called to order at 7:00 p.m. by Mayor Beaodet, Present: Co ncilmembers
Abrahamson, Doerr, McComber and Swenson. Staff present: Administrator
Johnson, City Attorney Vierling and Finance Director 11olst. Absent: City
Engineer Postler and City Planner Richards.
Mayor I eaudet added "Mill and overlay of Brekke Park and Other loads "' as
New Business Item C. Co ncilmember McComber, seconded by Council ember
Doerr, moved to approve the Agenda. Carried 5 -0.
Department/Council Liaison Repoi-ts:
A. Plan nim Commission: Coun Abrahamson reported that the next
meeting of the Planning Commission is on Thursday, December 11. He
reported that interviews for a commissioner vacancy will commence at
5 ;3o P, in, and th e re uIar mee ng wiII commence at 7:00 p.m .
B. Parks s Commission: Councilmernber McComber reported that the next
meeting � of the Parks Commission is on December 15 with interviews for
commissioner vacancies at :30 p.m. and the regular meeting at 6.30 p.m.
C. Gable Commission: Councilmember Doerr reported that the next meetin
of the Cable Commission is on December 17 at 7:00 p.m. at the Access
Center. He reminded residents off: Breakfast with Santa at the Valley
Ridge Mall on Decen 13.
D. Water Manwze ent Or ani ations l fiddle - St. Croix: Mayor c a det
reported that the next meeting of the Middle St. Croix Water Management

Organization is on January 8 at 7:00 p.m. at the Washington Conservation
District office.

Wednesday, December 1 there will be a Senate fax Haring at th
Capitol regarding LGA and Market Value Homestead Credit payments to
cities, and all elected officials are encouraged to attend. She stated they
w ill also be meeting with th House Tax Committee and the Property T ax
Division at l -00 p.m. at the State Office Building,
Council ember Swenson requested the Cit Administrator pass on a
thank you to Chief De osier for the excellent job the department did at the
Stillwater Area High School during an incident earlier in the day. He said

the children felt safe and the police department had everything under the
control.
111. Visitors/Public Comment:
Jennifer Severson of the rea er Stillwater Chamber of Commerce provided an
update on the Chamber Board Strategic Plan and upcoming projects.
Administrative Secretary Pinsl i reported that Lori and Hamilton Girard were
chosen as the recycling award winners.

Councilmember Swenson seconded by Cou ncilmen - i er McComben, moved to
approve the Consent agenda. Roll call vote taken. Curried -o.
V. Public Hem-in

Vt. old Business:
A. City Hall Facility — Continued P roject Advancement: Randy Engel of
uetow and Associates reviewed two potential geothermal options for the
new City Hall facility: geothermal wells or tapping into the City water
system. Ile stated that test wells are imperative if the City decides to ;
with geothermal wells.
Mayor Beaudet moved that the new building be geothermal. Motion
failed per lack of a second.
C:ounc ilmemb r Swenson reported that other communities are movin
forward with geothermal energy without obtaining input from the
Department of Health. He stated that if the city cannot tap into the water
system, then it should go with a conventional beati . cooling system.
Co ncilmemb r Doerr stated he was concerned about the possibility that
the Department of Health health would require that the city water supply be
chlorinated. City Administrator Johnson noted that it is a. possibility that
there may be mandates on Cho emissio s in the future.

Councilmember Swenson, seconded by Mayor Beaudet, moved to go with
the lowest bid from Ber erson Caswell for a bid of $14,420 to drill the
two wells to see if it is economically feasible for the City to go with
g eothermal and also proceed with going with a standard system. Mayor
Beaudet clarified the motion to revisit the issue in two weeks, and for the
engineer to prepare a payback estimate or the 50-year life of building.
Motjon carried -1, Cou el Imember McCom ber opposed.
Architect Randy Engel presented exterior color options to the council.
Councilmember McComber requested that samples of the roof and brick
colors be shown to the City fall Design Committee.
Mayor Beaudet, seconded by Councilmember McComber, moved to send
the xterior color options back to the design committee and they will make

a recommendation to council. Carried 5 -0.
Architect Randy Engel sought approval to move into the construction
documents phase. Ile provided the City Administrator with design
development documents.
Councilmember Abrahamson, seconded by Councilmember Doerr, moved
to approve the design development docun - ie its. Carried 5 -0.
Councilmember Swenson, seconded by Mayor Beaudet, moved to mo ve
into the construction documents phase. Carried 5 -0.
V11. New Bushl s:
A. Resolution Api)rovim the 2009 Budget: Finance Director Holst reported
that the proposed 2009 budget is $4,151,170. She reported there is a
$29,905 deficit and p rovided a. memo with a summary of proposed budget
cuts from staff.
Mayor Beaudet, seconded by Councilmember Doerr, moved to approve
the Resolution for the 2009 budget.
Councilmember Abrahamson, seconded by Councilmember Swenson,
moved to amend to make all suggested cuts in the memo from Judy Holst
and to leave in the chamber membership. Carried -o -1, Councilmember
McComber abstained.
Mayor Beaudet, seconded by Councilmen - ibex; Abrahamson, moved to
amend to clarify that by deleting the $11,500 from Mayo and Council

Conference at the City's expense. Carried 3-1 - 1, Co ncxlmember
Swenson opposed and Councilmember McC;omber abstained.
On main motion, roll call vote taken. Carried 5-0.
Councilmember McCon - t er stated that she would have to seed in four
letters of resignation because she is on the Board of Directors for Women
in Government, the Transportation Steering Committee, the City Futures
for Economic and regional Development and the Small Cities Council.
Mayor Be udet questioned whether she could appear on the phone for
those meetings. Councifi ember McComber responded that she cannot.
C:ouncilmember McCom er, seconded by Mayor f eaudet, moved for
Counell em er McComber to seed in the letters of resignation. Carried
5 -0.

Capital Improvement flan: Mayor Beaudet, seconded by Co nciln -.em er
Abrahamson, moved to approve the Resolution approv ing the 2009 tax
levy and anticipated Capital Improvement Plan with the levy to be
amended as indicates now in the budget. doll call vote. Carried -0.
Finance Director Holst requested clarification, She stated that the
difference in the budget is $109,075 and requested whether they wished to
drop the levy by that am owit. Mayor Be udet clarified that they want to
drop the levy but have a balanced budget.
C. Mill and overlay of Brekke Park and Other R oads: Mayor Bea det,
seconded by Cou ncilmember Abrahamson, moved to direct staff to come
back with a Mill and overlay Plan foci f rel l e 'ark and other streets and
provide a timeline when the City can go to bid and when the bids will be
back. Carried -o,

Police and Sheriffs. The conference is funded by the federal government. I would be attending in

The conf rence explores the issues related to missing and exploited children cases focusing on
effective p investigative practices, technical assistance, available resources, media issues,
victim impacts, and planning.
The Center has taken care of the fights, round transportation, hotel, and 2 meals a day. `I'hese are
lined directly to the Center. 'ne city is providing my time, and parking fees associated with the

A t the November ber 2 5 if, City Council meeting, the City Council directed that staff prepare a
draft ordinance that proud address a possible concern from the Dept of Health DOH
relating to the private use of the City Water Utility System for heating and cooling purposes.
The DOH concern being subsequent unregulated or inappropriate use of such systems without
proper management and/or oversight.
If the City had a future applicant that desired to utilize the public utility, a Conditional Use
Permit would first be required, but which would be above and beyond the minimum
requirements of being with the 1,000' radius of supply wells., being served by more than one
w ater main of not less than 8 inches diameter and ensuring that there are no thermal
impacts of > .5 degrees F#

Use of domestic aster for heafing and cooling shall only be considered by the
City within areas served by multiple water rains of not less' than diameter
with adequate and redundant flog and min a 1 ,000 foot radius of operating
domestic supply galls.
Such use shall be configured to buffer and displace all thermal impacts (DELT
T ) (must be < 2 .0 degrees F as approved by the City Engineer ) within
and between the piping and prior to any return of domestic rater to the public
distribution system. Implementation of such use of domestic rater will also
require payment to the city of an annual Thermal Charge equal to % of the
energy savings achieved that shall be used to offset other city utility costs
associated with monitoring various private systems that have eyed to Implement
the use of domestic rater for hsrng and cooling but shall be not less than
$1 ,000.00 per year.

request and secure the approval of the City Council via Conditional Use Permit,

WHEREAS, S, the City of Oak . Park Heights has finalized the draft of the
Comprehensive Plan 2008; and after having conducted a public hearing relative thereto, the
Planning Commission of Oak Park Heights recommended that the Comprehensive Plan 2008 be
approved. #I'he City Council of the City of Oak . Par Heights makes the following findings of
fact and resolution;
. The Planning Commission n Comprehensive Flan Subcommittee, appointed
by the City Council, completed the draft of the Comprehensive Plan 2008 in February of 2008
and recommended its approval; and
2. The Planning Commission Comprehensive Plan Subcommittee held an
open house on February 21, 2008 to discuss the Comprehensive Plan 2008 with the residents of
Oak Park Heights and interested pasties; and
3 The Planning Commission held a public hearing at their April 10, 2008
meeting, took comments from the public, closed the public hearing, and recommended that the
Comprehensive P an 2008 be forwarded to the adjoining j uri sdietions, affected agencies, and the
Metropolitan Council for review; and
4. The City Council, at their April 22, 2008 meeting, adopted the
rccommendation of the Planning Commission and authorized the Comprehensive Plan 2008 to
be forwarded to adjoining J* urisdicti ons, affected agencies, and the Metropolitan Co nei I for
review; and
Written comments on the Comprehensive Plan were received from
Baytown Township, Metropolitan Council, Valley Branch 'watershed District, and Washington
County; and
6. The Planning Commission held a second public hearing at their December
1 I , 2 00 8 meeting, reviewed the comments of the adjoining j uri sdietio s, affected agencies, and
the Metropolitan Council, as well as the final revisions made to the Comprehensive ve Plan 2008,
took comments f prom the p blie, and recommended that the Comprehensive Plan 2008 be
approved su ject to review and approval of the Metropolitan Council.

city does not have an ordinance specifically ically aut orizin the police department to run non- criminal
investigative criminal history reports. 'niese are routinely done for the various licenses the city issues,
employment investigations, and peddler solicitor perillits.
Since the time of the it we have been rcquired to set up a financial account with the MN BCC. for
each background check. The city is assessed a $ 1 5.00 fee per check. 'The crin - final history report is
also delayed with further cxpense due to the police department having to quail. it with a return envelope,
and wait for the response.
'The ordinance will give the city proper authority to perform the records search by ordering the oaf
Park Heights Police Dept. to be the authorized agent, This is essentially an ordinance allowing us to
o what was done for years in the past without the ordinance.
The ordinance was obtained from the League of MN Cities as a model ordinance. The appropriate
modifications and additions were made to apply to the City of Oak Park Heights,

Background/Justification:
am requesting the urchase of a replacement vehicle and equipment to be used as the School
Resource Investigator vehicle as well as a traffic enforcement vehicle. The c urrent v ehicle is a 19

Chevy Blazer with 82,000 miles and is reaching a point in age w here we begin experiencing frequent
repairs and malfunctions.
I have bud geted in capital outlay for a 2009 replacement vehicle. The replacement would serve as a
multipurpose vehicle. The SRO world u the vehicle for that duty, the would also be used for
traf Ic enforcement as part of our various grant programs we participate ire, and the vehicle could also
be used periodically as needed when other vehicles are down for repairs. This is an expected extended
I 1fe usage vehicle of up to 1 0 years.
The vehicle proposed is a 2009 Ford Crown Victoria Police Interceptor. `Fhe vehicle is bid spec
vehicle under the State of MN b i d program. This would be an unmarked fully operational police
vehicle. I am proposing funding for the vehicle, set up and lighting package, and the computer are
pu rchased using the capital outlay funding already in place, D 6 K I D. a e S

the criteria for funding from that source.

The vehicle set up and lighting package is proposed to be provided and installed by our current
installer for the rest of our fleet. This is a specialized process. This vendor has shown by past
experience with them to be reliable, proficient, a competitively priced. This vendor is KEEPERS of St
Paul, MCI.
'ne vehicle speed radar unit selected is by Stalker. 'rhe y have provided a competitive bid under the
State of MN bid process. I have selected them as the low bid for the options provided against other
manufactures. They are a proven manufacturer and we currently have one of their units in a vehicle.
The computer provides us with our access to the C — Computer Aided Dispatching system. This
provides the officer with access to driving records and vehicle information, our police reports, GK'S
location of the squad car, ticket and forms printing, along with other administrative functions with
dispatch and other units.
This is a single unit that is easily removed for security when not in service for traffic en or ement or
other duties that would require it. The computer is the model and manufacture bid under the
Washington County bids for the CAD system acid has been ruggedized for this application. The
system includes peripherals; Drivers License slide, ticket and forms printer, GK'S, and stand for the
printer. WC IT did not give nee a hard copy quote for the peripheral items, but did give it to me via
phone.
The video s rstein is one that was selected from the 2 competitive bidders I received information back
from. l received a demonstration of this system and feel for our size department, and our vehicles, it
would be the best fit. The system is a digital DVD s backed up by internal lard drive; allowin
us to easily provide copies of information to our prosecutors, as well as recovery of video from the
internal hard drive that was not recorded as a prompted event. The system will auton record
events from the activation of emergency lights, or manually r b the officer. The system can be set :o
record from 3 0 se ion s up to 10 minutes of vidco that was recorde d b y the Internal har d dri ve prior to
the automatic or manual activation. The s software is up tradable in the future and upgrades are
provided by the manufacturer. The s is a single unit allowing for easier installation. There is no
current state bid for the digital in car video systems that record in this manner that I was able to find.
We have budgeted in capital outlay for proposed additional units to be installed in our other squad
cars ID 201 o. The city prosecutor has expressed their desire for us to install video systems, and law
enforcement around the country has seen the advantages from these units. They provide for reduction
in civil liability, increased evidence for convictions in traffic and non-traffic related incidents, as well
as administrative use within the department for training or otber needs. The additional amount
included in the system is the data tracking software to allow us to log the video events for late; recall
