I responded to the complaint and found portions of the south east side of the parking lot flooded with runoff water. Upon further investigation, it is apparent that the storm catch basins at parcel#0502920120042 drain to the south into a holding pond owned by Wal-Mart. The drainage pond near the north property line separating Wal-Mart from Applebee's is designed to carry run off water to the west and into an outlet situated at the west end of the holding pond. An inspection of the drainage pond indicates that maintenance has not been performed on the pond and it no longer operates as designed. The pond must be restored to its original design to allow run off water to flow properly. • The property owner is responsible for maintenance of privately owned ponds. This letter serves as notice to restore the pond to its original design and maintain it accordingly to prevent similar run off drainage issues in the future. Please correct the failed drainage pond no later than September 30,2013. Should Wal-Mart fail to restore the drainage pond as designed by the aforementioned date,the City of Oak Park Heights may contract the work at Wal-Mart's expense.
