Re: Traffic Data—Upper 60 St. & Paris Ave/Washington Cnty Gov. Center Temp. Access
I put the radar trailer in the area facing West on Upper 60 St. at Paris Avenue. Due to the stop
sign on Upper 61st and a residential driveway on the other side,the trailer had to be placed back
"East"from the intersection of Paris Ave. This allowed the traffic turning East on Upper 61st St.
from Paris Avenue to also be counted in the study.
The trailer was placed 0930 hrs on 07-08-2008. I removed the trailer 07-11-2008 0930 hrs.
The traffic count is attached. This is not absolute or confirmed data but this would be very
representational of the general traffic for the area. A total of 56 cars for the area and total time
period.
While I was removing the trailer I spoke with the resident/complainant on this issue. He
approached me and we spoke about the situation. He said he has not seen any traffic using the
temporary exit in the last few weeks or longer,with the exception of a construction truck
periodically.

RE: Paris Avenue Secondary Entrance
Dear Eric:
This letter is to provide you with the information requested in your June 25, 2008 letter regarding
the Paris Avenue entrance to our Law Enforcement Center.
Since the time of your letter, County Sheriff Bill Hutton has talked with Mr. Malanaphy. The
Sheriff has also taken steps on the use of the access by other jurisdictions and County staff.
We believe the Sheriff's actions and his discussions with Mr. Malanaphy have significantly
addressed his concerns.
We have enclosed the plans for installation of the gate and card reader system. For vehicles
exiting the facility; loop detectors buried under the pavement will open the gate. In order to
enter the facility a County issued card is needed. This will allow us to accurately document who
enters and at what time if future issues arise. The driveway
paving
gate construction. We are working for completion of this work by August 15th mpleted with the
Paris Avenue and 62nd Street paving is scheduled for July 9, 2008.
Final plantings and landscaping will be done after the driveway is complete. Placing natural
barriers outside the gates is not planned. While driving around the gates will not be tolerated; it
is not in the best interest of public safety to create barriers to the only Courthouse and Law
Enforcement Center in Washington County.

RE: Paris Ave Secondary Entrance.
Dear Don:
At the City Council meeting held on June 24th, 2008, Oak Park Heights resident Stuart
Malanaphy of 6155 Paris Ave. expressed his continued concerns regarding the excessive
use of the Paris Ave.entrance to the Washington County Gov. Center. I have enclosed
for your review his written comments as read aloud to the City Council.
As we had agreed, this access is limited to only a "secondary use" typically to be
interpreted as either an emergency egress only access-way to Paris Ave. and/or for very
limited and special purposes;certainly not regular and continual use by general County
staff or other parties.This "secondary use"was agreed to in Annexation agreement
dated October 4th, 2005. (Language is excerpted here for your reference):
Sec.4.8.d. Paris Avenue will not be widened or enlarged south of 62nd Street and there shall be
no ingress to the County facilities from Paris Avenue. The currently unpaved
roadway may be paved and shall only be utilized as a secondary access for ponce
and emergency vehicles. If the County installs a full ingress and egress from Paris
Avenue, the County shall provide the funding for the design and reconditioning,
according to the standards of OPH engineer, of Paris Avenue from 62nd Street to
the point of ingress and egress, including the installation/replacement of curbing
and appropriate storm water infrastructure.
It would appear,according to Mr. Malanaphy's comments that the uses are exceeding
the terms of the agreement as the use is more than 'secondary" and is being improperly
used as an "ingress-way".
At this time the City requests that the County complete the paving of this gravel drive
and install the necessary gate &card system that will allow for egress only.The
installation of this gate-system is consistent with the Developer's Agreement between the
County and the City dated August 10th, 2007, (see Sec.5, Item 16.). Moreover, additional
landscaping and other natural barriers such as large boulders or other aesthetically
pleasing materials must be installed to prevent vehicles from simply driving around the
gate(s). To process this, the County should submit a plan to the City so that it may share
the proposal with Mr. Malanaphy and other area residents to demonstrate anticipated
outcomes for summer 2008.

As you are aware, this roadway intersects substantially in the City's right-of-way (see
enclosed map) for Paris Ave.and at this time the City is unaware of any permits issued by
the City that would have initially allowed this access. If your office has any record of the
City authorizing this entrance into its roadway we would like to be copied on same.
We look forward to the County providing the City a copy of its plan to pave this roadway
and to install the required gate systems. With these items being completed and enforced
though your offices, I would believe that Mr. Malanaphy's concerns will be addressed.

Re: Card activated gate at county emergency access road.
In my neighborhood,we have serious concerns regarding the planned use of the new card activated gate at
the emergency access road which is directly across the street from my home. First of all,we have seen no
documentation indicating what the planned use will be and we have a great deal of skepticism regarding
its necessity and the counties ability to use it responsibly.
Here is some history on this issue. It is our understanding that the county entered into certain agreements
with our O.P.H. neighborhood when the new county government center was first constructed. There were
meetings regarding the nature and use of the park area through which this emergency access road runs.
Should there be picnic tables,etc... We believe that it was generally agreed upon at that time that this
gravel path was merely an auxiliary,emergency access point,probably more for allowing fire trucks to get
at the building than for squads to shoot out of. As a consequence,the path was not used and was infact
closed to use by a chain strung between two poles.
In the spring of 2004,Walgreens was built on the west end of the county facility and the chain across the
road came down and the circus of county traffic through the park began. We endured 24 hour traffic
every day of the week for nearly 2 years. Squad cars,detective vehicles,personal cars,and all manner of-
vehicles moved in and out. There were near collisions and angry horn honks. Shift changes flowed
through that park coming into work and out to work and returning from work. Detectives and other
county workers drove in and out both for work and for lunch breaks it would seem.
They came sometimes singly and often in droves. The officers regularly blew through the stop sign in
groups,loudly bottoming out their cars,kicking up gravel and driving as aggressively as the road would
allow. Each time this happened,'which could be several times a day or night it made a hell of a racket.
We grew used to waking to the sound of over acceleration on our little road. The officers were also in the
habit of parking in the street,engines idling,and enjoying conversation or even addressing each other
with their noise-makers;no matter what hour.
We were astonished. I,personally,felt that their intrusion was so obviously wrong that it would only be a
matter of time before they would stop using the road out of common decency,particularly if they noticed
that we weren't smiling at them when they passed. They are officers of the law after all. I was wrong.
Two years into this,phone calls were.made,letters were written and traffic was greatly reduced though
not eliminated and not without further bad behavior.
As recently as 6-22-08,at 7:11 p.m.,an unmarked 4 door sedan,Minnesota licence rek 416 drove casually
through the park and around the chained exit,over the new sod and down the street. Not an emergency.
Three weeks ago,we watched a Stillwater squad drive over the new sod to access the government center
and then return the same way. Not an emergency. Two days previous to that,a Stillwater squad
obviously en route to the government center,unable to access it because of the c air,drove with out
auxiliary lights or signals recklessly through a stop sign at Paris and 62n`'and in attempting to turn left
through me missed the turn entirely and was forced to back up to try the corner again. Had be made that
corner on his first try his next obstacle would have been the pedestrian who I had just dropped at that
corner in the dark and who was bent over in the road picking up items she had dropped. Almost an
emergency.
Our neighborhood will not tolerate any more of this. The quality of life here is incredibly diminished by
having county traffic come through that park. Our property values are negatively affected. Still,our taxes
haven't been reduced despite the 3 years now that we have been treated like the doormat for the county.
Our streets are little more than alleys and are perfectly inadequate to the task of safely carrying anything
other than residential traffic.
Here is the situation as we see it. Prior to 2004,that access trail was not used,emergency or other. Also,
during the recent construction that trail was not used for emergencies though it could have been. If the
county claims a need to use that trail for emergencies then why hasn't it been used prior to 2004 or during
construction? Were there no emergencies or were emergencies compromised or what is the deal?
We believe that the county employees enjoy driving through the park for unprofessional reasons and that
the new card activated gate is just placing infrastructure to justify use. We also believe that once that gate
is installed any optimistic view towards the way in which it will be used is an uninformed view. We
would like the city of Oak Park Heights to represent the needs of our neighborhood in this matter.

Subject: Washington County Storm Sewer work
Dear Gary and Eric,
As you are likely aware,the re-routing of storm sewers around the east side of the campus to run-off
ponds at the south-east side of the Washington Cty Govt Center campus has begun.
We were sent a letter that said work on the storm sewers would begin in August and that some trees
would be taken down. They said that in a continuing effort to be " good neighbors," every effort would
be made to minimize the impact of the project on the neighborhood. We were warned that the
construction would cause significant disruption for some period of time. That was understandable and
expected.
However, in the letter,we were told that the trees that were scheduled to be removed would be clearly
marked. Well,that didn't happen.
IN FACT,the markings were so bad, incomplete and/or misleading, it came AS A COMPLETE
SHOCK TO ALL OF US,that EVERY TREE from the intersection of Upper 61st and Paris, south to
36 was removed.
Acres of field were CLEAR CUT! It is absolutely shocking the devastation that has been left in
the wake of this project.
Now, with absolutely NO trees to the south,the din from Hwy 36 is deafening; as is the screeching tires
of police cars racing out of the fueling area at all hours of the day and night and the industrial strength
lighting from the parking lot washing into our windows all night.
At no time were we informed, nor was it ever suggested,that this project would mean clear cutting the
trees that provided to protection from the Hwy 36 and the Government Center.
To the best of my knowledge,there is NO SPECIFIC PLAN FOR beautification and

amelioration of the impact of this part of the project on our neighborhood.
The purpose of my letter to you both is to plead for your immediate investigation and intervention into
this part of the project and to insist on notification of specific plan through completion, including how
they intend to shield our neighborhood from this industrial complex.
The duplicity of the people in charge of this project,slipping this aspect through council review and
neighborhood notification without informing us at all about the extraordinary,irrevocable impact of this
project on our neighborhood is unconscionable.
It is us who have been good neighbors to the Washington Cty Center.
Though we acknowledged that this expansion was inevitable, our four, fairly simple requests were not
to impede the project in any way but only to: maintain the status of the maintenance road
as "emergency use only";to have assurance that plans were in place protect our properties from the
increased noise and light pollution resulting from the expansion of the LEC; every effort would be
made to protect the trees and shrubbery that provided what little barrier we have from the center and
Hwy 36; and finally,that the back of the center be finished and landscaped in the same manner as the
rest of the campus and not like some back alley and storage area.
It is my opinion that without active participation and advocacy by our representatives from
Washington County and Oak Park Heights,every aspect of this expansion will continue to
threaten the quality of life and home values of every house that borders this complex.
What I can tell you is:NOW WE KNOW that we can not trust Washington Cty to be "good neighbors"
in their approach to this expansion.
The people who are running this expansion project have already broken faith with the good
people of this neighborhood.Are we suppose to sit on our hands,filled with concern and fear
about what betrayal of the public's goodwill will be next?
For example,there is a meeting to get approval to construct a"temporary shed" on the campus. My
questions would be Where to build it?How big?For what?When will it be torn down?How do you get
access to it?
My instinct is the city council will be asked to approve it and without knowing the answers to any of
these questions,approve it.

This is not acceptable, especially in light of the obvious callous indifference to the citizens of OPH that
face this complex. To me their intentions must be suspect from the beginning.
I want to know that, going forward,the questions and concerns of the community have been addressed
and resolved before there is any approval of any amendments to the expansion plan.
The lack of planning or consideration that went into the cutting of all those trees(or possibly, and more
diabolically, all the planning that did go into cutting all those trees...behind our backs!)makes me think
that our job in the future is to be as vocal and self-serving as we can be in opposition to anything they
want to do on the east border of this campus.
I don't know how we can rebuild any kind of relationship with the powers-that-be in terms of this
project but I can tell you that I personally, as someone who was supportive and understanding in regard
to this expansion,now feel completed betrayed and alienated.
Gary and Eric,I think you both know that my position has never been one of"NIMBY,"however,it is
now clear that it is not in my best interest or those of our neighbors to sit by idly and HOPE that the
people in charge of this project will do the right thing by us.
I hope we can count on your help in protecting our interests and concerns with these and the ongoing
issues related to this expansion.
