I am a licensed Land Surveyor, Minnesota License No. 43933. On July 18, 2006 a field crew employed by Westwood Professional Services, Inc. collected spot elevation data on the rough graded building pad. The finished floor elevation per the Site Plan, prepared by Ozark Civil Engineering, shows a proposed building elevation of 955.00 feet. Yesterday we found that on average the elevation of the rough graded building pad is 954.25. This corresponds to the building plans that call for an additional four inches of rock and a five inch concrete slab to get to the finished floor elevation of 955.00. Prior to granting approval of the building permit, Skanska will submit to the City of Oak Park Heights a letter from a licensed surveyor certifying that the building pad is rough graded to the proper elevation. This rough grade elevation will be minus .75' from finish floor elevation(4"stone base+5"concrete). Further grading work will be taking place over the next few weeks to bring the parking lot area to the final grade. Along with this letter we have provided a marked up plan that shows the areas still to be graded. Utility work will not proceed until the final rough grade is completed in these areas. It is our current anticipated schedule to survey the building pad rough grade on 7/18/06 and submit the letter of elevation certification by 7/19/06. Gentlemen: Last fall,the City advised you that there is damage to the curbing and aprons as installed on Nova Scotia and Norwich Ave.and that the City will not be accepting such damaged infrastructure and will require it to be replaced.As follows is a final determination and allocation of such costs. Nova Scotia Ave: It has been determined that approximately 740 linear feet,or 22 percent of the total concrete curb has been damaged. In addition to this curbing damage,all six of the commercial concrete driveway aprons have sustained some degree of damage requiring replacement.All damaged areas have been identified and marked in the field. Please note that there is an area of the southwestern most driveway apron on Nova Scotia that was damaged from the installation of electric conduit by LPD Electric that the City will address. Norwich Avenue North: It has been determined that approximately 150 lineal feet,of the concrete curb has been damaged. Some damage has also occurred on each of the three concrete commercial driveway aprons.All damage to the curb and driveway aprons was due to construction damages and must be removed and replaced,shall be considered project construction costs,(developer costs(CSM)). The difference in total linear feet from last year to the current amounts is a result from additional damage incurred throughout the winter months,most likely snowplowing.Norwich Avenue North has 44' of additional damaged curb,and now has approximately 150'total damages.Nova Scotia previously had 567' of damaged curb,and now has approximately 740'.Burschville has not been on the site since the fmal inspection on 12/9/06. In Summary: • Approximately 890' of concrete curb is damaged and requires replacement. • Burschville shall be responsible for 298' (33%). • The Developer shall be responsible for 592'(67%). s • The Developer will be responsible for damaged aprons(except one as above). At this point the City will be securing a cost estimate for these repairs and will allocate these expenses per the above per -ntages when those costs are determined. If the City anticipates that these items will be completed by May 1st, then Burschville could start by June 15th 2006. As discussed with John, if your contractor can't meet this anticipated start date, or if the contractor anticipates additional costs, then we should discuss re-bidding the work. Respectfully, we had provided the final DA sometime ago, but there have been constant changes requests from your end. Additionally, we have not yet seen the final plat nor have we been provided the securities. Technically speaking, the April 19th is a shadow date, the more correct date is April 23rd for the DA and other items as I anticipated some issues to creep up So the City stands ready to provide the final DA, which I now understand you have agreed to, review and hopefully finalize the plat, transfer the property with your payments and accept your securities per the DA. Lastly, we have consistently indicated that a demo permit can be issued for the area, but to date no one has come to pull such permit nor clarified if the wells and septic have been abandoned.
