PLANNING COMMISSION MEETING MINUTES
Thursda Februar 12, 2004
PUBLIC HEARING EXCERPT
Call To Order: Chair Dw called the meetin to order at 7:00 p.m. Present: Vice Chair
Runk., Commissioners Lil Oswald and Powell. Cit Administrator J ohnson, Cit Planner
Richards and Commission Liaison McComber.

A. S &C Bank: To consider re q uests for rninor subdivision and planned unit development
amendment to permit division of existin buildin located at 5795 Mornin Dove Ave. N.,
into two privatel owned office condominiums. (2)
Cit Planner Richards reviewed the Februar 5, 2004 plannin report, provided an issue anal and
recommended conditions for approval, should the Commission wish to recommend approval of the
re

Oswald, moved to close the public hearin Carried 5-0.
Commission discussion ensued as to si allowance at the site.
Vice Chair Runk, seconded b Commissioner Oswald, moved to recommend that the Cit Council
approved the re q uest, sub to the followin conditions:
1. The applicant produce either a tide opinion or a tide commitment or other verification of
the status of current tide, depictin current fee owner and outstandin hens and
encumbrances a g ainst the buildin propert sub to review and approval of the Cit
Attorne
2. The applicant suppl m -relative to the Common Interest Communit #235 that the
wish to create, with appropriate places for si of current owner and encumberin
interest a the propert in addition to the other statutor executions that need to be on
that plat. The plat shall be sub to review and approval of the Cit Administrator and City
Attorne
3. The applicant has 'informed us that, notwithstandin the condon-A'niurm'zation of the
buildin the do not intend to have separate utilities to Unit 101, which is bein created b
the condominium and minor subdivision application. Thus, a condition of the application
will have to be that the fee owner of Unit 100 and their successors, hells and assi will be
directl responsible to the Cit of Oak Park Hei for pa of all outstandin utilities
relative to the propert it bein understood that the Cit will not have to create a separate
billin entit or item for Unit 101, within its database, for utilit billings.

4. The applicant shall provide a completed, fully executed copy of a Common Interest
Con anunity #235 declaration, in substantially the same form as provided to the City, as part
of the final permitting, subject to approval of the City Attorney. That document will also
have to be amended to reflect that all utility billings for the City of Oak Park Heights will be
billed directly to Unit 100, who will then prorate or collect from Unit 101, its fah- share of
such billings. Not withstanding that process, Unit 100 will be solely and exclusively
responsible to the City of Oak Park Heights for payment of all municipal utility billings
incurred on the premises.
5. Any changes to the signage shall require submittal of a sign permit, subject to review and
approval of the Building official.
6. The landscaping shall be inspected by the City Arborist in June of 2004. Any trees or shrubs
that are dead or diseased, as determined by the City Arborist, shall be replaced by the
applicant with similar, healthy plant materials subject to review and approval of the City
Arborist.
Carried 5 -0.
Adi ournment Commissioner Powell, seconded by Commissioner Oswald, moved to adjourn
at 8:25 p.m. Carried 5 -0.
