HomeMy WebLinkAbout2002-04-11 PC Recommending ResolutionWHEREAS, the City of Oak Park Heights has received a request from SC Mali, LLC for a planned unit development amendment to allow building and site improvements at the St. Croix Mali; and after having conducted a public hearing relative thereto, the Planning Commission of Oak Park Heights makes the following findings of fact: follows, to wit: and and A RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY SC MALL, LLC FOR A PLANNED UNIT DEVELOPMENT AMENDMENT TO ALLOW BUILDING AND SITE IMPROVEMENTS AT THE ST. CROIX MALL SHOULD BE APPROVED WITH CONDITIONS 1. The real property affected by said application is legally described as SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B 3 . The subject site is zoned B -2, General Business in which the Mali and its retail and office uses are a permitted use; and 4. Revisions to the exterior of the Mali building and site including the following are require an amended planned unit development: A. 4,385 square foot enclosed computer deployment /receiving area B. Exterior seating area for proposed interior employee cafeteria C. Exterior courtyard D. Partial covered parking and walkway canopy E. New entry and maintenance area canopies F. Entry signage at relocated facility entry G. Demolition of existing retail exterior entry pavilions; and request; and 5. The City staff prepared a memorandum dated April 4, 2002 reviewing the 6. The memorandum dated April 4, 2002 recommended that the request be approved with conditions; and 7. The Planning Commission held a public hearing at their April 11, 2002 meeting, took comments from the applicants and public, closed the public hearing, and made the following recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted by SC Mali, LLC for a planned unit development amendment to allow building and site improvements at the St. Croix Mali and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby recommended to the City Council of the City of Oak Park Heights for approval subject to the following conditions: 1. The portion of the receiving area canopy within the Xcel Energy easement is subject to review and approval by xcel Energy. 2. All mall building wall light fixtures must be retrofitted to be full cutoff. 3. Grading and drainage issues are subject to review and approval of the City Engineer and review of the applicable watershed authority if required. 4. Any changes to existing utilities or construction over existing utility service lines is subject to review and approval of the City Engineer.
