Dear Mr. Brown:

that would cause the Cit to conclude that the initial development Phase of the project

Dear Mr. Brown:
You have inquired at my office as to conditions that may be apparent at the above site
that would cause the city to conclude that the initial development phase of the project
was not completed. At this time the city does not conclude that the development is
complete as there was not a final lift of bituminous asphalt applied to the parking areas.
We have requested that this be completed on numerous occasions, sending
correspondence f the previous developer and to the management companies; yet the
project remains incomplete.
Unless and until the final lift of asphalt is complete the city will not be in a position to sign -
off on any sales transactions nor will be able to assist in the further development or
enhancements of this site. The city will entertain the receipt of a $10,000 cash security to
ensure that the final lift of asphalt is completed, but will only return such funds at such
time when the asphalting project is completed.
Keep in mind that this letter does not constitute a statement absolute zoning compliance
for other conditions or parameters. Conditions at the site may change daily and zoning
compliances remain a constant requirement. There may be other minor conditions that
require attention, however the asphalt element is of significance relative to the safety
and access to the entire site
