Wolff (i9:t,1-1996) *Qualified Neutral ArLitrator & .\ketliator +Qualified Neutral \rLitrator i,:C'ertiFIed Real Estate Speeialist You will be receiving an application for minor subdivision from Mr. David Dupay, surveyor with Folz, Freeman and Dupay, who has surveyed properties on behalf of Routson Motors. Routson Motors has acquired the former Sut t ler' s Liquor Building on Osgood Avenue adjacent to what is now the Amoco Oil Station, the former Erickson Post. In surveying those properties, it was determined that an encroachment in the boundary lines has existed in the main building for Standard Oil as well as an encroachment in the wooden structure that serves that main structure. In order to resolve the encroachment, both affected properties are needing to make an adjustment to the common boundary line. They will do this by having mutual conveyances of what ends up being a very small sliver of land to each other so that they can adjust the boundary accordingly. I am enclosing a photocopy of the portion of the survey which indicates the area of encroachment. Mr. Dupay will be preparing the legal descriptions of the area to be conveyed between the respective parties. Since this is purely for the purposes of making a boundary adjustment so as to avoid the encroachment and is not altering the total square footage of either property or otherwise substantially changing any aspect on either property, I am Ms. Judy Holst January 19, 1998 Page 2 suggesting that this transaction be allowed to go forward by way of minor subdivision without public hearing. I have reviewed this matter with Scott Richards, who has advised me that he is not aware of any issues with regard to either property that would require the attention of the Council in any other respect. I have also checked on the subject properties with Jim Butler, who is also advising me that there is nothing within his department that requires any further attention on these properties. In order to accommodate real estate transfers and closings that are scheduled, the parties are requesting that this matter be scheduled on the Council agenda for January 27 and, given the nature of the request, I would suggest it is appropriate to be placed upon the consent agenda.
