The report covers the new city hall building and the garage addition /remodel. • New city hall building having about 26,500 sq ft on two levels. The lower level includes a 3,600 sq ft garage. • Existing addition and remodel of public works garage. • Existing public works pump house building. Mechanical Systems & Controls • Ground Source space heating and cooling systems and domestic hot water heating • Variable air volume system for comfort heating, cooling and ventilation • Energy recovery system using waste energy from exhaust air to precondition outdoor ventilation air • Use of exhaust air streams to heat the garage areas • Energy Management System • Lighting Systems and Controls • T8 lighting for interior spaces • Occupancy sensor controls (i.e. primarily office /storage space) • Metal halide and compact fluorescent fixtures for parking and exterior security areas • Lighting Control System Energy Design Assistance Plan Review Report Oak Park Heights City Hall 5 Xcel Energy 03/09 Page Executive Summary The Plan Review program is part of the suite of new construction programs offered by Xcel Energy through their Energy Design Assistance Program. This analysis was conducted by a review of current design plans provided to Xcel Energy during the month of March 2009. With the installation of the energy savings opportunities reviewed, Xcel Energy will provide incentives per measure beginning at $170 per kW and $2 per MCF while in Xcel Energy's natural gas territory. (Xcel Energy rebates will not exceed 50% of the project cost per energy conservation measure.) Our analysis found a potential annual energy savings of $ 5,921 for measures already within your construction documents and an additional $ 1,388 for measures we suggest you take a second look at. We have also recommended four additional opportunities that you may want to consider for additional energy savings. Within our report you will find the specific analysis of each measure and a summary page including all measures and potential rebates. Our strategies for more efficient energy use are to conserve energy and to shift or reduce energy demand during peak times of the day. The first step for customers is an evaluation of energy usage for new construction projects. Customers benefit because they discover how to reduce their energy costs, which can decrease their cost of doing business. Whether the business or building is large or small, commercial, industrial or retail, Xcel Energy helps customers get the most from their energy dollar. And those customers help Xcel Energy by reducing or shifting their energy use. That's how energy conservation works for everyone. When you use energy more efficiently, you also save non - renewable natural resources such as natural gas, oil, coal and water, used to generate electricity. Finally, you reduce carbon dioxide emissions at existing power plants and delay the need to build expensive new generating plants. We've reviewed the plans and specifications for the Oak Park Heights City Hall & Public Safety Buildings focusing the review on electric and gas energy using systems including lighting, mechanical systems and building envelope. The planned and proposed systems, controls and components are evaluated with respect to the State of Minnesota Energy Code. Annual cost savings estimates are based on energy efficient system and component designs above those required by the State of Minnesota Energy Code. Oak Park Heights City Hall & Public Safety Buildings have done an excellent job of incorporating energy efficient systems and controls into the design of their new buildings. These design improvements reduce energy use, provide ongoing operational cost savings and form the basis for a portion of the incentives offered as part of the plan review. This program cycles and or sheds air conditioners and rooftop unit second stage compressors on units of 20 tons and less during peak periods (i.e. noon to 6 pm on week days typical) when Xcel Energy's generation system is experiencing peak demand (i.e. about 8 —10 days per year). Not all of the units will be off at one time. Xcel Energy provides incentives up to $5 /ton for each of the 4 summer months. Your Xcel Energy Electric Sales Representative can provide you with program information. Oak Park Heights could potentially qualify for the program by installing the switches on the heat pump units. However, the planned heat pumps units are integrated into a central plant and probably would degrade operation during periods when the units would be cycled off. Installing the switch on one or two units may be a reasonable option, since the cycle times are random and two units may not cycle off at one time. Installing the switch on one 10 -ton unit, for example, would save $200 per year Xcel Energy installs the radio- controlled switch free of charge to the customer. You are encouraged • to talk to your Xcel Energy Representative about this program and how it may affect your facility and operation. 14 - Participate in Xcel Energy Peak Controlled Tiered Rate Program This program requires that the customer voluntary shed a minimum of 50 kW when requested by Xcel Energy (i.e. usually about 6 — 8 times a year from noon to 6 pm Monday through Friday). Xcel Energy provides an incentive based on the amount of demand shed and customer peak usage profile. Your electric demand costs can be reduced from $9.26/Kw (summer) and $6.61/Kw (winter) to about $4.43/Kw (summer and winter controllable demand). Your total building electrical loads could qualify this building for this program, but would require that substantial portions of the building lighting and heat pump systems be shut down during the control period. TERMS AND CONDITIONS The Company has a conservation program portfolio called "Energy Design Assistance" in which the Company offers to pay incentive payments to certain Customers for including energy- efficiency measures ("Conservation Measures") in the building that the Customer is constructing or reconstructing. Participation in one of the Energy Design Assistance programs precludes participation in Xcel Energy's prescriptive (component) programs for equipment installed as part of this project. This Agreement provides the terms for pay - ment of incentives by the Company under the Energy Design Assistance programs. 1. Conservation Measures and Incentive Payments The Company will pay the Customer an incentive for the Conservation Measures selected and installed. Payment will be made according to the results of verification. 8 2. Date of Equipment Incentive Payments The Company shall pay the Construction Incentive Amounts within 6 to 8 weeks after the following conditions are met: (1) Construction of Customer's facility is completed; (2) Customer has received an occupancy permit, and (3) Company has verified satisfactory installation of the Conservation Measures. 3. Review of Specifications Customer will provide the Company with a copy of the Construction Documents and Specifications for the construction of the Facility ( "Specifications "). For Custom Consulting projects, such Specifications must include the Conservation Measures. The Company may refuse to pay incentives if the Specifications do not adequately provide for installation of the Conservation Measures consistent with good engineering and energy- efficiency design practices. For both Custom Consulting and Plan Review projects, the Company will review the Specifications and provide the Customer with feedback regarding the specifications of the Conservation Measures within ninety (90) days of the receipt of the specifications. Failure by the Company to provide such feedback within said ninety (90) days shall be deemed approval of the specifications of the Conservation Measures. 4. Verification of Installation The Company is not obligated to pay any Equipment Incentive Amounts unless the Company is satisfied that the Conservation Measures were installed in accordance with the Specifications. Any other specific installation requirements (if any) are provided in the Incentive Rider. Failure by the Company to object to said installation within thirty (30) days of installation inspection shall be deemed satisfactory therewith. 5. Cancellation and Reimbursement (a) Term and Termination: This Agreement shall become effective upon the date first herein written and shall continue in effect for the full duration of the Agreement period. The contract will terminate after the receipt of the final incentive for the package of Conservation III Measures discussed in Section 1 and after all other agreed -upon services have been met. (b) Customer may cancel this Agreement at any time. If Customer is not engaged in a continuous program of construction of the Facility by the end of two years from the date the Customer signs this Agreement, the Company may cancel this Agreement. Limitation of Total Liability and Indemnity The Company and its Affiliates shall not be held liable, in any event or circumstance, whether in contract or in tort (including negligence or strict liability), for any special, indirect, incidental or consequential damages including, but not limited to, loss of anticipated profits, loss by non - operation or increased expense of operation, service interruptions, claims of customers or any third party, loss of use of capital or revenue, or loss of money. In any event, the total liability of the Company and its Affiliates, whether in contract, tort (including negligence and strict liability), or otherwise, shall be limited to the paying of incentives specified in Section 2, The Customer shall defend, indemnify, and hold the Company and its Affiliates harmless against all claims, demands and causes of action of every kind and character arising in favor of any person, including both the Company's employees, on account of personal or bodily injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly from the work or alteration thereof, whether such loss, damage, injury or liability, or claim thereof arises from or is contributed to by the negligence of the Company, its employees or another party. 7. No Warranties (a) Customer any es that neither the company nor of the Company's Affiliates are responsible for assuring that the design, 9 Y I' engineering and construction of the Facility or installation of the Conservation Measures is proper or complies with particular laws, codes or industry standards. Neither the Company nor its Affiliates guarantee that installation of any of the Conservation Measures wt ll res It u in an y level of ener gy II vings or result in any measurable energy - related benefit. (c) NO OTHER WARRANTIES, WHETHER STATUTORY, WRITTEN OR ORAL, EXPRESS ED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WILL APPLY. 8. Follow -up Visits (a) The Company reserves the right to make a reasonable number of follow -up visits to Customer's Facility during the 24 months follow- ing initial operation of Conservation Measures. Such visit(s) will be at a time convenient to the Customer, made with at least one week advance notice given to the Customer by the Company. 9. Audits The Company reserves the right to conduct random inspections of installations. Please retain invoices for at least 90 days. If the Company finds that you don't comply with the Company rules and standards, any rebate you have received must be returned to the Company. 10. Customer Must Pay All Taxes The benefits conferred upon Customer under this program may be taxable by federal, state and local government. Customer is responsible for declaring and paying all such taxes. Customer is encouraged to consult a tax advisor for further information. The Company is NOT responsible for the payment of any such taxes. 11. Miscellaneous (a) This Agreement is the entire agreement between the parties and supersedes all other communications and representations. (b) Customer acknowledges that the only individuals authorized to bind the Company under this Agreement are the individuals who signed his Agreement, or the President or a Vice President of the Company. (e) Confidentiality: Any and all knowledge, know -how, practices, process, Customer name or trademark, or other information (hereinafter referred to as "Confidential Information ") disclosed or submitted in writing or in other tangible form shall be considered as Confidential Information to either party by the other, and shall be received and maintained by the receiving party in strict confidence and shall not be disclosed to any third party. Furthermore, neither party shall use said Confidential Information for any purpose other than those purposes specified in this agreement. Each will agree to use its reasonable efforts not to disclose any agreed -to Confidential Information. Confiden- tial Information does not include information available in the public domain, or independently known prior to receipt thereof. (f) Force Majeure. Neither party hereto shall be considered in default in the performance of its obligations hereunder to the extent that the performance of any such obligation is prevented or delayed by any cause, existing or future, which is beyond the reasonable control of the party (g) Applicable Law. This agreement shall be constructed in accordance with the laws of the state in which the Facility is being built. The above obligations for Confidential Information shall be in effect for a period of three (3) years from the termination of this Agreement. Xcel Energy has permission to list the customer and building name as a program participant: yes no. Xcel Energy has permission to use this project for promotion of Energy Design Assistance, if so chosen: yes no. TERMS AND CONDITIONS The Company has a conservation program portfolio called "Energy Design Assistance" in which the Company offers to pay incentive payments to certain Customers for including energy- efficiency measures ( "Conservation Measures ") in the building that the Customer is constructing or reconstructing. Participation in one of the Energy Design Assistance programs precludes participation in Xcel Energy's prescriptive (component) programs for equipment installed as part of this project. This Agreement provides the terms for pay - ment of incentives by the Company under the Energy Design Assistance programs. 1. Conservation Measures and Incentive Payments The Company will pay the Customer an incentive for the Conservation Measures selected and installed. Payment will be made according to the results of verification. 2. Date of Equipment incentive Payments • The Company shall pay the Construction Incentive Amounts within 6 to 8 weeks after the following conditions are met: (1) Construction of Customer's facility is completed; (2) Customer has received an occupancy permit, and (3) Company has verified satisfactory installation of the Conservation Measures. 3. Review of Specifications Customer will provide the Company with a copy of the Construction Documents and Specifications for the construction of the Facility ( "Specifications "). For Custom Consulting projects, such Specifications must include the Conservation Measures. The Company may refuse to pay incentives if the Specifications do not adequately provide for installation of the Conservation Measures consistent with good engineering and energy- efficiency design practices. For both Custom Consulting and Plan Review projects, the Company will review the Specifications and provide the Customer with feedback regarding the specifications of the Conservation Measures within ninety (90) days of the receipt of the specifications. Failure by the Company to provide such feedback within said ninety (90) days shall be deemed approval of the specifications of the Conservation Measures. 4. Verification of Installation The Company is not obligated to pay any Equipment Incentive Amounts unless the Company is satisfied that the Conservation Measures were installed in accordance with the Specifications. Any other specific installation requirements (if any) are provided in the Incentive Rider. Failure by the Company to object to said installation within thirty (30) days of installation inspection shall be deemed satisfactory therewith. 5. Cancellation and Reimbursement (a) Term and Termination: This Agreement shall become effective upon the date first herein written and shall continue in effect for the full duration of the Agreement period. The contract will terminate after the receipt of the final incentive for the package of Conservation 40 Measures discussed in Section 1 and after all other agreed -upon services have been met. (b) Customer may cancel this Agreement at anytime. If Customer is not engaged in a continuous program of construction of the Facility by the end of two years from the date the Customer signs this Agreement, the Company may cancel this Agreement. Limitation of Total Liability and Indemnity The Company and its Affiliates shall not be held liable, in any event or circumstance, whether in contract or in tort (including negligence i it d or strict liability), for any special, indirect, incidental or consequential damages including, but not I m e to, Toss of anticipated p profits, rofits , loss by non - operation or increased expense of operation, service interruptions, claims of customers or any third party, loss of use of capital or revenue, or loss of money. In any event, the total liability of the Company and its Affiliates, whether in contract, tort (including negligence and strict liability), or otherwise, shall be limited to the paying of incentives specified in Section 2. The Customer shall defend, indemnify, and hold the Company and its Affiliates harmless against all claims, demands and causes of action of every kind and character arising in favor of any person, including both the Company's employees, on account of personal or bodily injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly from the work or alteration thereof, whether such loss, damage, injury or liability, or claim thereof arises from or is contributed to by the negligence of the Company, its employees or another party. 7. No Warranties (a) Customer acknowledges that neither the company nor any of the Company's Affiliates are responsible for assuring that the design, engineering and construction of the Facility or installation of the Conservation Measures is proper or complies with particular laws, codes or industry standards. (b) Neither the Company nor its Affiliates guarantee that installation of any of the Conservation Measures will result in any level of energy • avings or result in any measurable energy - related benefit. (c) NO OTHER WARRANTIES, WHETHER STATUTORY, WRITTEN OR ORAL, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WILL APPLY. 8. Follow -up Visits (a) The Company reserves the right to make a reasonable number of follow -up visits to Customer's Facility during the 24 months follow- ing initial operation of Conservation Measures. Such visit(s) will be at a time convenient to the Customer, made with at least one week advance notice given to the Customer by the Company. 9. Audits The Company reserves the right to conduct random inspections of installations. Please retain invoices for at least 90 days. Customer Must Pay All Taxes t The benefits conferred upon Customer under this program may be taxable by federal, state and local government. Customer is responsible for declaring and paying all such taxes. Customer is encouraged to consult a tax advisor for further information. The Company is NOT responsible for the payment of any such taxes. 11. Miscellaneous (a) This Agreement is the entire agreement between the parties and supersedes all other communications and representations. (b) Customer acknowledges that the only individuals authorized to bind the Company under this Agreement are the individuals who signed his Agreement, or the President or a Vice President of the Company. (d) For purposes of this Agreement, the term "Affiliates" means any subsidiary of Xcel Energy and its consultants. (e) Confidentiality: Any and all knowledge, know -how, practices, process, Customer name or trademark, or other information (hereinafter referred to as "Confidential Information ") disclosed or submitted in writing or in other tangible form shall be considered as Confidential Information to either party by the other, and shall be received and maintained by the receiving party in strict confidence and shall not be disclosed to any third party. Furthermore, neither party shall use said Confidential Information for any purpose other than those purposes specified in this agreement. Each will agree to use its reasonable efforts not to disclose any agreed -to Confidential Information. Confiden- tial Information does not include information available in the public domain, or independently known prior to receipt thereof. (f) Force Majeure. Neither party hereto shall be considered in default in the performance of its obligations hereunder to the extent that the performance of any such obligation is prevented or delayed by any cause, existing or future, which is beyond the reasonable control of the party (g) Applicable Law. This agreement shall be constructed in accordance with the laws of the state in which the Facility is being built. The above obligations for Confidential Information shall be in effect for a period of three (3) years from the termination of this Agreement. The unauthorized use of either party's name, logo, or other identifying marks is expressly prohibited. 12. Final Report. The final report, which will outline all the estimated energy savings and incentives to be paid for the Conservation Measures that were commended and/or implemented, will be presented to the Customer thirty(30) days after the conditions have been met regarding the onstruction Incentive Amounts mentioned in Section 2. Xcel Energy has permission to list the customer and building name as a program participant: yes no. Xcel Energy has permission to use this project for promotion of Energy Design Assistance, if so chosen: yes no. TERMS AND CONDITIONS The Company has a conservation program portfolio called "Energy Design Assistance" in which the Company offers to pay incentive payments to certain Customers for including energy- efficiency measures ( "Conservation Measures ") in the building that the Customer is constructing or reconstructing. Participation in one of the Energy Design Assistance programs precludes participation in Xcel Energy's prescriptive (component) programs for equipment installed as part of this project. This Agreement provides the terms for pay- ment of incentives by the Company under the Energy Design Assistance programs. 1. Conservation Measures and Incentive Payments The Company will pay the Customer an incentive for the Conservation Measures selected and installed. Payment will be made according to the results of verification. 2. Date of Equipment Incentive Payments • he Company shall pay the Construction Incentive Amounts within 6 to 8 weeks after the following conditions are met: (1) Construction of Customer's facility is com leted; (2) has received an occupancy permit, and (3) Company P h a s verified satisfactory installation of the Conservation Measures. 3. Review of Specifications Customer will provide the Company with a copy of the Construction Documents and Specifications for the construction of the Facility ( "Specifications "). For Custom Consulting projects, such Specifications must include the Conservation Measures. The Company may refuse to pay incentives if the Specifications do not adequately provide for installation of the Conservation Measures consistent with good engineering and energy- efficiency design practices. For both Custom Consulting and Plan Review projects, the Company will review the Specifications and provide the Customer with feedback regarding the specifications of the Conservation Measures within ninety (90) days of the receipt of the specifications. Failure by the Company to provide such feedback within said ninety (90) days shall be deemed approval of the specifications of the Conservation Measures. 4. Verification of Installation The Company is not obligated to pay any Equipment Incentive Amounts unless the Company is satisfied that the Conservation Measures were installed in accordance with the Specifications. Any other specific installation requirements (if any) are provided in the Incentive Rider. Failure by the Company to object to said installation within thirty (30) days of installation inspection shall be deemed satisfactory therewith. 5. Cancellation and Reimbursement () Term and Termination: This Agreement upon the date first herein written and shall continue in effect for the g reement shall become effective P full duration of the Agreement period. The contract will terminate after the receipt of the final incentive for the package of Conservation easures discussed in Section 1 and after all other agreed -upon services have been met. (b) Customer may cancel this Agreement at any time. If Customer is not engaged in a continuous program of construction of the Facility by the end of two years from the date the Customer signs this Agreement, the Company may cancel this Agreement. Page 1 of 4 06 -10 -206 12/2006 ConservationWise from Xcel Energysm • (c) Upon cancellation of this Agreement by the Customer, Customer must reimburse all payments made by the Company to the Customer under this Agreement, for Conservation Measures not completely installed. 6. Limitation of Total Liability and Indemnity The Company and its Affiliates shall not be held liable, in any event or circumstance, whether in contract or in tort (including negligence or strict liability), for any special, indirect, incidental or consequential damages including, but not limited to, loss of anticipated profits, loss by non - operation or increased expense of operation, service interruptions, claims of customers or any third party, loss of use of capital or revenue, or loss of money. In any event, the total liability of the Company and its Affiliates, whether in contract, tort (including negligence and strict liability), or otherwise, shall be limited to the paying of incentives specified in Section 2. The Customer shall defend, indemnify, and hold the Company and its Affiliates harmless against all claims, demands and causes of action of every kind and character arising in favor of any person, including both the Company's employees, on account of personal or bodily injuries or death, or damages to property occurring, growing out of, incident to, or resulting directly or indirectly from the work or alteration thereof, whether such loss, damage, injury or liability, or claim thereof arises from or is contributed to by the negligence of the Company, its employees or another party. 7. No Warranties (a) Customer acknowledges that neither the company nor any of the Company's Affiliates are responsible for assuring that the design, engineering and construction of the Facility or installation of the Conservation Measures is proper or complies with particular laws, codes or industry standards. (b) Neither the Company nor its Affiliates guarantee that installation of any of the Conservation Measures will result in any level of energy savings or result in any measurable energy - related benefit. • (c) NO OTHER WARRANTIES, WHETHER STATUTORY, WRITTEN OR ORAL, EXPRESSED OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WILL APPLY. 8. Follow -up Visits (a) The Company reserves the right to make a reasonable number of follow -up visits to Customer's Facility during the 24 months follow- ing initial operation of Conservation Measures. Such visit(s) will be at a time convenient to the Customer, made with at least one week advance notice given to the Customer by the Company. 9. Audits The Company reserves the right to conduct random inspections of installations. Please retain invoices for at least 90 days. If the Company finds that you don't comply with the Company rules and standards, any rebate you have received must be returned to the Company. 10. Customer Must Pay All Taxes The benefits conferred upon Customer under this program may be taxable by federal, state and local government. Customer is responsible for declaring and paying all such taxes. Customer is encouraged to consult a tax advisor for further information. The Company is NOT responsible for the payment of any such taxes. 11. Miscellaneous (a) This Agreement is the entire agreement between the parties and supersedes all other communications and representations. (b) Customer acknowledges that the only individuals authorized to bind the Company under this Agreement are the individuals who signed this Agreement, or the President or a Vice President of the Company. • Page 2 of 4 06 -10 -206 12/2006 ENERGY DESIGN ASSISTANCE 40 PROGRAM AGREEMENT (c) If either the Company or Customer desires to modify this Agreement, the modification must be in writing and signed by an authorized person of the other party in order for the modification to be enforceable against that party. P P 9 Y Y 9Y le) Confidentiality: Any and all knowledge, know -how, practices, process, Customer name or trademark, or other information (hereinafter referred to as "Confidential Information ") disclosed or submitted in writing or in other tangible form shall be considered as Confidential Information to either party by the other, and shall be received and maintained by the receiving party in strict confidence and shall not be disclosed to any third party. Furthermore, neither party shall use said Confidential Information for any purpose other than those purposes specified in this agreement. Each will agree to use its reasonable efforts not to disclose any agreed -to Confidential Information. Confiden- tial Information does not include information available in the public domain, or independently known prior to receipt thereof. (f) Force Majeure. Neither party hereto shall be considered in default in the performance of its obligations hereunder to the extent that the performance of any such obligation is prevented or delayed by any cause, existing or future, which is beyond the reasonable control of the party (g) Applicable Law. This agreement shall be constructed in accordance with the laws of the state in which the Facility is being built. The above obligations for Confidential Information shall be in effect for a period of three (3) years from the termination of this Agreement. The unauthorized use of either party's name, logo, or other identifying marks is expressly prohibited. 12. Final Report. The final report, which will outline all the estimated energy savings and incentives to be paid for the Conservation Measures that were i 'ommended and /or implemented, will be presented to the Customer thirty(30) days after the conditions have been met regarding the nstruction Incentive Amounts mentioned in Section 2. The numbers listed here are very preliminary, based upon the concept plans that have been submitted to date. These are all subject to change as the plans are refined. A listing of those issues is as follows: Comprehensive Plan. The Proposed Land Use Map of the 2008 Comprehensive Plan indicates the existing City Hall and parking lots as Government Facilities. The area to the north, where the new City Hall is located, is designated for Park Facilities /Open Space. In that the 2008 plan has not been formally approved by the City Council, the area designated as Government Facilities would be expanded to include the new City Hall area. The map would be revised prior to the final adoption of the plan in December 2008. Zoning. The City Hall and surrounding open areas are zoned 0, Open Space Conservation. Municipal structures and buildings, as well as parks and recreational facilities, are a listed permitted use. The public works facility would be an accessory structure. Parking. City Halls are considered as office buildings for the purpose of calculating parking requirements. The Zoning Ordinance requires "three (3) spaces plus at least one space for each two hundred (200) square feet of floor area." Solid or board -on -board wood fencing or a masonry wall around the storage yard would be required. 2. Site Plan Review. The City Council may want the Planning Commission to comment on the site plan. 3. Design Guidelines Review.
