Myr lie, President Hom 4 Me, Inc. 15185 Carrousel Way #101 Rosemont, MN 55068 RE: Past Due Charges Dear Mr. Myrlie, I have again had an opportunity to review your dispute of a past due amount of $580.00 resulting from your development project. A few items: 1) The original bill dated 9-30-03 from the City was for the time period of July - August 2003 and totaled $610.00. This bill was found to be in error as a number was transposed from our engineer's bill to our pass-along to Home4Me $336 was a correct amount instead of $366. Accordingly the total bill was dropped from $610 to $580. Such correction was made. 2) As of today this corrected amount of $580 is past due. 3) This $580 bill is a result of two items related to your project - $336 amount to have engineer review final revised plan, coordination and discussion with staff regarding your project - including the ditch grade issue as well as assistance with inspection services. 4 EA It L e ; 4.1 $287 amount for additional review and letter to the City regarding the ditch slope. The City Engineer also had had at least two conversations with Mitch Johnson of EOR for correcting such slope. I take issue with your letter of March 1, 2004 where you state that "...after numerous conversations ... the amount of $687.31 was to be credited" This was never authorized and is an inaccurate statement at best. Additionally, the City did not affirm the current ditch grade as being satisfactory and we still await a correction. I refer you to our City Engineer's letter of August 8 2003 to Mitch Johnson - a copy is attached hereto. At this stage I am advising you that the bill is correct and that we await payment. You will not be granted occupancy permits until this bill is paid in full. Additionally, occupancy permits will be withheld until the ditch slope issue is corrected. Lastly we still await the survey and proper easements for the fireplace and patio issues for these two end units. Oakdale, M.1\1 55128 Re: Oakgreen Townhomes (Hom4Me) Ditch Grading BRA File No. 55-03-000 Dear Mitch: As we have previously discussed, we are concerned with the steep slopes graded in the westerly ditch of Oakgreen Avenue as part of this development. The grading plans indicate slopes of approximately 3:1. However, from our visual inspection, it appears these slopes are closer to 2:1 or 2V2:1. In addition, the new shoulder of the roadway is approximately only 1 foot in width. The current ditch grading and shoulder width is not acceptable. As we also previously discussed, you were going to verify the current slopes of this ditch and determine a remedial course of action. It seems most feasible to resolve this issue while your contractor is still on site. As of today we have not received any information relative to this issue. Review old grading plan and prepare letter to developer's engineer (cc: city and developer) to fix steep ditch grades and narrow roadway shoulder adjacent to Oakgreen Avenue. * 8/13/03 -- 0.5 hrs. Discussions with developer's engineer re: (lack of) progress re: steep ditch and narrow roadway shoulder and discuss status with city staff at weekly meeting. Overall, I had numerous discussions with Mitch Johnson of EOR (developer's engineer) regarding the steep ditch and narrow roadway shoulder issue that were initiated from his end. Quite frankly, many times 1 did not charge any time to this project after our conversations, but only charged up to half an hour when the phone calls, added to discussions at city meetings, added up to a half hour of my time. To my knowledge, nothing has yet been done to remedy the unacceptable ditch grades and roadway shoulder width that exist out there. The City may want to draft stronger (legal) language to the developer holding him responsible for any damage sustained by vehicles that may end up in this ditch (especially at night and /or during the upcoming winter months) .
