C. Approval of the parkin area setback variance subject to the following
findin
1. The proposed parkin area setback represents the continuance of
an existin condition.
2. The Central Business District promotes an urban environment and
encoura joint use of parkin and drivewa facilities.
3. The applicant has a joint parkin a with the adjacent
Ea Club re open access between properties.
4. The Cit approves the submitted site and buildin plans.

3. SC Mall LLC: To consider re for planned unit development amendment
and site plan review for landscapin and exterior improvements to buildin
facade at 5909 Omaha Ave. N.
Cit Planner Richards provided an overview of the applicants re and of his
report re the same.
Vice Chair Dw opened the hearin for public comment.
Vice Chair Dw in as to handicap accessible parkin accommodations,
to which Marc Partrid Project Architect responded.
Commissioner Runk, seconded b Commissioner Powell moved to close the
public hearin Carried 4-0.
Commissioner Powell, seconded b Commissioner Runk moved to recommend
approval, subject to the followin conditions:
1. Submit photometric for proposed parkin lot li in compliance with
Oak Park Hei Code subject to cit staff review and approval.
2. Submit li fixture specifications 'in compliance with Oak Park
Hei Code subject to cit staff review and approval.
3. Submit documentation indicatin that all proposed li fixtures meet
the performance standards set forth in Section 401.15.B.71 of the Oak
Park Hei Code.
4. Submit specifications for exterior buildin finish subject to Cit Council
review and approval.
5. Submit documentation indicatin that all proposed landscapin meet the
re of section 401.15.E. of the Oak Park Hei Code.

6. Placement of all fire hydrants and fire connections must be approved by
the City Fire Marshall.
7. Grading and drainage issues are subject to review and approval of the
City Engineer and review of the applicable watershed authority if
required.
8. Any changes to existing utilities or construction over existing utility
service lines is subject to the review and approved of the City Engineer.
9. The project architect shall work with city staff in repositioning the
disability accessible stalls closer to the building entrance.

4. Renton Homes To consider a request for planned unit development. concept
-plan, general plan and site plan review for 9 unit housing development at,.:::.

City Planner Richards provided a summary of the applicant's request and
reviewed his report regarding the same. Community Development Director
Danielson ard.,Richards discussed the process of development applications and
noted that the applicants earlier application had been withdrawn prior to its
approval or denial thus the new application as modified is permissible.
Additionally, they noted.. that MnDOT access and stormw' ater permits are needed
for the project and suggested the Commission consider continuing the public
hearing to October to allover time for the permits to be received by the applicant.
Vice Chair Dwyer opened the hewing for public comment.
Mitch Johnson representing Renton Homes informed the Commission that with
this plan, the units are downsized from those originally proposed and that fire
suppression and alternate access 1 1 s provided: for. He stated that they feel the
parcel supports the proposed 9 units.
Pat Estes 5770 Oak green Ave. expressed his concern about the traffic on
oakgreen Ave. and that he' did not feel that the stop signs are effective.
Barbara Anderson of.- Pondview Condominiums expressed concerns regarding
snow removal, lot lines and setback requirements, parking concerns and impact
upon 59th St.
Commissioner Lilj egren, seconded by Vice Chair Dwyer, moved to continue the
public hearing to October. Carried 4--0.
Commission discussion ensued as to potential development of additional
housing North of Oakgreen in relation to the request.
Vice Chair Dwyer called for a 5- minute recess, after which the regular meeting
, ` continued.
