You highlighted 12 items on the development application checklist which are addressed below. 1) Application form and payment for fees (attached) 2) Proof of ownership or authorization to proceed as applicant (attached) 3) A parcel search, including mailing labels, obtained from Washington County locating all properties within 500 feet of the exterior boundaries of the subject property (attached) 4) Project Narrative SHP hired GME Consultants, Inc. to provide environmental consulting services, including Phase I and II Environmental Site Assessments (ESAs) . We found low level petroleum contamination in the soil and buried debris in three locations on the Property labeled areas 1, 2, 3 on the attached diagram. SHP proposes to excavate and dispose of the impacted material which is estimated to be about 800 cubic yards. These three areas are further described below. > Area 1 - It appears that fill soil with debris had been deposited Sin this former "low" area in the past. Johnson 2 January 12, 2005 GME Project No. 7735-E > Area 2 - We previously observed scattered surface petroleum staining in this area. We estimate that the upper 1 to 2 feet of soil. is impacted. > Area 3 - This area was reportedly the former location of a basement on the Property. It appears that fill soil with debris had been deposited in the former basement. We estimate that the basement floor slab is about 8 feet below grade. Our Environmental Scientist will be present on the Property during the removal process, to conduct field testing and observe the excavated materials. Following excavation, we plan to collect confirmation soil samples from the bottom and sidewalls of the excavations for analytical testing. The confirmation samples will determine whether residual contaminated soil remains. Following removal of the contaminated soil, SHP proposes to backfill the excavations to original grade with a suitable soil. At this time, they propose to backfill the excavations with a sand or sand with silt, classified as SP or SP-SM according to the Unified Soil Classification System. This soil will be compacted to 95% of the maximum modified proctor dry density (ASTM D:1527) . Backfilling of the excavations will occur shortly after excavation. 4111 _ , SHP has enrolled this site in the Minnesota Pollution Control Agency (MPCA) Voluntary Investigation and Cleanup (VIC) and the Voluntary untary Petroleum Investigation and Cleanup (VPIC) programs. Prior to hauling the material, Bolander told us that they intend to place landscape fabric overlain by Class 5 gravel over the 58th Street concrete road curb and Mr. Eric A. All grading, erosion control and turf establishment shall be according to the materials, workmanship, and other applicable requirements of the Minnesota Department of Transportation 'Standard Specifications for Construction', latest edition, unless otherwise specified. All erosion control measures shown on the plans, including silt fence and hay bales, must be installed prior to commencement of grading operations and maintained until all areas altered on the site have been restored. Place hay bales around catch basins after they are constructed and maintain until all areas disturbed have been restored. F. Wherever construction vehicle access routes Intersect paved public rinds, provisions must be made to minimize the transport of sediment (mud) by runoff or vehicles tracking onto the paved rood surface. Where sediment Is transported onto a public road surface, the roads shall be cleaned thoroughly at the end of each day. Sediment shall be removed by shoveling or sweeping and be transported to a sediment controlled disposal area. II/ Accordingly,Ms.Erickson has no objection to allowing the project to proceed under a Conditional Use Permit.However,the following are minimum conditions should be placed on the approval Minimum Conditions For Approval: 1. Applicant shall protect all City infrastructure;curb,gutter,bituminous trailways,etc from damages. 2. All access shall be from 58th Street. 3. All mud,debris,dirt,etc tracked onto the City streets/trails shall be cleaned-up at the end of each construction day.There shall be no stockpiling of any fill or excavated materials on or off site. 4. No excavations or backfilling of any type may proceed without a Minnesota licensed soil scientist present at the site AT ALL TIMES.Applicant shall backfill any and all excavations with materials as indicated in scope of work before leaving the site at the end of each construction day.Site shall be reseeded with appropriate grass/prairie mixture. 5. You highlighted 12 items on the development application checklist which are addressed below. 1) Application form and payment for fees (attached) 2) Proof of ownership or authorization to proceed as applicant (attached) 3) A parcel search, including mailing labels, obtained from Washington County locating all properties within 500 feet of the exterior boundaries of the subject property (attached) 4) Project Narrative SHP hired GME Consultants, Inc. to provide environmental consulting services, including Phase I and II Environmental Site Assessments (ESAs) . We found low level petroleum contamination in the soil and buried debris in three locations on the Property labeled areas 1, 2, 3 on the attached diagram. SHP proposes to excavate and dispose of the impacted material which is estimated to be about 800 cubic yards. These three areas are further described below. > Area 1 - It appears that fill soil with debris had been deposited in this former "low" area in the past. To date this has not been supplied to the City. I am in need of this report. Additionally, the site remains unfinished as there has been no topsoil placed and the site has not been reseeded, this was also a condition of the project. Likewise the silt fencing remains in place and should be removed once the new grasses are established. The City expects this work completed/supplied in the next 30 days or we will be required to draw from the deposit posted on the project by VSSA and complete same. I would imagine the cost of reproducing the environmental testing would be expensive. As a result of their failure to protect the City's property,the curb and sidewalk will need to be replaced and/or repaired to the extent determined by the City.Additionally,the street was damaged by the vehicles, mostly tracked vehicles,and therefore the City's road must also be repaired. Enclosed you will find color photographs that clearly show the damages.The City will be preparing estimates for these repairs in the next 30 days.Once these estimates are complete we will provide you such information and how the City will proceed. Senior Housing Partners shall be responsible to cover all costs related to these repairs. Evergreens are not allowed on the boulevard. Planting Specifications: Attached is a sample Landscape Plan,"Plant Schedule"and "Planting Detail"(accepted planting procedures for shade trees,evergreen trees,and shrubs). Plants are to be installed according to these specifications. The landscape plan and planting will not be approved unless these procedures are used. A"Planting Detail" diagram for both trees and shrubs should be attached to any landscape plan which is submitted. Also included on this plan are Tree Replacement Calculations,which should be included for any projects which fall under the City's Tree Protection Ordinance. Approvals and Inspections Site Plan Review: A meeting between City Staff and the developer to discuss plans which have been submitted. Developer will receive initial feedback regarding the landscape plan at this meeting. If applicable,tree protection/replacement issues will also be discussed. Plan Approval: This normally occurs after the Site Plan Review meeting. The Arborist will review the project and make recommendations as to changes and specifications. The plan will receive final approval only after any suggested changes have been implemented and plans have been re-submitted for Parks Commission(if applicable),Planning Commission, and City Council approval. Inspections: Landscaping is inspected by the Arborist just after installation and also near the end of the guarantee period(typically 1 year after installation).Inspections may also occur at time of installation to ensure that planting specifications are being adhered to and that plant material is in good condition when planted. Final Acceptance of Installation and Landscape Plants: If specified planting procedures have been followed and plants are alive and in good condition at the end of the guarantee period,the Arborist will sign off on the landscape portion of the project. Senior Housing Partners (SHP) owns the Property at the above referenced location. We were hired by SHP to provide environmental consulting services at the Property. We have previously conducted Phase I and II Environmental Site Assessments (ESAs) on the Property. Our assessments revealed low level petroleum contamination in the soil and buried debris in three locations on the Property. The three locations where the excavations are planned are shown on the attached diagram. SHP has contracted with Bolander and proposes to excavate and dispose of this material at the SKB landfill in Rosemont, Minnesota. Our Environmental Scientist will be present on the Property during the removal process to conduct field testing and make observations of the excavated materials. SHP has enrolled in the Minnesota Pollution Control Agency (MPCA) Voluntary Investigation and Cleanup (VIC) and the Voluntary Petroleum Investigation and Cleanup (VPIC) programs and will be seeking closure letters from them.
