We continue to have difficult reviewin y our submitted easement documents for Units 8 and 9. We ask
a for the followin to be completed, but that this letter allows the construction and the easements to be
based from actual "as-built" construction parameters. Please note that a we have asked that all
documents be directl drafted b le counsel and re land surve
1 The current fireplace base and chase as it is constructed as of 12/8/03 on the east side of Unit 9
shall be removed and replaced with a structure that is flush to the east exterior wall - protrudin no more
than 8 inches includin facin rock and finishes. Hom4me shall submit dimensional drawin to Jim Butler
of this structure and its ventin for prior approval. Onl the first 8" of the concrete base closest to the
structure and as currentl poured for Unit 9 ma be utilized the remainder shall be buried and not utilized.
For the Unit 9 fireplace, once completed as above - Hom4me shall provide for Cit review and
approval:
New "as-built" easement lan describin the "Easement Area" shall prepared in fall a b
Minnesota Re land-surve and shall be *inserted into a Easement Document crafted b a
licensed Attorne in the State of Minnesota describin the conve of said Easement Area.
The Easement Area shall include, at a muouimum, the followin elements: fireplace subject to the above
8" depth; g rantin g permanent and perpetual easement to correspondin unit that the Unit shall be
responsible for all upkeep, maintenance, insurance, repair and replacement of the fireplace and
structure.
An "as-built" surve map reflectin the le descriptions of the easement area. This shall be prepared
and stamped b re land-surve This Easement Area ma not encroach into an other
easement or ri
2) The patios that are currentl poured on the south side of units 8 and 9 ma remain subject to
below.
• "As-built" easement lan describin the extended Patio "Easement Area" subject to the current
dimension of the poured patios outside the established lotline shall be submitted for approval.
Easement lan shall be calculated and prepared in fall a b Minnesota Re Land Surve
and shall be inserted into a Easement Document crafted b a licensed Attorne in the State of
Minnesota describin the conve of said Easement Area.
The Basement shall include, at a m' um, the following elements: A clear definition of the Patio
Easement Area subject to the current dimension of the poured patios outside the established lot line;
granting permanent and perpetual easement to corresponding Unit; that the Unit shall be responsible
for all upkeep, maintenance, insurance, repair and replacement of the structure.
An "as- built" survey map reflecting the legal descriptions of the easement area. This shall be prepared
and stamped by registered land - surveyor. This Easement Area may not encroach into any other
easement or right-of-way.
Work may continue on these porches and fireplaces subject to the terms listed above.
