On N+evember 20, 2002 a Stop Work order was placed at oak Park Station. The _
Stop work Order reiterated the City requirement 'to submit a plan and receive
approval prior,to starting. the work. This. requ�rerr�ent was presented .td you on page 4
paragraph of our November 1, 2002 letter. -

Avenue and 60 -foot wide flat bottom ditch running from 'Memorial Avenue to the
existing pond. The 6o foot wide ditch is an essential part of the approval of the -oak
;Park Station development from both the watershed and the City. This' area provides

water storage for the future development of oak 'ark Station.
Today I received a copy of the Browns Creek Watershed District "Findin of Fact -

Conclusions of -Law and Order" order #2 requires ripraping of the ditch with a 20-.
foot width.

The BCWD Board Order #2 is a short-term solution for erosion control and is in minor
conflict with the lon solution of the Oak Park Station development plan. If the
BCWD 20-foot flat bottom ditch is centered in the area where y our drawin shows
the 60-foot wide ditch, startin with a stillin basin at the outlets of the pipes under
Memorial Avenue and extendin to below the normal water level of the pond then
y ou would appear to have met the BCWD Order. If this ditch is properl desi
and installed it have minimal interference with the future widenin of the area to 60
feet for hi water stora The final result could be the 60-foot wide area with a 20-
foot wide riprap channel down the middle.
As of toda the onl plan approved b the Cit of Oak Park Hei is the Metro
Surve plan with the 60-foot wide ditch and pond near Memorial Avenue. If staff
were presented with plans showin a minor modification to the approved plan that
shows the BCWD 20-foot riprap ditch incorporated into th 60 foot wide area I would
recommend to our Interim Cit Administrator, Communit Development Director and
Cit En that the chan is a minor modification and enhancement of the
approved plan, therefore can be approved b Staff. The plans need to show the
location of the ditch bottom elevations and t cross sections showin how the
riprap section fits into the 60-foot wide area. Staff will also consider an other
method to achieve both the BCWD short-term re and the lon term
development plan. In order to meet the BCWD's deadline of December 9, 2002
plans acceptable to Cit Staff as a minor chan to the approved plans need to be
submitted immediatel
