To Whom It May Concern:
The above - referenced restaurant location has a several violations to City Ordinance as
described below. This letter is being sent to you in order to bring the violations to your attention
and to direct their remedy no later than May 15, 2013.
1. A sign has been painted upon the rear side of the building. This sign is over and beyond
the number of signs to the store, which were approved as part of the development
approvals for the site. A copy of the 2004 Planned Unit Development Permit (PUD) is
enclosed. This sign needs to be painted over with a solid color matching the overall
exterior wall color as approved or a variance sought for its placement. A Development
Application is enclosed for your reference.
2. The exterior wall Tight fixtures do not comply with City Ordinance 401.15.B.7 & 401.02.B,
which requires total cutoff light fixtures. These ordinances are enclosed and a diagram
of a total cutoff fixture can be found on page 02 -16 (it is highlighted for your
convenience). The light fixtures on the building are not the same as those originally
approved and shall be corrected either be replacing the fixtures or locating shorter light
bulbs so that the light source is completely within the light fixture shield. No light shall be
emitted from the sides of the fixture, nor may any light source be visible beyond the
bottom of the light fixture shield. If you opt to change the fixture, please submit a cut
sheet of the proposed fixture for review prior to their installation.
3. Your trash containers are to be kept within the trash enclosure and the trash enclosure
closed at all times, with the exception when your trash is collected. Currently the trash
containers for this store are placed outside of the trash enclosure, which is in a state of
disrepair. The trash enclosure shall be repaired and the trash containers returned to the
interior of the enclosure.
4. While on site, I noticed that advertisement signage has been placed at the store. This
type of signage is known as special event signage, which is regulated by City Ordinance
401.15G.8 Special Events and does require a Special Event Permit, which is available at
no charge. This ordinance and a special event permit application are enclosed for your
use. Please see that the person(s) responsible for advertisement signage at the store is
provided with the information. Any advertisement signage in place at your receipt of this
letter shall be removed immediately or a special event permit remitted for its placement.

I have provided you with pages from Ordinance 401.16 Design Guidelines for additional visual
resources related to your lighting fixture cutoff and trash enclosure. All City Ordinances and
forms, including those referenced in this letter may be viewed on our webpage at
www.cityofoakparkheights.com.
Thank you in advance for your prompt attention to the above requests. Compliance to the
above shall be made no later than May 15, 2013. A compliance check will be made after this
date.
