Do to accessiblity issues with the individual located at the end unit we are proposing a 2' high retaining wall to allow access around the end of the 5-unit building at McKean Square. Silt fencing exists and will be maintained or reinstalled to assure protection of the wetland. The wall will be constructed of boulders. Please review and call with any questions. Wetland E is located in the east side of the property as shown in Figure 3. Dominant vegetation includes river bulrush, reed canary grass and common buckthorn. The NWI (Figure 4) classifies the basin as seasonally flooded palustrine persistent emergent(PEM1C)which equates to Type 3 inland shallow fresh marsh in the Circular 39 system. Soils in Wetland E were examined along a transect in the south side of the basin at flag E-1. Soils were found to be dark grayish brown silt loam with dark yellowish brown mottles over very dark grayish brown silt loam with dark yellowish brown mottles. Depth of surface water was found to be approximately 8 inches with free water within 3 inches of the surface in the wetland soil pit. Upland soils consist of brown fine sandy loam. The Washington County Soil Survey shows the area to be Auburndale silt loam (fine-silty mixed, Typic Glossaqualfs) (Figure 5). Wetland F Wetland F is a depressional basin with fairly steep wooded slopes on all sides. Wetland F is located in the northeast corner of the property as shown in Figure 3. Dominant vegetation in Wetland F includes reed canary grass, common buckthorn and lesser duckweed (Lemna minor). The NWI (Figure 4) shows the basin as intermittently exposed unconsolidated bottom palustrine (PUBG). This equates to Type 5 open water under the Circular 39 system. Soils in Wetland F were examined along a transect on the basin's north side at flag F-1. Soils were found to be very dark brown fine sandy loam over very dark gray fine sandy loam with cobble. Depth of surface water was estimated at 3D inches with free water within 6 inches of the surface in the wetland soil pit. Upland soils consist of very dark gray fine sandy loam over very dark grayish fine sandy loam with cobble. The Washington County Soil Survey shows the soil to be Freer silt loam (fine-loamy mixed, Aeric Ochraqualfs) (Figure 5). Wetland G Wetland G is a small depressional basin located in the north central part of the property as shown in Figure 3. Dominant vegetation in Wetland G includes reed canary grass, currant (Ribes spp.), common buckthorn and lesser duckweed. The NWI (Figure 4) does not map the basin. Soils in Wetland G were examined along a transect in the northeast side of the basin at flag G-11. The soils were found to be black sandy loam over very dark brown loamy sand. Depth of surface water was estimated to be 24 inches with free water within 8 inches of the surface in the wetland soil pit. Upland soils were found to be very dark grayish brown fine sandy loam over dark grayish brown fine sandy loam. The Washington County Soil Survey shows the soil to be Kingsley sandy loam on 6 to 12 percent slopes (coarse-loamy mixed, Mo!lic Hapludalfs) (Figure 5). The DNR Protected Waters map shows no protected waters on the site (Figure 6). Additional information regarding each wetland's vegetation, soils and hydrology characteristics is included in the wetland delineation data forms in Appendix A. Ground photos of each wetland are included in Figures 7-10. The email was in regards to questions arising from an invoice of$53,294 to Presbyterian Homes for work performed by Burschville Construction. The invoice included the payment for all of the work completed by Burschville Construction to date. The last request for payment was submitted in order to finalize the project to this date, although additional work including the construction of sidewalks and pedestrian ramps remains to be completed. As indicated on the 9th Request for Payment dated March 2, 2005, the revised contract amount is $1,124,821.60. The value completed to date and recently agreed upon with the contractor is $1,092,350.84. The actual amount paid to the contractor is $1,037,733.30, which includes the most current payment of$53,294.65. The contractor is still owed the 5% retainage ($54,617.54) and an estimated $20,000 for the construction of the remaining sidewalk and pedestrian ramps. This remaining work will be completed in May of 2005. It is also anticipated there will be an estimated $6,000 for construction administration, engineering and testing costs to complete this project, separate from the construction contract amount. During the construction process, some quantities are calculated by the process of estimation. After obtaining tickets,taking field measurements, and with the use of other documentation, quantities can be finalized and agreed upon by the Contractor and the Engineer. It is always the intention of Bonestroo to pay the Contractor in full as soon as all documentation is obtained in order to quantify each bid item. In some circumstances, it may take several months before quantities may be agreed upon and before the contractor submits the correct documentation. In the past three months, Burschville and Bonestroo have been working together to resolve remaining issues with the bid items at McKean Square. These issues included extras and invoicing from Burschville Construction. Burschville was given direction to perform the additional work from the City and Bonestroo. All extras were necessary and required in order to complete and have a successful project. Some examples of the additional work included items such as listed below. • Repair of hydrant gate valves that had been damaged during small utility installation. • Additional street sweeping due to building contractors dropping excess material onto the road prior to wear paving. • St. Paul, St. Cloud, Rochester, Willmar, MN • Milwaukee, WI • Chicago, IL Affirmative Action/Equal Opportunity Employer and Employee Owned t. • Delivery and installation of a new sanitary sewer manhole casting on sanitary manhole #2 that was lost by the building contractor or the grading contractor. • Removal of blacktop and curb in failure areas due to building construction, and patched the entire area with new bituminous. Outstanding bid items, extras, and invoices were paid in full when an agreement between Burschville Construction and Bonestroo was recently obtained. However,prior to any final acceptance the City would need a final verification from its engineer that all elements are complete and in an acceptable condition.Accordingly,there appear to be remaining issues, although small,that will not be able to be addressed until this spring-including remaining storm sewer cleaning,final sidewalk construction and some street paving issues.Once complete the City will then contemplate a formal acceptance. In the interim however,the City will accept the typical snowplowing responsibilities at this time for the Streets Only,namely Nolan Parkway and Nolan Lane—but does not include sidewalks,driveways or other private streets.This responsibility will be assumed by the City at 12:01 a.m.on January 15th,2005. Effectively any snowplowing efforts incurred by Raleigh Trucking will be billed to the City as of that date and under the terms as stipulated in our contract with them. It is important to note that there are remaining issues with the final asphalt lift that still need to be corrected and which could be damaged during the plowing season.The City will not be responsible to repair this damage.This potential damage,as well as any other damage that may have already occurred due to plowing or due to other reasons will have to be assessed and corrected prior to the City accepting the roadway. We believe that there is an acceptable third option for resolving this issue, which takes into account the reality of the design and construction process. When these streets and utilities were designed and bid, it was anticipated that up to ten percent of the curb would be damaged, and need to be replaced. A price for that replacement was included in the bid documents. We would assume that this percentage is based on the experience of professional engineers. No criteria was stated or provided which would dictate which curbs would need to be replaced. Now almost a year later, an extremely severe criterion, which was developed in a different city, is presented and applied to this project. We are building in Oak Park Heights and will comply with the expectations as stated at the time of bidding. Damage was done by snowplows and I observed damage by the Burschville crews repairing the street sections this week. It is not reasonable to require VSSA to pay for a complete second curb, at a cost two and one half times the original cost,when the responsibility for the damage is widespread. We are presently observing chipping to curbs that have cured for many months, from car traffic as well as equipment traffic. I raise the question of the type and quality of the concrete used for the curbs. We have requested copies of the cylinder test results but have not received them. We have also proposed that a core sample be taken to determine the strength of the concrete. Implementation of Method 2, replacing of 8,000 lineal feet of curb would, at this time, pose an intolerable hardship on this project and the current residents. I would envision that all construction would be forced to stop for a period exceeding one week. This would delay the completion of homes. Our future residents have sold homes and planned their moves based on the completion dates that we have provided. Many of our existing residents are now unable to use their driveways and garages since the sidewalks have been poured. The demolition of curbs and asphalt,pouring new curbs and aprons will make their homes virtually inaccessible for extended weeks of time. We propose that we stay with the plan anticipated in the bid documents. Identify the most damaged sections of curb which we all agree need to be replaced. This would be in the vicinity of ten percent. Utilize the best possible patching products to deal with other areas of damage. The most consistent type of damage is small chips along the front edge of the curb. Based on observation of the excellent routine maintenance of streets in Oak Park Heights, with the application of a chip seal these chipped edges are filled and sealed periodically. We suggest that the streets could receive an application of chip seal, perhaps next year as a means of protecting the concrete edge. Considering the fact that VSSA will continue to be the owner of the property adjacent to all dedicated streets, we realize that the cost of repair of any failure of the curbs will be assessed to our organization. We are willing to accept the possibility that there may be repair costs at an earlier date than if the curbs were in perfect condition. There are numerous reasons that we do not support the replacement of all curbs, each of them substantial in its own right. That damage has been due to building construction activity. Dave Hanson did make a thorough site evaluation of the concrete curb on Friday,July 23, 2004. As we looked at the concrete curb damage in the field, he did tell everyone that the pink dot on the pavement at the center of the panel is a panel of curb that is not acceptable to the City. All curb that is not painted with the pink dot is acceptable. I did review the status of the evaluation and that approximately 66% of the curb is damaged. There was quite a bit of discussion throughout the meeting from all parties involved with the meeting describing how and who could have damaged the curb. Specifically, Ken Hooge mentioned that prior to coming to the meeting he did actually see the bituminous driveway contractor damaging curb. Dennis Postler also noticed there was some recent curb damage after Friday. The curb continues to be damaged. Ken mentioned that he was concerned about what the cost would be to replace this. Eric Johnson mentioned that he should probably try to collect some of the cost for the repair of the concrete curb from the contractors that are working for him. Eric asked if they have any retainer of the subcontractors, potentially to use that retainer to help pay for the replacement of the damaged curb. It appears that VSSA's contract for all the single-family and multiple family town home construction is with Krongard Construction, and that all/most sub-contractors are Krongard's. Quite a bit of discussion was held regarding what methods could be used to remove and replace the curb. The discussion was really two methods. One was to remove all damaged curb & gutter panel by panel and hand place the concrete curb and patch out in front of the street and behind the curb. The contract with Burschville Construction does include 10% curb patching. Also note that there is about 8,500 feet of curb on the project. 10% of that would be 850 feet anticipated to be damaged. The second method would be to remove all curb & gutter and mill and grind up 2 feet of the existing bituminous from the front edge of the bituminous out towards centerlii}e, and then to physically remove the concrete curb to grade and compact that gravel area and the existing bituminous would be mixed in with the gravel base. The contractor would grade.and compact that. The concrete curb would then be placed and then the street, the two-foot bituminous patch, would have to be placed in front of the new concrete curb before the wear course is placed. There was discussion about the sprinkler systems that are right behind the curb that would be an issue. The subcontractor would have to deal with the sprinkler system and the sprinkler heads. There was discussion regarding the driveways and that there would have to be patching of the driveways. Specifically there would be patching of bituminous driveways, or driveways on the opposite side of the street of the sidewalk. As part of the project, there is a concrete apron between the concrete sidewalk and the concrete curb. Those would be done at the time the curb & gutter was replaced. Eric Johnson mentioned to the developer that the cost to do this replacement would be 100% the developers. Further comment by Eric, was that long term for the City, this curb damage is not something the City could accept because the curb would have to be prematurely replaced down the road. There would have to be a special assessment against the property, and at that time the cost would be significantly greater. At this time, the developer still has his contractor's on site who have caused the damage and will be able to recover his costs much more easily. Next item involved trying to get costs for this work. Bonestroo is going to meet with the contractor, Burschville, and get two different costs for the two different methods for replacement. We will get a cost from the developer for the removal and replacement in what I consider a patch job. Remove and replace segments of curb. The second cost we will get from them is to remove and replace 100% of the curb. Both Dennis and I expressed our opinion that the cost for removing 100% of the curb would be more feasible and probably is the preference of the City's vs. having 60-70% of the curb being hand placed and patched. We told the City and developer we should be able to get those costs within a week. Next item: The coordination of the placement of the sidewalk. It was scheduled to start Monday or Wednesday of this week. However that schedule has been held back due to this issue and this meeting. We further discussed that we'll tell the contractor to proceed with the sidewalks, however, he will not be able to do the sidewalks adjacent to the pedestrian ramps because there are a lot of pedestrian and curb ramps that have to be removed and replaced. They will have to stop short of that. Also they will not be able to place the sidewalk across the driveways. We did discuss in detail and in depth that the concrete sidewalk, the concrete driveway apron and the curb by those driveways would be done all at one time to minimize the inconvenience to the property owner or residents of the property. We told the developer that once we understand and talk with the contractor we would get back to them with the schedule for the sidewalk. McKean Square Curbs Comments In my opinion, a vast majority of the damage was a result of the Developer not enforcing curb protection. The curb is in worse condition than the Autumn Ridge curbs which are 8 to 10 years old. During the pre-construction meetings and during the construction meetings with VSSA, their contractors, and subcontractors were repeatedly advised to protect the curbs and strict lot access to protect the curb. Bonestroo staff and City staff emphasized that the 10%estimate of damaged was based on a normal subdivision where a few houses are built at a time. The damage would be much higher if the homes were built in mass. The damage could be minimized if the Developer and Contractors would make an effort to protect the curbing. At one point the contractor installed erosion control fencing across the front of some lots leaving only the driveways open. The fence lasted a few short weeks. I Mr. Hogge's letter he points to various outside contractors that placed dirt on the curbs and then scraped it off of the curb to fill the hole. He did not mention that the Developer's contractor who probably caused the majority of the damage. Collins Electric installed the fiber cable communications system at the back of the curb. In many places they dug several feet deep directly behind the curb and they also placed dirt on the curb. Collins Electric installed the streetlights and the electrical wiring behind the curb. Mann Valley Excavating is the excavating contractor for the townhome section of the subdivision. They were pretty good at protecting the curb when they moved dump trucks and the large excavators over curbs. However, their skid steer drivers were not as careful when they spread the black dirt and dug out for driveways. Also Mann Valley installed the trail system using large equipment. The curb sections had no protection when the large vibrating roller compacted the base material for the trails and drive over the curbs. Snow plowing and street cleaning was done at times with a bobcat with a broom and at other times with a bobcat scraping mud and snow off the street with a bucket. If curb protection and right of way control had been implemented and maintained by the Developer the contractors would have had room away from the curb to store their dirt. As the development was managed by the Developer and Contractors the right of way and even the street was used to store materials. TREE CITY U.S.A. MEMORANDUM To: Dennis Postler From: Dave Hanson Subject: McKean Square Utility and Street Improvements BRA File No. 55-03-129 Date: January 4, 2005 The following is the status of the City Utility and Street Construction for the McKean Square Project. Burschville Construction(the prime contractor)completed the sanitary sewer,and this system was put into service in August of 2003. Burschville also completed the installation of the water main and sewer and water services in September of 2003. The water main was put into service following the required bacteria testing of the system in October of 2003. They completed the storm sewer installation in September 2003. The initial street construction began in September of 2003, including excavation, grading and class 5 gravel placement. The concrete curb and gutter was placed and the first lift of bituminous was completed in October of 2003. In the summer of 2004 the City determined that the building construction activity had damaged a significant amount of concrete curb and gutter, and they directed the City contractor Burschville to remove and replace 100%of the concrete curb. This work began in September of 2004, and in conjunction with this work the concrete sidewalk was also constructed. Note,there is a short segment of concrete sidewalk that was not constructed due to developer's activities and will be constructed by the developer in the spring of 2005. The final wear course paving was completed on October 22, 2004. Final inspections have been completed,and the contractor has completed all outstanding items for the sanitary sewer and water main. Final inspection of the storm sewer system can not be completed until the Developer completes the cleaning of the system(when weather permits). The final inspection of the street construction has been completed. At the intersection of Nolan Parkway North and Nolan Avenue North there is a bituminous paving issue that will be further evaluated in the spring of 2005 to determine if correction action is required? As per the contracts and the project specifications and the dates mentioned above, substantial completion for the Utility Construction was October of 2003, and substantial completion for the Street Construction was November 2004. In November, I began contacting Ron Fenny from Visu-Sewer on the storm cleaning. Ron explained his busy schedule, and that cleaning may happen just before Thanksgiving or right after. Cleaning began on December 16, 2004. The storm lines were cleaned from SS-5 to SS-1, FES-1 to SS-1, and SS-1 through SS-4. Cleaning was discontinued on December 17, 2004, due to cold weather. On December 27, 2004, Ron Fenny explained that cleaning would not continue until spring, unless a week of warm weather would occur.
