Councilmember Liliegen: He attended the Bayport Fire Department's 125-year anniversary dinner and thanked the volunteer fire fighters for their service. D. The residents at 14161 U. 54th St. (Colleen and Mike Nolde) are requesting removal of a silver maple (11 in. diameter) in the boulevard right-of-way in front of their home. The tree has surface roots which have popped landscaping and landscape edging, and are interfering with mowing. The Noldes would like to re-do their driveway in the next year or so and are concerned that the roots will cause cracking of the new driveway. l have inspected the situation. The tree roots are currently causing significant damage to the lawn and landscaping (images attached) and have the potential to cause structural damage to the driveway. The Noldes are requesting that the tree be removed. They have been informed that there is a $100 co-pay for removal of the tree. I have attached a copy of the Nolde's letter and my recommendation form. Additional repairs are necessary. Gary Brunckhorst has prepared a memo outlining our options and costs. There are no immediate alternative options short of removing the systems in the PW Garage, but which would then result in no fire alarm systems for that building. Staff does recommend approval as discussed in the memo. Funding source: Budgeted Projects—City Hall Maintenance Fund. Page 23 of 124 of Oak Park Heights,i Memo Date: September 18, 2013 To: Eric Johnson, City Administrator; Betty Caruso, Finance Director From: Gary Brunckhorst, Sr. Accountant Re: Security and Alarm System Since moving into the building in May of 2010 we have periodically had issues with the security and alarm system malfunctioning due to storm activity. Staff has had Steak and Case, Inc. as well as Diebold, Inc. in to repair the issues at varying costs depending upon what has been knocked out. The first major repair, one of the external card readers in the Public Works garage was assumed to be the origination point of the power surge and the surge traveled through its loop to the Security Alarm Panel in the basement and knocked out the Star Coupler, The Star Coupler connects all of the reader and security loops in both buildings. Every card reader in that loop was put into"soak". "Soak"means that it may or may not work with the last information that it had received from the panel until the faulty reader was replaced and the loop restored. To replace the Star Coupler and the reader and restore the loop it cost$830 for parts and labor. We cannot be sure if that was the origination point or if that reader just happened to be the only reader on the loop that couldn't handle the surge. The second time 3 separate card readers and one keypad reader in the Public Works garage were knocked out and needed to be replaced as well as the Star Coupler and the Alarm Panel motherboard to restore the loop. Again we cannot definitively say that the surge originated in the Public Works garage or the City Hall or if those readers were the only ones on the loop unable to handle the surge. At this time it was decided to put in surge suppressors on all exterior card readers to try to resolve the problem. It was thought that any lighting strike near the City Hall or the Public Works garage was allowing electricity to come in through the outside readers knocking them out and traveling through to the Star Coupler knocking it out also. This repair including parts and labor was$6,271. The first two repairs were done by Steak and Case, Inc. The City then decided to put both the monitoring and repair under one umbrella and hired Diebold to do both. The third instance happened earlier this year and was once again thought to have been originated in the Public Works garage but we could not know for sure. This time two card readers and one keypad reader in the Public Works garage knocked out the loop but it did not knock out the Star Coupler. The replacement of the card readers and keypad and restoration of the loop cost $721. Wednesday September 18`h it happened again. We have 16 card readers and one keypad in "soak". Some of them are working and others are not. Diebold has been out and we have two Page 24 of 124 card readers in the Public Works garage burned out, and the Star Coupler has two of its four ports burned out. Through discussions with the Diebold repair representative after the third incident it was thought that our next step to take in resolving this issue would be to separate the two buildings by installing a second panel in the Public Works garage. This would allow us to definitively discover if the issue is originating in the Public Works garage and flowing into City Hall or the other way around. The readers that have had to be replaced have all been out in the garage, but the whole loop which includes almost all of the police department and the whole Public Works garage have been knocked out each time. If we install the second panel in the Public Works garage and split that loop we will be able to definitively determine if the issue is located in the Public Works garage or the City Hall if and when it happens again. We asked Diebold for an estimate to install a second panel in the Public Works garage. We received the proposal on July 19th and we were going to budget for this for next year, but after having the loop go down again after a storm are requesting the funds to have this installation done this year. The estimate with parts and labor is $3,813. To repair the two card readers and replace the Star Coupler for the current incident will not exceed $1,500. HISTORY In 1987 a Report for a Street Capital improvement Program was created to review existing streets and provide a program to upgrade streets in three of the older neighborhoods. In 1993 a Comprehensive Street Report was created that identified five areas of street resurfacing rehabilitation needed in the older streets within the City. In 1995 the street rehabilitation program began with Area A which included approximately 3.2 miles of streets.This area is located between O'Brien Avenue North, TH-36, Osgood Avenue North, and 55th Street North. Area A was reconstructed with concrete curb and gutter and included storm sewer extensions, and miscellaneous sanitary sewer and water main repairs. Driveway reconstruction to aprons occurred. The streets were built within existing easements and right of way. Assessments were used to fund a portion of the reconstruction, and the approximate residential rate per unit was$2,600. Feasibility reports were prepared for the remaining areas B, C, D, and E in 1998 and 1999. Additional street reports and studies were also completed between 2000 and 2013, which further identified reconstruction needs and evaluated the costs of the potential improvements. SCOPE OF STUDY The purpose of this report is to provide the feasibility of the current reconstruction improvements of approximately five miles of streets.The type of improvements required, costs of the improvements, and how the improvements will be funded will be evaluated. Proposed improvements will need to synchronize with the current and upcoming construction adjacent to the proposed project areas.The St. Croix River Crossing (SCRC) project is currently under construction and will continue over the next couple years.This project is identified on most of the figure drawings shown throughout this report. Other projects include Washington County work on Stagecoach Trail North and TH-95 in 2014, Paris Avenue North in 2015, and potential future projects on Osgood Avenue North. While creating this report, soil borings were taken to in order to supply additional necessary information to complete more accurate cost estimates. Past soil boring and test hole information was utilized in determining the ultimate street section and amount of subgrade correction work that may be required. The streets in this area include failing pavement that has been patched, seal coated, slurry sealed, and is in need of full reconstruction. On Upper 551h Street North there is approximately 410 feet of bituminous curb. The remaining area consists of a four inch high back, drive over curb. Generally, the project area drains to the northeast into Valley View Park and ultimately to Perro Pond. City records have been reviewed and initial inspections performed to identify storm sewer and sanitary sewer warranting improvement work in the project area. Overall, the condition of the existing storm and sanitary systems in the project area is good. Deteriorating storm structures, storm pipe laterals, and specific sanitary pipe issues will be further identified during the project design phase to determine if replacement or rehabilitation is needed. As is typical with the existing cast iron water mains in the City, approximately 410 feet will be replaced on Upper 510 Street North from Osgood Avenue North to the east.The remaining water main in this area was installed with ductile iron pipe in 1972 and 1978 and will not be replaced as part of this project. Oren Avenue was constructed in 1983. The streets in this area include failing pavement that has been patched, overlaid, seal coated, slurry sealed, and is in need of full reconstruction. Most of the streets have bituminous curb,with a small portion of concrete curb located at the south end of Omaha Avenue North and also a four inch, high back drive over curb on Oren Avenue North. The project areas drain storm water to the frontage roads along TH-36 and to the east. The trunk storm sewer pipes along TH-36 ore currently under construction this year in 2013,which will continue through the end of 2014. The ultimate City storm water will be separate from the TH-36 corridor storm water through two separate systems. City records have been reviewed and initial inspections performed to identify storm sewer and sanitary sewer warranting improvement work in the project area. Overall, the condition of the existing storm and sanitary systems in the project area is good. Although, the storm sewer structures on Omaha Avenue North are known to be in bad condition. Deteriorating storm structures, storm pipe laterals, and specific sanitary pipe issues will be further identified during the project design phase to determine if replacement or rehabilitation is needed. As is typical with the existing cast iron water mains in the City, approximately 2,700 feet will be replaced. Due to the age and condition of the streets, full street reconstruction is warranted. RECONSTRUCTION The reconstruction method includes the removal and replacement of the bituminous streets and curb, along with replacing the aggregate base and utilizing reclaimed aggregate backfill material. Subgrade corrections have been identified in previous feasibility and soil boring reports. Based on those reports, reconstruction will consist of the following improvements: • Full depth recycling of existing pavement (grinding existing bituminous and aggregate base to create new aggregate base section). • Subgrade correction as necessary (assuming 30 percent required for this report). • Install 136-18 concrete curb and gutter, unless surmountable curb is identified as needed on certain streets during the project design. • Install drain the as needed and connect to storm sewer at low points to remove Subgrade drainage. • Replace driveways aprons from curb to right of way. Replace bituminous with bituminous, concrete with concrete, and gravel shall be upgraded to bituminous. EXISTING AND PROPOSED CURB The existing curb conditions are identified in Figure 6. As explained in the previous Existing Conditions section, Area E shows areas where no curb is currently visible. It is understood by staff and previous records that all areas had bituminous curb at some point, and over time the curb has deteriorated, broke away, or have been damaged by snow plows. Although the majority of the existing curb is bituminous, it is proposed to replace all curb with concrete curb and gutter. Installing concrete curb and gutter will provide superior drainage, structural edge support to the street,will allow the control of slight grades and prevent standing water, and will be less maintenance for city staff. TYPICAL SECTIONS In general, streets reconstructed will not be enlarged or reduced in width unless determined necessary during the project design and approved by the City Council,The proposed street widths are shown in Figure 7. Reconstructed streets will be designed to fit within the current footprint in efforts to minimize impacts to properties, landscaping, and trees. I LL a- 0 7 1 kl: H O U- L riu w w LU U Page 53 of 124 CITY OF OAK PARK HEIGHTS - STREET RECONSTRUCTION PROJECT Water Main Improvements As part of the infrastructure maintenance program, all cast iron pipe (CIP) is proposed to be replaced in all areas designated for reconstruction as shown in Figure 10.The CIP water main being replaced was originally installed between 1967 and 1973. Historically, CIP water main is more susceptible to breaks and can become a maintenance issue and cost to the City. Since the streets are being reconstructed, now is the appropriate time to replace the old CIP water main and avoid potential breaks under the new pavement. It is proposed that the water main, hydrants, valves, service pipe to the property line, and curb stops (water shut-off valves) be replaced as part of the project where rehabilitation of the existing street is completed.The new main, leads, and fittings would be replaced using ductile iron pipe (DIP). Sanitary Sewer Improvements The sanitary sewer mains have been televised and overall appear to be in satisfactory condition. However, there are a few needed spot replacements and repairs which were identified. Figure 1 1 identifies the sanitary sewer within the project areas that will be reviewed during the design phase, and may require spot replacement or rehabilitation. All non-conforming manhole covers, ones with open pick holes, within the project area are proposed to be replaced with covers with concealed pick holes.This will help in limiting unnecessary inflow into the sanitary sewer system. Additionally, seals will be added to the existing sanitary manhole's access to reduce potential infiltration into the system. The proposed improvements assume 20 percent of the sanitary sewer will require replacement due to sags in the pipe, breaks, or severe root issues. Additionally, it is assumed that 30 percent of the sanitary sewer will require cured-in-place pipe (CIPP) lining. Lining is currently proposed as part of this project, but can be completed as necessary in future projects, Typically, problem areas identified during the design phase will be reviewed and determined when the appropriate time is to complete the lining improvement. City of Oak Park Heights Stantee Stantec Project No: 193801994 Sireet Reconstruction-2014&2015 Page 24 Page 54 of 124 CITY OF OAK PARK HEIGHTS - STREET RECONSTRUCTION PROJECT Storm Sewer Improvements As shown on Figure's 12-15, there are additional proposed storm sewer pipes and structures shown generally in efforts to improve area drainage.The exact location of storm structures and pipe alignments will be determined during the design phase after the preliminary survey work is complete. Within the project area, several types of storm sewer needs have been identified. If is proposed that along with the scheduled maintenance of the streets, non-city standard catch basin castings be replaced in areas where reconstruction is proposed. Similarly, all storm sewer structures that are constructed of block will be replaced with pre-cast concrete structures within the project area.Spot replacement will occur for any deteriorated and failing structures or pipe. The two areas requiring more significant improvement to the storm sewer system are Areas D and E. As shown in Figure 14, proposed storm sewer runs to the west of Peabody Avenue North are shown to collect the drainage west of Paris Avenue North. Coordination with Washington County will need to occur during the design of the storm sewer and streets for this area. The storm sewer in Area E, as shown in Figure 15, identifies additional storm sewer to replace the existing culverts for the ditch sections. Installing this storm sewer with the concrete curb and gutter will improve the drainage in this area, and will result in less maintenance for city staff. In efforts to manage storm water quality and quantity, storm water will be managed via sub-surface concrete structures compliant with the Middle St. Croix Management Organization rules. Page 99 of 124 Appendix C Resolution for Street Reconstruction Parameters Page 100 of 124 RESOLUTION 13-09-36 A RESOLUTION BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS RELATING TO GENERAL PARAMETERS FOR THE NECESSARY STREET RECONSTRUCTION PLANNED FOR 2014 AND 2015 Whereas,the City of Oak Park heights has numerous lane miles of streets that are in need of major repair and replacement, specifically in Areas B, C, D & E as shown on the Plan Map attached hereto as Exhibit A; and, Whereas,the related curbing and storm water management systems are also in need of major repair or replacement; and, Whereas, many of the City's underground sanitary and water utility systems are approaching the end of their useful life and should be updated in conjunction with any major street reconstruction so as to avoid duplicative and costly re-excavation and restoration; and, Whereas, The City Council for the City of Oak Park Heights has carefully considered several options for managing and funding the execution of each of the above elements so that costs are viable and equitable based on long-term investment; and, Whereas, there is additional discussion and public dialogue needed the following directives are provided to the City Staff so that costs and options may be further refined so that an informed future decision can be made by the Council. 1. All streets planned to be reconstructed shall not be enlarged or reduced in width unless necessary for functionality and as determined by the City Council on a case-by-case basis. 2. All streets planned to be reconstructed shall have new concrete curbing placed along each side of street. Curbing is anticipated to be of 136-18 standard design,non-surmountable; or shall be a surmountable curb where desired by the City Council and which will be identified by the City as the project progresses. Asphaltic/bituminous curbing shall not be installed. Page 101 of 124 3. All water mains shall be replaced in Areas C, D & E, and shall change from cast iron to ductile iron. Except for approximately 400' of cast iron pipe on the western end of Upper 55th street which shall be replaced with ductile iron,Area B generally contains ductile iron water main and does not need replacement at this time.None of these costs shall be directly assessed. 4. For the purposes of planning all cost estimates shall assume a 20%replacement on sanitary lines, 30% to be lined with the final 50% to remain unaltered. None of these costs shall be directly assessed. 5. The City shall replace at its expense(not assessed) the private water service line from the water main to (and including) the curb-stop, typically located at or near the property line. Once installed,this service line becomes the responsibility of the property owner consistent with City Ordinance.The City will replace this water service line from the main to the curb stop in its current location. Should the property owner decide to relocate the curb stop location, such as to remove it from a driveway surface to a lawn area, the City will pay for the connection from the main to the curb stop in its new location so long as the new location remains in the City's right-of-way and without obstructions. Should this new location occur it is the property owner's responsibility and expense to directly connect and coordinate such construction of a new direct water service line from the new curb-stop location to the hoarse in a direct fashion without the use of a union joint at the old curb-stop location. If the old curb stop that is no longer going to be used lies within the apron of the driveway to be replaced by the City, the City will remove the curb stop and service line to the main. If the old curb-stop lies outside the apron to be replaced, the City will not remove the former curb-stop but will terminate the service at the main. In locations where new sanitary line is being installed,the City shall replace at its expense(not assessed)the private sanitary service line from the sanitary main to a point of connection at the private service typically located at or near the property line. Once installed, this service Iine becomes the responsibility of the property owner consistent with City Ordinance. Page 102 of 124 6. Storm water shall be managed via sub-surface concrete structures compliant with MSCWMO rules. 7. The Project will replace the residential driveway aprons as part of the total project from the curb-line to the right-of way line. These costs shall be totaled and shall be calculated into the total Street Assessment costs. All aprons shall remain the same general width onto the City street. Asphalt aprons shall remain asphalt; concrete shall remain concrete, gravel shall be upgraded to asphalt. Property owners who desire to install a concrete apron from an asphalt apron or who may desire to widen the apron shall directly pay for these increased costs to the City. These increased costs may be paid directly to the City in an upfront payment or may be directly assessed (unsubsidized) and shall be included in their assessment to their property. 8. Should City residential property owners desire that their entire driveway be replaced, the City shall direct the residential property owner to the contractor for an independent discussion. The City shall secure a per-ton and/or a square-yard price for asphalt installation and finishing which shall be extended to the property owner by the approved contractor and which shall contain at least a two-year warranty from the contractor. It is the property owner's responsibility to coordinate all such work and secure necessary contracts and performance standards with the contractor selected. The property owner is not required to utilize the City's contractor and may secure their own separate contractor. The City will not assess these costs or finance these private driveway costs. The City shall not guaranty any work on the driveway and all disputes shall be settled independently between the property owner and the contractor chosen by the property owner. 9. Unless specifically authorized via a separate resolution, the City shall not install any new trails or sidewalks in conjunction with this Project. Page 103 of 124 10. The Street Assessment will pay for all typical costs associated with the removal and installation of the street surface, subgrades as well as the driveway aprons. The Curbing Assessment will pay for all typical costs associated with curbing removals and installation. 11. In addition to the protocols set forth in this resolution, the following Assessment Policies shall be utilized for Street and Curbing Assessments: • Total Street Reconstruction Costs (generally being streets and curbing) shall be reduced by funds available to the City and Street Reconstruction Funds generated through 2014 and will be applied to the total cost of the street and curb project elements. • The remaining costs shall be allocated between homesteaded properties and commercial/non-homesteaded properties. • Commercial/Non-Homesteaded Properties shall be assessed on a total per frontage foot basis, with improvement assessed at 100%of frontage. There shall be a minimum assessment for all commercial /non-homesteaded properties of an amount not less than the minimum homesteaded residential assessment. (The Commercial/ Non-Homestead classijrcation is defined as lands being utilized as a commercial, multi-family home, government facility,public utility,places of worship, or any other non-homestead property as defined by Minnesota law.) • The balance remaining, excluding amounts to be allocated to City owned property, will be distributed equally to the residential homesteaded properties on an equal, per unit basis. In determining the units of residential properties, each parcel will be a unit. Exhibit B— as attached outlines the cost allocations as defined above. • The City shall offer a ten (10) year assessment repayment timeline at an interest rate of not more than 2.0%over the City latest general obligation bond issued by the Page 104 of 124 City which is anticipated to be a general obligation improvement bond to be issued to finance a portion of the projects(s)discussed herein. 12. Parcels of land that are directly attached to a homesteaded parcel shall not be required to pay an additional assessment in addition to the primary parcel when such parcels that are owned by the same person(s) and are not buildable for a single family residence(or for a greater density), for commercial or non-homestead use or as may be permitted by the City Ordinance; or not buildable or due to other apparent circumstances, such as overhead power lines, that would substantially preclude any residential or commercial construction. 13. As the Project relates to any necessary bonding for any purposes,the City shall not charge the utility funds for such costs via a rate increase; instead such funds shall be derived from the City general revenues sources as may be generated outside of utility fees. 14. Once the general costs estimates are completed the City Council the City shall hold public/neighborhood meetings on the anticipated concepts, funding scenarios and possible timelines. These meetings may include at least one meeting where all neighborhoods are invited as well as possible per neighborhood 1 area meetings. After such meetings,the City Council may then schedule the formal improvement and assessment hearings. NOW, THEREFORE BE IT RESOLVED, that the City Council does direct staff to complete the Feasibility Report for the proposed street reconstruction and related improvements as approved by the City Council on May 29h, 2013 and to execute necessary and reasonable obligations based on the above directives found in this Resolution, to be completed in a timeline that produces a plan for possible bid letting in February 2014. Should the property owner decide to relocate Page 111 of 124 the curb stop location, such as to remove it from a driveway surface to a lawn area, the City will pay for the connection from the main to the curb stop in its new location so long as the new location remains in the City's right-of-way and without obstructions. Should this new location occur it is the property owner's responsibility and expense to directly connect and coordinate such construction of a new direct water service line from the new curb-stop location to the Dome in a direct fashion without the use of a union joint at the old curb-stop location. If the old curb stop that is no longer going to be used lies within the apron of the driveway to be replaced by the City, the City will remove the curb stop and service line to the main. If the old curb-stop lies outside the apron to be replaced, the City will not remove the former curb-stop but will terminate the service at the main. In locations where new sanitary line is being installed, the City shall replace at its expense (not assessed) the private sanitary service line from the sanitary main to a point of connection at the private service typically located at or near the property line. Once installed, this service line becomes the responsibility of the property owner consistent with City Ordinance. b. Storm water shall be managed via sub-surface concrete structures compliant with MSCWMO rules. 7. The Project will replace the residential driveway aprons as part of the total project from the curb-line to the right-of way line. These costs shall be totaled and shall be calculated into the total Street Assessment costs. All aprons shall remain the same general width onto the City street. Asphalt aprons shall remain asphalt; concrete shall remain concrete, gravel shall be upgraded to asphalt. Property owners who desire to install a concrete apron from an asphalt apron or who may desire to widen the apron shall directly pay for these increased costs to the City. These increased costs may be paid directly to the City in an upfront payment or may be directly assessed (unsubsidized) and shall be included in their assessment to their property. Page 112 of 124 8. Should City residential property owners desire that their entire driveway be replaced, the City shall direct the residential property owner to the contractor for an independent discussion. The City shall secure a per-ton and/or a square-yard price for asphalt installation and finishing which shall be extended to the property owner by the approved contractor and which shall contain at least a two-year warranty from the contractor. It is the property owner's responsibility to coordinate all such work and secure necessary contracts and performance standards with the contractor selected. The property owner is not required to utilize the City's contractor and may secure their own separate contractor. The City will not assess these costs or finance these private driveway costs. The City shall not guaranty any work on the driveway and all disputes shall be settled independently between the property owner and the contractor chosen by the property owner. 9. Unless specifically authorized via a separate resolution, the City shall not install any new trails or sidewalks in conjunction with this Project. 10. The Street Assessment will pay for all typical costs associated with the removal and installation of the street surface, subgrades as well as the driveway aprons. The Curbing Assessment will pay for all typical costs associated with curbing removals and installation. 11. In addition to the protocols set forth in this document reseletien,the following Assessment Policies shall be utilized for Street and Curbing Assessments for City parcels only unless noted otherwise: 9 Total Street Reconstruction Costs-(generally being streets and curbing) for City o Oak Park Hei hg is parcels shall be reduced by funds available to the City and Street Reconstruction Funds generated through 2014 and will be applied to the total cost of the street and curb project elements. For all parcels outside of the City_limits and tax exempt parcels within the City limits such properties shall pa the costs of the Page 113 of 124 project per frontage foot at the actual calculated costs without City Street Reconstruction Fund subsidy, The remaining costs shall be allocated between homesteaded properties and commercial/non-homesteaded properties. • Commercial/Non-Homesteaded Properties shall be assessed on a total per frontage foot basis, with improvement assessed at 100% of frontage. There shall be a minimum assessment for all commercial/non-homesteaded properties of an amount not less than the minimum homesteaded residential assessment. (The Commercial/ Non-Homestead classification is defined as lands being utilized as a commercial, multi family home, government facility,public utility,places of worship, or any other non-homestead property as defined by Minnesota law.) • The balance remaining, excluding amounts to be allocated to City owned property, will be distributed equally to the residential homesteaded properties on an equal, per unit basis. In determining the units of residential properties, each parcel will be a unit. Exhibit B—as attached outlines the cost allocations as defined above. • The City shall offer a ten (10) year assessment repayment timeline at an interest rate of not more than 2.0% over the City latest general obligation bond issued by the City which is anticipated to be a general obligation improvement bond to be issued to finance a portion of the projects(s) discussed herein. 12. Parcels of land that are directly attached to a homesteaded parcel shall not be required to pay an additional assessment in addition to the primary parcel when such parcels that are owned by the same person(s) and are not buildable for a single family residence (or for a greater density), for commercial or non-homestead use or as may be permitted by the City Ordinance; or not buildable or due to other apparent circumstances, such as overhead power lines, that would substantially preclude any residential or commercial construction. As the Project relates to any necessary bonding for any purposes, the City shall not charge the utility funds for such costs via a rate increase; instead such funds shall be derived from the City general revenues sources as may be generated outside of utility fees. 14. Once the general costs estimates are completed the City Council the City shall hold a public / neighborhood meetings on the anticipated concepts, funding scenarios and possible timelines. These meetings may include at least one meeting where all neighborhoods are invited as well as possible per neighborhood / area meetings. After such meetings, the City Council may then schedule the formal improvement and assessment hearings.
