TRAFFIC CONTROL SIGNAL MAINTENANCE AGREEMENT BETWEEN THE COUNTY OF
WASHINGTON, THE CITY OF OAK PARK HEIGHTS, AND THE CITY OF STILLWATER FOR
MAINTENANCE OF A TRAFFIC CONTROL SIGNAL AT THE INTERSECTION OF
OSGOOD AVENUE (CSAH 24) AND 62ND STREET NORTH IN OAK PARK HEIGHTS AND
STILLWATER
THIS AGREEMENT made and entered into by and between the County of Washington, a political
subdivision of the State of Minnesota, hereinafter referred to as the "County" and the Cities of Oak
Park Heights and Stillwater, Minnesota, municipal corporations, hereinafter referred to as the "Cities";
WHEREAS, it has been determined to install a traffic control signal at the intersection of Osgood
Avenue (CSAH 24)and 62"d Street North, and;
WHEREAS, the County and Cities will share in the maintenance costs of the traffic control signal as
hereinafter set forth;
NOW THEREFORE, IT IS AGREED AS FOLLOWS:
1. The County shall install or cause the installation of an actuated traffic control signal with
overhead signal indications and pedestrian indications at Osgood Avenue (CSAH 24) and 62nd
Street North in the Cities.
2. The County shall install or cause the installation of two new intersection luminaires (overhead
street lights), both of which shall utilize "full cut-off" lighting design.
3. The County shall install or cause the installation of crosswalks along the west (crossing north-
south) and north (crossing east-west) sides of the intersection and include pedestrian push-
buttons for these crossings. When construction of additional sidewalks occurs in the southeast
quadrant of the intersection, the County will install a similar pedestrian crossing along the south
(crossing east-west)and east(crossing north-south)sides of the intersection.
4. If requested by a city, the County shall allow an upsize in the signal service cabinet and the
service power feed to accommodate a separate additional street lighting circuit for up to seven
additional street lights. The requesting city shall be responsible for paying for this circuit and
costs associated with the increased cabinet size and upsized service power feed.
5. If requested by a city, the County shall permit at no additional cost to the Cities, the installation
of conduits to be placed under the street for future lighting systems. The requesting city will be
responsible for paying for their own additional costs associated with the installation of such
conduits.
6. The Cities shall be responsible for paying for the monthly electrical power costs to operate the
signal system, with Oak Park Heights responsible for 50% and Stillwater responsible for 50%.
7. The County shall install, maintain, and keep in repair the Emergency Vehicle Preemption
System. Such systems shall be fully compatible with the Cities' emergency service delivery
agents.

8. The County shall maintain and keep in repair the traffic signal, including re-lamping, cleaning,
and painting of the signal and luminaires at its cost and expense. Except in instances where
the signal must be temporarily disabled or discontinued for repair, maintenance or replacement
in which case prior notice or permission shall not be required, the County shall not disable,
remove, or otherwise discontinue the use of the traffic control signal or other lighting and
crosswalk elements provided for within this agreement at any time unless it has obtained the
approval and consent of the Cities of Oak Park Heights and Stillwater.
9. The Cities shall indemnify, save, and hold harmless the County and all of its agents and
employees of and from any and all claims, demands, actions or causes of action of whatsoever
nature or character arising out of, or by reason of, the performance of any work by the Cities
provided for hereby, and further agrees to defend, without cost or expense to the County, their
agents or employees, any action or proceeding commenced for the purpose of asserting any
claim of whatsoever character arising in connection with or by virtue of the work to be
performed by the Cities.
10. Any and all persons engaged in the aforesaid work to be performed by the County shall not be
considered employees of the Cities, and any and all claims that may or might arise under the
Workmen's Compensation Act of this State on behalf of said employees while so engaged, and
any and all claims made by any third party as a consequence of any act or omission on the part
of said employees while so engaged on any of the work contemplated herein shall not be the
obligation and responsibility of the Cities. The County shall not be responsible under the
Workmen's Compensation Act for any employees of the Cities.
11. The County shall indemnify, save, and hold harmless the Cities and all of their agents and
employees of and from any and all claims, demands, actions or causes of action of whatsoever
nature or character arising out of, or by reason of, the performance of any work by the County
provided for hereby, and further agrees to defend, without cost or expense to the Cities, its
agents or employees, any action or proceeding commenced for the purpose of asserting any
claim of whatsoever character arising in connection with or by virtue of the work to be
performed by the County.
12. , All timing of all traffic control signals provided for herein shall be determined by the County, and
no changes shall be made therein except with the approval of the County.

As part of the Washington County campus expansion project,the County is proposing to install traffic
signal controls at the intersection of 62nd Street and Osgood Ave. The County has acknowledged that it
will be paying for all infrastructure, installation and maintenance costs for this installation. Because
part of this intersection lies in the City of Oak Park Heights, Washington County is seeking a cost-
sharing agreement on the month-to-month electrical costs necessary to make such signals operational.
The estimated cost to the City is $200 per year—all signals shall be LED. 'Opticom' (emergency
signal override)will be installed at this intersection for emergency vehicles.
All utility services to these poles will be underground, except for one additional overhead line between
Xcel Energy electrical poles,but these overhead will be primarily in the City of Stillwater. (See
enclosed plans). The City Engineer has reviewed the proposed plans and has cited some concerns to
the County and should be addressed prior to construction.
The County is anticipating that St. Paul Utilities will be installing these signals in the very near future.
The County will need secure a City right-of-way permit and provide the `as-built' drawings when the
signalization project is completed.
There are many additional items to be considered by the City Council as the County project proceeds,
however, at this time the County is in need of this element and has materially complied with City
ordinances relating to `under-grounding' of facilities. At this time Staff is recommending that the
City approve the required resolution authorizing the installation of the signals subject to the
final approval of the City Engineer; as well as the Signal Maintenance Agreement for CSHA 24
(Osgood Ave) & 62nd Street subject to the final approval of the City Attorney.

APPROVING,WITH CONDITIONS,A COUNTY PROJECT WITHIN MUNICIPAL
CORPORATE LIMITS-INSTALLING AN ACTUATED TRAFFIC CONTROL SIGNAL
SYSTEM AT THE INTERSECTION OF COUNTY STATE AID HIGHWAY NO.24 AND 62ND
STREET NORTH
WHEREAS,plans showing proposed intersection signal layout of an actuated traffic control signal system at the intersection of
County State Aid Highway No. 24 and 62"d Street North within the limits of the City have been prepared and presented to the
City;and,
WHEREAS,the City is in general concurrence with the installation of such signal systems.
NOW, THEREFORE, BE IT RESOLVED that the City of Council for the City of Oak Park Heights does approve of the
installation of an actuated signal control system at the intersection of County State Aid Highway No.24 and 62nd Street North
contingent upon the final review and approval of the City Engineer and the completion of a signal maintenance agreement.

The maintenance agreement seems fine. The main thing to note is that the City will be responsible
for 50% of the electrical costs. The County will be responsible for all repair and maintenance.
Timing is also part of the County's job.
The signal layout is incomplete in its current form. For instance, there aren't any pole notes. I
know Ted Schoenecker, though, and he should put a good plan together. That being said, a couple
items for you:
• The indications on the pole are listed as 8" (the ones on the mast arms are listed as 12").
We would prefer 12" for all the indications.
• There is not a push button for crossing n-s. The plan may be for the walk to always come
on with n-s traffic. I think this is inefficient and prefer a push button to activate the walk
phase.
• There is not a indication as to whether the crossings will be count-down timers. Is that
something the City would want?
• Pedestrian crossing indicators are only provided for the west and north sides of the
intersection (only the north side will have a striped crosswalk). That's not necessarily a
problem, but the City should be aware in case they have an issue with it.
• Back detection loops are not shown for any approach. These should be on a match-line
sheet assuming the signal is fully actuated.
• Every approach except eastbound has three indications. I think an indication should be
added to pole 3 for the eastbound movement (3-3).
• There may be reasons for it, but it seems odd to me that the power source (B) is across the
street from the cabinet location (A). Just looking at this plan sheet without topo or other
geometric features, I would have places the cabinet in the northwest quadrant near the
power source.
• The mast arms are shorter than what would normally be planned for an intersection. In
general, I would want the mast arm indication on the lane line between the left/through
lane and the right turn lane. Again, there may be a reason for using these short mast arms.
