Section 8214 Dear Ms. Danielson: The Minnesota Department of Transportation ( Mn/DOT) has reviewed the above - referenced concept plan in compliance with Minnesota Statute 505.03, Subdivision 2., Plats. Before an further development, please address the followin issues: • Mn/DOT is currentl conductin a partnership stud of Trunk Hi (TH) 36 in this location, includin a possible interchan at Oak Avenue North. The stud is expected to be completed, and one alternative identified for this location, b the close of 2002. If the Cit is interested in discussin with Mn/DOT the impact of the proposed development, includin the possible need for the Cit to preserve land at this location, Mn/DOT is willin to meet and discuss the need to preserve land for an interchan "footprint" at TH 36 and Oak Avenue North. In the interim, the Cit should consider a re that the access not be allowed in its proposed location, but rather utilizin the south propert line of the developer's propert for access. The proposed development will need to maintain existin draina rates (i.e., the rate at which storm water is dischar from the site must not increase). The Cit or pro developer will need to submit before/after h computations for both 10 and 100 y ear rainfall events verif that all existin draina patterns and s affectin Mn/DOT ri of wa will be perpetuated. Mn/DOT's polic is to assist local g overnments in promotin compatibilit between land use and hi Residential uses located adjacent to hi often result in complaints about traffic noise. Traffic noise from TH 36 could exceed noise standards established b the Minnesota Pollution Control A (MPCA), the U.S. Department of Housin and Urban Development, and the U.S. Department of Transportation. An e opportunit employer Minnesota Rule 7030.0030 states that municipalities are responsible for takin all reasonable measures to prevent land use activities listed in the MPCA's Noise Area Classification (NAC) where the establishment of the land use would result in violations of established noise standards. Mn/DOT polic re development adjacent to existin hi prohibits the expenditure of hi funds for noise miti measures in such areas. The pro proposer should assess the noise situation and take the action deemed necessar to minimize the impact of an hi noise.
