed sign, therefore, violates the ordinance requirements regarding legally non - conforming signs and requires a variance to have the sign be allowed. However, for a variance to be justifiable, a unique physical hardship must be encurred which makes the proposed sign the only sign reasonably feasible. From reviewing the subject property, there does not appear to be any physical hardship encurred by this property which would justify an oversized sign. The site receives excellent visibility from Highway 36 and rho physical barriers exist which would obstruct the view of a sign which conforms; to the maximum area requirement. RECOMMENDATION Based upon the above review, it is recommended that a variance to allow for an oversized sign for the Hoffman Refrigeration property be denied.
