DECEMBER 14, 2009 BUETOW AND ASSOCIATES INC. 2345 RICE STREET SurrE 210 ROSEVILLE, MN 55113 RANDY ENGEL — PROJECT ARCHITECT RE: CONSTRUCTION CHANGE DIRECTIVE No. 1 RANDY, THIS LETTER IS IN RESPONSE TO CONSTRUCTION CHANGE DIRECTIVE No. 1. PER AIA DOCUMENT A201 - 2007, ARTICLE 7.3 JORGENSON CONSTRUCTION INC. WILL PROCEED WITH THE PROPOSED WORK AS DESCRIBED IN THE CONSTRUCTION CHANGE DIRECTIVE. HOWEVER, PER ARTICLE 7.3.5 AS I INDICATED TO YOU AT THE CONSTRUCTION MEETING ON WEDNESDAY, DECEMBER 2, 2009 JORGENSON CONSTRUCTION INC. DOES NOT AGREE WITH THE PROPOSED LUMP SUM ADJUSTMENT METHOD IN THE CONTRACT SUM OR CONTRACT TIME INDICATED ON THE CONSTRUCTION CHANGE • DIRECTIVE No. 1. ACCORDING TO ARTICLE 7.3.6, "A CONSTRUCTION CHANGE DIRECTIVE SIGNED ONLY BY THE OWNER AND ARCHITECT CONSTITUTES A CHANGE IN THE CONTRACT WHICH THE OWNER RECOGNIZES THAT THE CONTRACTOR MAY BE ENTITLED TO AN ADJUSTMENT TO THE CONTRACT SUM IF SUBSTANTIATED BY THE CONTRACTOR." THEREFORE, WE ARE PROCEEDING WITH THE WORK ACCORDING TO SECTION 012600 CONTRACT MODIFICATION PROCEDURES, 1.6 CONSTRUCTION CHANGE DIRECTIVE, ITEM 1.6.B "DOCUMENTATION: MAINTAIN DETAILED RECORDS ON A TIME AND MATERIAL BASIS OF WORK REQUIRED BY CONSTRUCTION CHANGE DIRECTIVE. We have proceeded with both of these CCD's but with protest. CCD#1 —we will order the amount of Lighting Fixtures per the Architects counts in lieu of our counts but do not agree nor do we agree to cutting of all the material quanities . Appollo Systems pricing was arbitrarily cut with no explanation. We reserve the right for additional days as this is forced work. This is a T &M forced work and do not agree to any lump sums listed. CCD#2- -There will be no credit for material or labor for 19 -Type K already on the jobsite. They will not take them back for credit. The labor has already been expended on the jobsite. The 19 -new LED Type K2 will require the additional labor to receive , distribute, and install —more labor is also due to LED fixtures being harder to install than recessed fluorescents. if there is no scaffold in place at the time these fixtures are received an all terrain lift will be necessary to install these out of sequence/scheduled late fixtures. Who will be keeping track of our daily time involved in these CCD's? Please advise. Thanks C.F. C.F. The JCI claim is $13,039 and I think it should be $10,504. Why ?: I reviewed previous the PR 13 response 1)Gephart Electric Work: Only 1 E2 device should be added -not 2 - plus 1 E2 device was deleted at Opening 018 (not originally included in the Proposal Request) and 1 E2 device was modified. 0 2) Gephart Electric pricing adjusted for lesser quantity of electrical work. 3) Appollo pricing adjusted for lesser quantity of telephone receptacle work.
