This document replaces NA Document G713, Construction Change Authorization.) , PROJECT: Oak Park Heights City Hall DIRECTIVE NO: Six (6) (name, address) 14168 Oak Park Blvd. North Oak Park Heights, MN 55082 DATE: June 17, 2010 TO CONTRACTOR: ARCHITECT'S PROJECT NO: 0822 (name, address) Jorgenson Construction 9255 East River Road NW CONTRACT DATE: April 15, 2009 Coon Rapids, MN 55433 CONTRACT FOR: General Construction You are hereby directed to make the following change(s) in this Contract: • Now in Project Phase 2 of the Project, Contractor claims that existing limestone bedrock is at below -grade depth of 120 +1- which is less than anticipated depth of 145' to 155'. • Contractor claims that drilling through existing bedrock from below - grade depth of 120 +/ tb 145' +1 or 155' is more costly than drilling to below -grade depth of 120' +/- (not through bedrock). • Contractor proposes to drill 10 to 12 120 +/- deep wells at all well locations in Phase Two and all additional lateral and horizontal piping and millwork for a total additional fee of $7,200 and does not require additional time to complete this task. • Contractor claims that these proposed additional wells and the shorter below -grade depth constitute an unknown, unforeseen and unanticipated condition. • Architect advises that attached Specification Section 15826 Geothermal Ground Loop Design -Build Specification specifically requires Contractor to accept burden of any and all unknown, unforeseen and unanticipated conditions. COMPLETING THE G714 FORM • 1. With the concurrence of the Owner, the Architect initiates and prepares the form (Including a description of the Work) and attaclunents. 2. Method of Determining Costs (D . In accordance with Subparagraph 7.3.3 of AIA Document A201 (1987 edition), insert the method proposed for determining the final cost of the ( Work involved. If the proposed method of adjustment is acceptable. the Contractor so advises the Architect and the method selected shall be utilized In the determination of future Applications for Payment. If the proposed method of adjustment is not acceptable. the Contractor so advises the Architect. In such event, the method of the adjustment will automatically become that designated In Subparagraph 7.3.6. The Architect should prepare a Change Order for execution by the Owner, Architect and Contractor for the Work directed by the Construction Change Directive when (a) the Contractor agrees to the proposed adjustment of the Contract Sum and Contract Time upon receipt of the Construction Change Directive or (b) the Contractor and Owner agree to the determination by the Architect of the change in Contract Sum • pursuant to Subparagraph 7.3.6 and Contract Time pursuant to Subparagraph 7.3.8, If, following the Architect's determination, no agreement is • reached, the matter is referred to the Architect as a Claim. • 3/88 • Oak Park Heights City Hall Minutes of Construction Meeting Number Fifty -One Oak Park Heights, Minnesota Conducted on December 2,2010 BA #0822 Page 42.12 Architect's Comments (Remaining Items) • Water entered Lower Level Mechanical/Electrical Room, Police Evidence Room and ceiling at Main Level Display Case. Architect will review and will report. Architect issued Memorandum. Contractor is searching for apparent sources of leak. Architect issued recommendations for application of stormwater control measures to reduce ponding in that area Contractor will view and will advise. Contractor believes that this leaking situation will not reappear. Architect will issue drawings to Owner that would indicate placement of materials to deflect and direct water that exits from downspouts and sump pump outflow. Contractor advised that drain pan was installed above wood ceiling at location of leak. Also, Proposal Request Forty -Four (44) (Second Revision) was issued to Contractor. Contractor requested to submit separate prices for gutter and downspout work apart from underground pipe drain work. That was agreed to 45.13 Owner's Comments (Remaining Items) • Owner advised that sound above ceiling line of VAV Box motor is still apparent. Architect will review. Mechanical Engineer will issue a report that indicates the source of the noise as a noisy motor in the Lower Level AHU Unit (return air side) in the Mechanical Room. Contractor is asked to review and to respond. Response stated that Mechanical Subcontractor will look into provision of alternate Variable Frequency Drive (VFD). Waiting for Mechanical Subcontractor's onsite review. VFD was installed — noise is reduced. 47.11 Miscellaneous Items. • Contractor will provide responses to previously- issued Construction Change Directives. Responses to CCD One, CCD Two and CCD Three were received. Owner awaits receipt of it all CCDs prior to seeking resolution with Contractor. Responses to CCD Four and CCD Five were received from Contractor. Contractor will check with Geothermal Subcontractor regarding CCD Six. Architect will issue notice regarding resolution actions for CCDs One through Five. CCD Six is no cost change so Contractor was requested to sign CCD Six and to return to Architect. 47.12 Architect's Comments (Remaining Items) • Bituminous paving wear course installation presents issues of durability, aesthetics and quality expectations. Onsite discussion and discussion at this Project Meeting followed. Architect will prepare letter to Contractor for Contractor's response. Architect sent letter rejecting bituminous paving wear course in Light -Duty paved area of driveway and parking south of new City Hall. Awaiting Contractor's response. Contractor proposed "Chip and Seal" technique (at main parking area south of City Hall, at Employees parking area south of Oak Park Boulevard and at patched areas on 57t Street and O'Brien Avenue. Owner will consider the above. Only "bird bath" repairs can occur this Fall. Other repair and /or replacement Work cannot be achieved yet this year. Architect recommended replacement of wear course. Owner, however, requested letter from Contractor that would describe Contractor's application of topcoat, extended warranty, removal of bituminous from gutters and restriping in 2 or 3 years hence.
