EASEMENT AGREEMENT z
This Agreement made this 11 th day of August, 2004, by and between Oakgreen Townhome Association,
a Minn-esota corporation (hereinafter referred to as "GRANTOR "); and Horn4Me, Inc., a Minnesota
corporation (hereinafter referred to as "GRANTEE ").
WITNES SETH:
WHEREAS, GRANTOR. owns the following described property:
Lot ten (10), Block one (1), Common Interest Community No. 213, A Plarnied
Community, Oakgreen Townhom-es, County of Washington, State of Minnesota
(hereinafter referred to as Premises A);
WHEREAS, GRANTEE owns the following described property:
Lot nine (9), Block one (1), Common Interest Community No. 213, A Planned
Community, Oakgreen Townhomes, County of Washington, State of Minnesota
(hereinafter referred to as Premises B); and
WHEREAS, That for and in consideration of the sump of one and 001100 dollar ($1.00) and other
good and valuable consideration, the receipt of which is hereby acknowledged, GRANTOR has this day
bargained and sold, and by these presents does bargain, sell., and convey unto GRANTEE, its successors
and assigns the following:
A perpetual easement to construct, use, maintain, improve, repair and replace a patio structure
over, under, and across the real estate hereinafter described.
Beginning at the Southwest comer of Lot 9, Block I, Oakgreen Townhomes,
Washington County; thence South 01 degrees 51 minutes 18 seconds East (Basis of
Bearings: assumed), along a line which is an extension southerly of the westerly line of
said Lot 9, a distance of 1.0 feet; thence North 88 degrees 08 minutes 52 seconds East,
parallel with the southerly line of said Lot 9, a distance of 22.0 feet; thence North 01
degrees 51 minutes 18 seconds west, along a line which is an extension of the easterly
line of said Lot 9, a distance of 1.0 feet to the southeast corner of said Lot 9; thence South.
88 degrees 08 minutes 52 seconds West, along the southerly line of said Lot 9, a distance
of 22.0 feet to the point of beginning. Subject to and together with any other casements,
reservations, and restrictions of record.
GRANTOR AND GRANTEE agree that the property described in this easement will be
maintained under agreements as assigned in the Common Interest Community No.213, Oal�green
Townhomes, Washington County, Minnesota Declaration and in all present and future amendments to
said Declaration.
The easement hereby granted, the restrictions hereby imposed, and the agreements herein
contained shall be easements, restrictions and covenants running with the land and shall inure to the
benefit of and be binding upon the parties hereto and their respective heirs, successors, and assigns,
including With -out limitation, all subsequent owners of Premises A and Premises B.
GRANTOR, for itself, it successors and assigns does hereby covenant with the GRANTEE, its
successors and assigns, that it is well seized in fee title of Premises A. and has the sole right to grant and
convey this easement to GRANTEE.
In witness whereof, the parties hereto have signed this Easement Agreement the date and year
