1. Contractor and Surety, jointly and severally, bind themselves, their heirs, executors, administrators,
successors, and assigns to Owner to pay for labor, materials, and equipment furnished by Claimants for use in
- the performance of the Contract, which is incorporated herein by reference.
2. With respect to Owner, this obligation shall be null and void if Contractor:
2.1 Promptly makes payment, directly or indirectly, for all sums due Claimants, and
2.2 Defends, indemnifies, and holds harmless Owner from all claims, demands, liens, or suits alleging
non-payment by Contractor by any person or entity who furnished labor, materials, or equipment
for use in the performance of the Contract, provided Owner has promptly notified Contractor and
Surety (at the addresses described in Paragraph 12) of any claims, demands, liens, or suits and
tendered defense of such claims, demands, liens, or suits to Contractor and Surety, and provided
there is no Owner Default.
3. With respect to Claimants, this obligation shall be null and void if Contractor promptly makes payment,
directly or indirectly, for all sums due.
4. Surety shall have no obligation to Claimants under this Bond until:
4.1 Claimants who are employed by or have a direct contract with Contractor have given notice to
Surety (at the address described in Paragraph 12) and sent a copy, or notice thereof, to Owner,
stating that a claim is being made under this Bond and, with substantial accuracy, the amount of the
claim.
4.2 Claimants who do not have a direct contract with Contractor:
1. Have furnished written notice to Contractor and sent a copy, or notice thereof, to Owner, within
90 days after having last performed labor or last furnished materials or equipment included in the
claim stating, with substantial accuracy, the amount of the claim and the name of the party to
whom the materials or equipment were furnished or supplied, or for whom the labor was done or
performed; and
2. Have either received a rejection in whole or in part from Contractor, or not received within 30
days of furnishing the above notice any communication from Contractor by which Contractor had
indicated the claim will be paid directly or indirectly; and
3. Not having been paid within the above 30 days, have sent a written notice to Surety (at the address
described in Paragraph 12) and sent a copy, or notice thereof, to Owner, stating that a claim is
being made under this Bond and enclosing a copy of the previous written notice furnished to
Contractor.
5. If a notice by a Claimant required by Paragraph 4 is provided by Owner to Contractor or to Surety, that is
sufficient compliance.
6. Reserved.
7. Surety's total obligation shall not exceed the amount of this Bond, and the amount of this Bond shall be
credited for any payments made in good faith by Surety.
8. Amounts owed by Owner to Contractor under the Contract shall be used for the performance of the Contract
and to satisfy claims, if any, under any performance bond. By Contractor furnishing and Owner accepting this
Bond, they agree that all funds earned by Contractor in the performance of the Contract are dedicated to satisfy
obligations of Contractor and Surety under this Bond, subject to Owner's priority to use the funds for the
completion of the Work.
9. Surety shall not be liable to Owner, Claimants, or others for obligations of Contractor that are unrelated to
the Contract. Owner shall not be liable for payment of any costs or expenses of any Claimant under this Bond,
and shall have under this Bond no obligations to make payments to,give notices on behalf of, or otherwise have
obligations to Claimants under this Bond.

10. Surety hereby waives notice of any change, including changes of time, to the Contract or to related
subcontracts,purchase orders, and other obligations.
11. No suit or action shall be commenced by a Claimant under this Bond other than in a court of competent
jurisdiction in the location in which the Work or part of the Work is located or after the expiration of one year
from the date (1) on which the Claimant gave the notice required by Paragraph 4.1 or Paragraph 4.2.3, or(2) on
which the last labor or service was performed by anyone or the last materials or equipment were furnished by
anyone under the Contract, whichever of(1) or (2) first occurs. If the provisions of this paragraph are void or
prohibited by law, the minimum period of limitation available to sureties as a defense in the jurisdiction of the
suit shall be applicable.
12. Notice to Surety, Owner, or Contractor shall be mailed or delivered to the addresses shown on the signature
page. Actual receipt of notice by Surety, Owner, or Contractor, however accomplished, shall be sufficient
compliance as of the date received at the address shown on the signature page.
13. When this Bond has been furnished to comply with a statutory requirement in the location where the
Contract was to be performed, any provision in this Bond conflicting with said statutory requirement shall be
deemed deleted herefrom and provisions conforming to such statutory requirement shall be deemed
incorporated herein. The intent is that this Bond shall be construed as a statutory Bond and not as a common
law bond.
14. Upon request of any person or entity appearing to be a potential beneficiary of this Bond, Contractor shall
promptly furnish a copy of this Bond or shall permit a copy to be made.
15. Definitions
15.1 Claimant: An individual or entity having a direct contract with Contractor, or with a first-tier
subcontractor of Contractor, to furnish labor, materials, or equipment for use in the performance of the
Contract. The intent of this Bond shall be to include without limitation in the terms "labor, materials or
equipment" that part of water, gas, power, light, heat, oil, gasoline, telephone service, or rental
equipment used in the Contract, architectural and engineering services required for performance of the
Work of Contractor and Contractor's subcontractors, and all other items for which a mechanic's lien
may be asserted in the jurisdiction where the labor, materials, or equipment were furnished.
15.2 Contract: The agreement between Owner and Contractor identified on the signature page, including all
Contract Documents and changes thereto.
15.3 Owner Default: Failure of Owner, which has neither been remedied nor waived, to pay Contractor as
required by the Contract, or to perform and complete or otherwise comply with the other terms
thereof.

EXPLANATION
This application form shall be used for installations of utility service connections that do not cross the trunk highway roadbeds,for miscellaneous guys and anchors,and for
performing miscellaneous work on the highway right of way.
Utility applications for overhead and underground installations and extensions thereto shall be made on Form 2525 and submitted to the Utilities and Agreements Engineer,State
Transportation Building for issuance.
PERTINENT REGULATIONS
Safety
1. Where work on or near the traveled roadway is necessary,proper signs,channelizing devices,warning lights,and barricades shall be erected to protect traffic,employees,
and pedestrians.All traffic control devices and methods shall conform to the Minnesota Field Manual on Temporary Traffic Control Zone Layouts,Minnesota Manual on
Uniform Traffic Control Devices(MMUTCD),Minnesota Standard Sign Manual,and the appropriate provisions of Standard Specification 17I0.
2. If work to be done lies within a municipality or platted town,permission must be obtained from such village,town,or city.
3. Excavations must be cribbed when necessary,depending upon type of soil,in order to prevent cave-ins.All excavations,trenching and/or jacicing and boring pits shall be
shored or sloped in accordance with OSHA requirements.
4. No guys or stays or any structure are to be attached to trees on trunk highway right of way.
5. Underground construction must be so constructed as not to harm or unnecessarily destroy the root growth of specimen trees.
PERTINENT REGULATIONS
Roadway
1. Installation of pipe under concrete or bituminous pavements shall be done by jacking or boring or other approved methods.
2. When open trenching or excavating in existing roadways,all subgrade,base,and surfacing materials shall be replaced with the same type,depth,and density of
materials which were removed.
3. All backfill must be placed in 6"or less layers and thoroughly tamped and material must be flush and even with the adjacent surface when finally in place.
4. If pavement or roadway is damaged,same shall be restored to a condition as good as or better than the original condition.
5. All pavements shall be replaced in accordance with State specifications.
6. If settlement occurs or excavation caves in so that replaced materials settle(bituminous mat or concrete base),same shall be restored to a condition as good as or better
than the original condition.
7. Unless adequately protected by a traffic barrier,there shall be no work within the clear zone,nor shall pipe materials,equipment or other objects as determined by the
State,be stored within the clear zone as detennined by the Department and as defined by the latest edition ofAASHTO's"Guide for Selecting Locations,and Designing
Traffic Barriers".
8. No poles,anchors,anchor braces,or other construction shall be placed on the roadway shoulder or within the prescribed clear zone.
9. No driving onto highway from ditch or driving on shoulders will be permitted where damage will occur.
10. No foreign material such as dirt,gravel,or bituminous material shall be deposited or left on the road during any construction activities.
LIMITATIONS
1. No lugs shall be used on equipment traversing the road which will damage the road surface.
2. Roadside shall be cleaned up upon completion of all work.
3. If Department of Transportation shall make any improvements or change on all or any part of its right of way upon,over,under,or along the highway,then and in every
case the applicant herein named shall after notice from the Commissioner of Transportation or his authorized agents proceed to alter,change,vacate,or remove from
trunk highway right of way said works necessary to conform with said changes without cost whatsoever to the State of Minnesota.
4. Drainage on the trunk highway right of way shall be done under Form 30795-02 available at the District/Area Maintenance office.
5. After work on a project is completed said persons doing such work must notify the Area Maintenance Engineer or his authorized representative in which district the
work is being performed that such work has been completed and ready for final inspection and acceptance by the State of Minnesota.
6. Cutting and trimming of trees within the right of way and removal of resulting stumps require prior approval of the Area Maintenance Engineer or his authorized
representative.
NOTE: Certified Check or Bond may be required to Insure proper restoration of highway surfaces and to cover payment for any damage to highways or State
property.Additionally,any expense incurred by the Minnesota Department of Transportation above the posted deposit will be assessed against the applicant.
In the event that the construction has not been started by the"WORK TO BE COMPLETED BY"date,this permit becomes null and void and deposit
refunded.

The applicant, or their contractor, shall notify Mr. Ed Barrett, Mn/DOT Roadway
Regulation Inspector, at 651-234-7912 at least 48 hours prior to starting construction so
State inspection may be arranged, and for approval of all highway materials prior to their
placement. All work authorized by this permit shall meet Mn/DOT specifications.
This permit authorizes the applicant to do drainage structure improvements in TH 36 right
of way at 64th Street and Pecan Ave in the city of Oak Park Heights as shown on
applicant's plan sheet(s).
Any lane closures shall be approved by this office at 651-234-7912, 24 hours prior to the
lane closure. The hours of the lane closure shall be determined by this office.
The applicant shall provide in-house inspection at all times while working on trunk
highway right of way.
The applicant shall furnish, install and maintain all required traffic control devices
according to the Minnesota Field Manual on Temporary Traffic Control Zone Layouts
(January 2004)(see web page @ www.dot.state.mn.us/trafficeng/), while performing the
construction authorized by this permit. Due to the Twin City rush hour restrictions, no
work involving interference with or causing a distraction to traffic will be allowed
from 6:00 AM to 9:00 AM, or from 3:00 PM to 6:00 PM. unless authorized by the
MN/DOT Permit Office at 651-234-7912.
If the temporary traffic control zone is to remain in one place for more than 3 days or
involves a detour, road closure or a situation where the typical layouts do not apply, the
applicant shall prepare a specific Traffic Control Plan for approval by Mn/DOT prior to
start of any construction.

All persons while performing authorized work on Mn/DOT Right of Way shall be required
to wear a Mn/DOT approved High Visibility Safety Vest and Soft Cap/Hard Hat. Any
authorized night work requires all personnel to wear a Mn/DOT approved full night safety
suit (pants and jacket).

It shall be the responsibility of the applicant to utilize the "Gopher State One Call"
excavation notice system as required under Minnesota Statute Chapter 216D, 48 hours
prior to performing any excavation (Phone 651-454-0002 Twin Cities Metro Area or Toll
Free 1-800-252-1166).
The Excavator shall mark proposed excavation with paint and flags or in lieu of flags
stakes may be used. All flags and stakes shall display the name and phone number of the
Excavator. All areas of proposed excavation shall be considered "practical" for the use of
white markings, pursuant to Minnesota State Statute 216D.05 (2).
The Excavator shall acquire a Positive Response confirmation from Mn/DOT for all
proposed excavations when the Gopher State One Call has indicated Mn/DOT utilities
may be affected. The Excavator may call Mn/DOT Electrical Services Section (ESS)
Dispatch Locating to confirm the status of Utility infrastructure owned by Mn/DOT.

The Excavator is required to comply with the provisions of Minnesota Statutes chapter
216D when performing Excavation as defined in Minnesota Statutes §216D.01
(subdivision 5), and will be responsible for damages to facilities in accordance with
Minnesota Statutes §216D.06.
No material shall be deposited on the traveled roadway.
All areas disturbed by the applicant shall be restored with a minimum of 6" of topsoil
(according to Mn/DOT Standard Specification 2105 Table 1 Topsoil Borrow), then
sodded or seeded. Seed or sod should be the same as/or compatible with the existing
turf cover. If the areas are to be seeded, a Mn/DOT seed mixture comparable to the
existing turf along with Type 1 Mulch and Disk Anchoring shall be used according to
Mn/DOT Specification 2575.
All areas disturbed during construction within State right-of-way shall be restored to
original or better condition.

The applicant shall perpetuate all existing drainage. The applicant shall relocate and
reconstruct the in-place drainage ditch along the highway as necessitated by the
construction authorized by this permit. The new ditch shall match the grades and contours
of the in-place drainage ditch.
The applicant is required to preserve all existing survey monuments. If Mn/DOT
determines that monuments have been disturbed or destroyed during construction activities,
the applicant shall accept full responsibility for all costs incurred in the re-establishment of
the monuments.
It is expressly understood that this permit is issued subject to the applicant's compliance
with the Rules and Regulations of the Minnesota Environmental Quality Board and any

Winter work shall be considered from November 1 through April 15, work during this
period shall be on a day-to-day basis at the discretion of the Roadway Regulation
Supervisor.
All work authorized by this permit and the restoration of the State's right of way shall be
satisfactorily completed by 8/1/10.
The applicant or his contractor shall notify the permit office at 651-234-7912 for final
inspection.

We have completed preliminary design work related to the 2010 Storm Sewer
Improvements project. While the initial design concepts have been prepared, final
recommendations will be dependent on comments from review agencies (Mn/DOT and
MnDNR), survey data, utility locations and televising results. Project construction
continues to be on schedule for May, 2010.
Communications with both Mn/DOT and MnDNR have been initiated. Each agency
may have concerns related to the improvements and may provide recommendations
for the design. Additionally, there is the potential for funding contributions from
Mn/DOT for the improvements.
The design survey will be completed following the snow melt. Costs associated with
surveying with snow cover are significantly higher than after the snow melt.
Utility locates will be completed after snow melt and prior to the field survey being
performed. Existing utility locations and potential conflicts could impact the selected
design alternative for each project.
Televising of the existing storm sewer pipe is required for the Swager Brothers 9th
Addition storm sewer. The existing clay sanitary sewer pipe (8"VCP) located in the
City easement(near the concrete drainage swale west of Lookout Trail)should be
televised prior to construction as well. This will aid in verifying pipe conditions and
manhole quality. City forces will perform this work after the spring thaw.
The bid award date and construction continues to be on schedule for May, 2010
following the release of road restrictions.
Design options reviewed to date, along with exhibits and photographs of the area are
included on the following pages for reference.

Design Options
Beaudet Storm Sewer Improvements:
• Option 1—Install manhole structures with storm sewer pipe to redirect storm
water flows and disperse the storm water energy(see Figure 1).
• Option 2—Install storm water concrete wall to redirect storm water flows.
• Option 3—Install grouted rip rap to disperse the storm water energy.
Lookout Trail —Concrete Drainage Swale Improvements:
• Option 1—Remove existing failing concrete swale, construct detention basin
(possibly rain garden w/overflow structure), install storm sewer pipe, and
construct overflow swale (see Figure 2).
• Option 2—Remove existing failing concrete swale, and construct new swale
(concrete or a more aesthetically pleasing alternative)within City easement.
Swager Brothers 9th Addition Storm Sewer Improvements:
• Option 1—Remove and replace storm sewer pipe and structures at
intersection of 53`d St. N. and O'Brien Ave. N., and unplug outlet pipe on
south side of City storm water detention pond (see Figure 3).
• Option 2—Spot repair failing grout at catch basins(no pipe or structure
removals), and unplug outlet pipe on south side of City storm water detention
pond.
• Option 3—Resolution with DNR(owns wetland located to the south of the
City storm water detention pond)to resolve the storm water back-up into the
intersection from the City pond.

Funding for this project is anticipated to be allocated from the City's Storm Sewer Fund, which maintains a fund
balance of over$200,000. Additionally, the City maintains$118,000 in the Storm Sewer Renewal&
Replacement Fund.
These available amounts have been contributed to from the monthly charges on water bills and/or allocations
from the City's General Fund and are generally intended for these types of repairs.
Staff is seeking permission from the City Council to authorize the City Engineer to prepare bids and
specifications to solicit bids for the repairs of these facilities in the summer of 2010.

9th Addition Storm Sewer Repair
Project Backaround
A storm water drainage issues has been identified near the intersection of 53`d Street N and O'Brien
Ave N. The apparent problem is an elevation difference between the storm sewer inlet to a drainage
pond and a culvert exiting the pond is not significant. The storm sewer line holds water which erodes
the grout and in winter freezes and thaws, potentially breaking or separating the pipe. Further
investigation is needed to expose the exact failure location(s); however the effects of a failure are
apparent at eroding catch basins on the east and west side of O'Brien Ave N as well as undermining of
53rd Street N. Repairing/ replacing the storm sewer and catch basins will prevent the street from
undermining.
Project Overview •
Simply replacing the storm sewer and catch basins may alleviate erosion and undermining for a short
period; however a solution to prevent water storage in the storm sewer line should be the ultimate
goal. If preventing water storage in the storm sewer line is not feasible the pipe and catch basins
should be lined with a water tight substance to, at a minimum help prevent erosion of grout and
subsequently erosion around catch basins and undermining of the street. The estimated construction
cost of this project is based on replacing the existing roughly 50'of 15"pipe, 40'of 30"pipe, and 90'of
36"pipe as well as two catch basins.
Local residents will be impacted by the construction at the intersection of 53rd and O'Brien Ave N;
however access to each home will not be affected.

Drainage Swale Correction — 62nd Street N to Lookout Trail
Project Background
Staff was notified of washouts occurring at 6242 Lookout Trail alongside a roughly 160'above ground
concrete drainage swale. The swale directs area storm water flow from 62nd Street N to an existing
culvert/catch basin just west of Lookout Trail. The concrete swale is broken in several sections and
undermining of the rock base is evident. An existing 30"storm sewer line exists near the termination
of the existing swale.
Project Overview
This project would install two catch basins and roughly 200'of underground storm sewer to replace the
• above ground concrete swale. The new storm sewer would tie into the existing 30"line which
terminates in a wooded area between Peabody Ave and Hwy 36.
The impact to the general public would be minimal as most work would occur on an easement between
private properties. The estimated construction costs include engineering, excavation, adding storm
infrastructure and repair of private property.

Storm Basin Correction on Lookout Trail
Project Background
Erosion is occurring at an inlet culvert and inside of an OPH storm basin along Lookout Trail. The
erosion around the inlet culvert is causing undermining of lookout Trail and the basin. This problem
has caused washouts on Lookout Trail; and will only become more severe.
Project Overview
To prevent further erosion around the inlet culvert, the existing rip rap would be replaced with grouted
rip rap.This would provide a more secure base and deter erosion.

Enclosed is a proposed Capital Improvement Plan which does reflect the comments
received at the various budget meetings as well as the final adopted 2010 Budget.
This document was more difficult to craft in a timely fashion due to late dates in receiving
budgetary information from the State and Washington County.
As in previous years, this document is not unilaterally binding on the City but does set •
forth some spending priorities for the foreseeable future. It is a planning fool and not a
direct authorization to proceed with a given project. ::•
